Kota Kinabalu: Thirteen illegal immigrants comprising Filipinos and Indonesians were jailed four months each. Aesimal Landu, Al paisal Abdullah, Azlan Husin Asidin, Esam Ayudin, Omar Abdul Salleh, Radzmil Umad, Rian Zulkifli, Sadri Landu, Sarah Indang, Albinar Julasdi, Sitti Yalin Julasdi, Parak Baki and Nurjima Salimuddin, aged 22 and 50, all pleaded guilty separately before Sessions Court Judge Hurman Hussain, to entering the State without their valid documents. The illegal immigrants were arrested by the Immigration team who carried out operation in Papar, Tenom, Kota Belud, Kota Marudu and Kudat in May this year. During the operation, they failed to produce their identification documents to the Immigration personnel. In asking for leniency, they informed the court that they had stayed in the State without documents for several months and years and worked as labourers, carpenters and farmers. Advertisement They asked to be deported to their respective hometowns as soon as possible. The court ordered the illegal immigrants to serve the jail sentence from the date of their arrests. After completing their jail sentence, all of them were ordered referred to the Immigration Department for further action. Kota Kinabalu: A 22-year-old baby sitter was charged with acting carelessly while taking care of a three-month-old baby girl. Cherries Ferreline pleaded not guilty before Sessions Court Judge Amir Shah Amir Hassan, to the charge against her. Advertisement She is accused of acting carelessly causing the baby to suffer injuries to the head and cheeks at 5.33pm on Dec 17, 2024 at the PPR Gayang Ria 2 in Tuaran. Kota Kinabalu: Two men were charged separately with raping their own relatives in Penampang and Tuaran, last year. Both the men who appeared separately before Sessions Court Judge Amir Shah Amir Hassan, pleaded not guilty to the charges against them. Advertisement In the first case, the 34-year-old man is accused of raping his 14 years and eight-month-old cousin at a house in a village in Penampang in July 2024. The man was charged under Section 376(1) of the Penal Code which provides for a jail term of up to 20 years and whipping, on conviction. The court set July 16 for mention and the man was released on bail of RM6,000 in two local sureties with permanent address and job. Additional conditions were imposed on the man, namely to report to Penampang police station on the first day of every month until the disposal of his case, to surrender his passport, if any, to the court and not to disturb or contact any of the prosecution witnesses especially the alleged victim. Deputy Public Prosecutor (DPP) Bryan Francis appeared for the prosecution while the man was not represented. In the second case, the 24-year-old man allegedly raped his 16-year-old niece at 11pm in June 2024 at a house in a village in Tuaran. He was charged under Section 376(3) of the Penal Code which carries a jail term of between eight and 30 years and whipping of at least 10 strokes, on conviction. His case would be mentioned back on July 17 and succeeded to obtain bail of RM6,000 in two local sureties as well as to report to the nearest police station once a month. Kota Kinabalu: A 37-year-old man was jailed four years for robbing a woman of her handbag containing her personal items. Mahadil Hasan who appeared before Sessions Court Judge Hurman Hussain, had changed his plea and admitted to the charge against him on Monday which was supposed for his trial. Advertisement Mahadil robbed Suzzylia Robin of her handbag containing a receipt from National Registration Department, a plastic bag, a birth certificate, a wallet, a set of key and a handphone at 8.15pm on Feb 9 this year at the One Stop premises in Megalong, Penampang. The charge stated that Mahadil had caused fear to Suzzylia during the incident. The offence under Section 392 of the Penal Code carries a jail term of up to 14 years and liable to a fine, or whipping, on conviction. The court ordered Mahadil to serve the jail sentence from the date of his arrest and referred to the Immigration Department upon completing the jail sentence as he did not have any document. In mitigation, Mahadil who was not represented, asked for leniency saying that he has two children to look after and requested for no whipping to be imposed on him. However, Deputy Public Prosecutor Fazriel Fardiansyah Abdul Kadir urged the court to impose an adequate sentence considering public interest and the trauma suffered by the victim. He added that the sentence should be given as a lesson not only to Mahadil but the public at large. The court heard that the incident happened while the victim was walking alone to her rented room when she realised that someone had followed her from behind and identified the person as Mahadil. She then entered the Megalong premises and went to the One Stop shop to ask help there but all the workers at that time were women. Mahadil who claimed that the woman was his wife, then grabbed her handbag and left the scene. Kota Kinabalu: A 46-year-old man, who raped his stepdaughter, was sentenced to 21 years in jail and given 12 strokes of the cane. Sessions Court Judge Elsie Primus handed the sentence to the man after making the decision at the end of defence stage and ruling that the prosecution had proven its case beyond reasonable doubt against the accused on Friday. Advertisement The man was found guilty of raping the 11-year-old stepdaughter at 1.57pm on Dec 30, 2021 at a house in Inanam. He was convicted of the offence under Section 376(3) of the Penal Code for committing incest, which provides for a jail term of between eight and 30 years and whipping of at least 10 strokes, on conviction. The court ordered the man to serve the jail sentence from the date of his conviction but granted his application to stay execution of the sentence. But the man must file the notice of appeal by today (June 14). Additionally, the court ordered the man to be placed under police supervision for three years pursuant to the Section 295 (1A) Criminal Procedure Code (CPC) as well as to undergo a rehabilitative counselling within the period of his detention under section 295A of the CPC. Seven prosecution and four defence witnesses had been called to testify during the hearing. Begging for a minimum sentence, counsel Nurul Rafeeqa Afdul Mutolip who was just appointed on the day of the decision, told the court that it was the man's first offence and had no previous conviction record. According to Nurul, the man had apologised to the daughter and his family. She added that despite of the case, the man also had performed his responsibility by supporting his wife and the victim, financially. In reply, Deputy Public Prosecutor Nurul Shafeerah Mad Iskim urged the court to impose the heaviest sentence on the man. 'This is in consideration of the fact that the man had wasted the court's time as the trial has been ongoing for so long. The witnesses brought forward by the man did not have any relevance to the case and further delayed the trial. 'The law was made to protect children below 16 years of age from sexual exploitation by someone who is clearly influential against the child, and/or someone who has familial relationship with the victim, hence the minimum eight years imprisonment punishment under section 376(3) of the Penal Code,' said Shafeerah. She further submitted that even though the man had sought apology from the victim, the trauma would forever remain as a dark chapter in the victim's life.
