Kota Kinabalu: A 46-year-old man, who raped his stepdaughter, was sentenced to 21 years in jail and given 12 strokes of the cane. Sessions Court Judge Elsie Primus handed the sentence to the man after making the decision at the end of defence stage and ruling that the prosecution had proven its case beyond reasonable doubt against the accused on Friday.
Advertisement The man was found guilty of raping the 11-year-old stepdaughter at 1.57pm on Dec 30, 2021 at a house in Inanam. He was convicted of the offence under Section 376(3) of the Penal Code for committing incest, which provides for a jail term of between eight and 30 years and whipping of at least 10 strokes, on conviction. The court ordered the man to serve the jail sentence from the date of his conviction but granted his application to stay execution of the sentence. But the man must file the notice of appeal by today (June 14). Additionally, the court ordered the man to be placed under police supervision for three years pursuant to the Section 295 (1A) Criminal Procedure Code (CPC) as well as to undergo a rehabilitative counselling within the period of his detention under section 295A of the CPC. Seven prosecution and four defence witnesses had been called to testify during the hearing. Begging for a minimum sentence, counsel Nurul Rafeeqa Afdul Mutolip who was just appointed on the day of the decision, told the court that it was the man's first offence and had no previous conviction record. According to Nurul, the man had apologised to the daughter and his family. She added that despite of the case, the man also had performed his responsibility by supporting his wife and the victim, financially. In reply, Deputy Public Prosecutor Nurul Shafeerah Mad Iskim urged the court to impose the heaviest sentence on the man. 'This is in consideration of the fact that the man had wasted the court's time as the trial has been ongoing for so long. The witnesses brought forward by the man did not have any relevance to the case and further delayed the trial. 'The law was made to protect children below 16 years of age from sexual exploitation by someone who is clearly influential against the child, and/or someone who has familial relationship with the victim, hence the minimum eight years imprisonment punishment under section 376(3) of the Penal Code,' said Shafeerah. She further submitted that even though the man had sought apology from the victim, the trauma would forever remain as a dark chapter in the victim's life. Couple held for series of housebreaking, robbery cases since January
MELAKA: Police have arrested a couple suspected of involvement in seven housebreaking and robbery cases in Melaka and neighbouring states since January. Melaka Tengah police chief Assistant Commissioner Christopher Patit said the unemployed couple, aged 24 and 31, were arrested in Kuala Kurau, Perak, on June 4. "On May 28, police received two reports involving housebreaking and robbery in the Melaka Tengah district, linked to the couple. "Their modus operandi included targeting homestays and stealing various electrical appliances and furniture," he said in a statement today. Initial investigations found they were involved in three housebreaking and robbery cases in Melaka Tengah, and four others in Kuala Lumpur and Selangor. The case is being investigated under Section 457 of the Penal Code for housebreaking and Section 392 for robbery. In a separate development, Christopher said a clothing dealer was arrested for allegedly firing a shot from an air pistol at Jalan Johor, Semabok, on June 8. "Following intelligence gathering and a public tip-off, the 35-year-old suspect was arrested in Puchong, Selangor, on June 17. Police also seized a black bag, a silver-black air pistol bearing the inscription Pietro Beretta Gardone V.T., a speed loader, and 30 ball-bearing bullets. The suspect has been remanded for seven days until June 23 to assist in the investigation under Section 33 of the Arms Act 1960 and Section 427 of the Penal Code for mischief. Retiree loses over RM500,000 in fake investment scam
JOHOR BARU: A 57-year-old retiree has lost more than RM500,000 after falling victim to a fake investment scheme advertised on social media. Seri Alam OCPD Asst Comm Mohd Sohaimi Ishak said the man, who previously worked in the private sector, came across an online advertisement on Facebook in March and decided to click on it. 'The victim was enticed by the promise of high returns in a short period. Believing he was investing in the scheme, he deposited a total of RM535,766 into five different bank accounts from March 13 to June 5,' he said in a statement on Saturday (June 21). ACP Mohd Sohaimi said the retiree conducted a total of 26 bank transactions. 'He realised something was wrong when he was asked to transfer more funds to cash out his profits,' he said, adding that the victim lodged a police report on Tuesday (June 17). 'The public are reminded to check unknown bank account numbers using the police's SemakMule portal because early investigations revealed that the five bank accounts involved in this case were linked to 22 other investment scam cases,' he said. The case is being investigated under Section 420 of the Penal Code for cheating, and action will also be taken against those who allow others to use their bank accounts as mule accounts.

46 foreigners nabbed after riot at Penang workers' hostel
BUKIT MERTAJAM: A riot among foreign workers broke out at a workers' hostel in The Summit Bukit Mertajam building late last night, leading to the arrest of 46 people. Seberang Prai Tengah district police chief Assistant Commissioner Helmi Aris said police received a tip-off at 10.42pm about a gathering of foreign workers in the building's courtyard. He said initial investigations revealed that the premises had been repurposed as a workers' hostel by a company based in the Bukit Minyak industrial area. He said the company had implemented strict regulations prohibiting smoking and alcohol consumption within the hostel. "The unrest is believed to have been triggered by frustration among workers towards the hostel warden, a fellow foreign national, who had been collecting fines from those violating these rules — allegedly without the company's knowledge or authorisation. "Tensions escalated when a group vandalised a company van parked in front of the building," he said in a statement. The case is being investigated under Section 148 of the Penal Code for rioting with weapons. Helmi confirmed that police had arrested 46 male foreign nationals in connection with the incident. "A remand order has been granted by the Bukit Mertajam magistrate's court for four days, allowing investigations to continue until June 24," he added.
