
Delhi notifies community service guidelines for minor offences under new laws
New Delhi: Delhi govt's home department has notified 12 community services that a court may assign to individuals convicted of minor offences. These include cleaning and maintaining hospital wards and peripheral areas, weeding roadsides, cleaning public parks and spaces and arranging or binding books in public libraries.
In a gazette notification, the department said that the High Court of Judicature had made guidelines for awarding community services as punishment. "They are not intended to curtail the discretion of the court in awarding any other mode of community service under Section 4 (f) of the Bharatiya Nyaya Sanhita, 2023," the notification said.
The department also specified the duration of community services, ranging from one day to 31 days or 40 hours to 240 hours.
According to officials, BNS and Bharatiya Nagarik Suraksha Sanhita, introduced community service as a punitive measure from July 2024 for some offences, such as attempted suicide, unauthorised trading by public servants, petty thefts, public drunkenness and defamation.
Senior advocate Amit Chadha, said that under Section 4(f) second-class magistrates could impose sentences including imprisonment up to one year, fines up to Rs 10,000, or both, or community service.

"The presiding judge maintains complete discretion in determining whether an accused person qualifies for community service," Chadha explained.
For public servants engaged in unlawful trade (BNS Section 202), the punishment includes simple imprisonment for one year, a fine, or both, or community service. BNS Section 209 (non-appearance in response to proclamation under BNSS section 84(1)) carries three years' imprisonment, a fine, or both, or community service.
Attempted suicide to influence exercise of lawful powers (BNS section 226) is punishable by one year's imprisonment, a fine, or both, or community service.
First-time offenders convicted of theft under Rs 5,000 (BNS Section 303(2)) may receive community service upon property value restitution. Public intoxication causing disturbance (BNS Section 355) carries 24 hours' simple imprisonment, Rs 1,000 fine, or both, or community service.
Defamation (BNS Section 356(2)) is punishable by two years' simple imprisonment, a fine, or both, or community service.

said the Indian criminal justice system under the earlier Code of Criminal Procedure, 1973, did not expressly recognise community service as an independent form of punishment. "Despite this absence, the Indian Judiciary, guided by the principles of reformative justice system, has in cases innovatively imposed community service as punishment.
Earlier, only Section 18 of the JJ Act, 2015, defined community service as punishment," said Ahlawat.
Courts assigned community service to first-time or minor offenders at their discretion before BNS, pointed out advocate Manoj D Taneja. "The new codes formalise this practice and incorporate community service as a penalty for minor infractions," he said.

Family held hostage in Darbhanga village, jewellery worth Rs 10 lakh looted
Patna: A group of armed criminals broke into a house at Belahi village under Chotaipatti panchayat in Darbhanga district late on Saturday night and escaped with jewellery worth about Rs 10 lakh and Rs 8,500 in cash. The criminals tied the hands and legs of the houseowner's grandson and forced the women to remove their jewellery. Following the incident, a special investigation team (SIT) was formed by Darbhanga SSP, Jagunath Raddi, on Sunday to probe the incident. "We have formed special teams for investigation, and some suspects have been identified through technical surveillance. We are working with local residents to gather information. Some evidence has been collected from the crime spot, and arrests will be made soon," stated the SSP. The incident occurred at the house of one Mohammad Tufail Ahmad, a resident of Belahi village under Sadar police station area. According to the complaint filed at the police station, the family was asleep when they heard a knock at the door around 1am. When Tufail inquired about the visitors, the criminals forcibly broke in, threatening the family and physically assaulting his daughter. The criminals spent about 30 minutes breaking into a locked room while positioning themselves strategically around the house. They tied Tufail's grandson and forced the women to remove their jewellery. "They took everything, including Rs 8,500 kept for household expenses. They took the jewellery belonging to my wife, daughter and daughter-in-law," said Tufail. The SSP visited Tufail's house. The local mukhiya, Pappu, confirmed the incident. "The police are investigating the incident from different angles to solve the case and prevent such incidents in the future," added the SSP.

329 booked in Cyberabad drunk driving crackdown
A total of 329 individuals were booked by the Cyberabad Police for driving under the influence of alcohol during the weekend. Of the total cases registered, 248 were two-wheeler riders, 23 were three-wheeler drivers, 54 were operating four-wheelers, and four were behind the wheels of heavy vehicles. As per the data shared by the police, as many as 283 drivers registered Blood Alcohol Concentration (BAC) levels between 35 mg/100 ml and 200 mg/100 ml. Another 37 individuals had BAC readings between 201 mg/100 ml and 300 mg/100 ml, while nine were found with dangerously high levels between 301 mg/100 ml and 500 mg/100 ml. The Cyberabad Police warned that in cases where an inebriated driver causes a fatal crash, they will be booked under Section 105 of the Bharatiya Nyaya Sanhita, 2023, which pertains to culpable homicide not amounting to murder. The section carries a maximum punishment of 10 years in prison along with a fine. Police urged citizens to refrain from drunk driving to help maintain safety on the roads.

Citing left-wing extremism, US issues advisory cautioning against travel in parts of Odisha
BHUBANESWAR: The US has flagged parts of Odisha in its travel advisory, urging its citizens to exercise increased caution while travelling. Citing concerns over terrorism, crime and civil unrest, the US Department of State has issued a Level-2 alert for India, warning of sporadic incidents linked to left-wing extremism in parts of the country. The presence of Maoist activities in Odisha has awarded the state a place among 14 Indian states where travellers' safety may be compromised included in the advisory. The June 18 advisory warned its citizens against travel to south-western Odisha, which it lists among regions impacted by Maoist violence. It specifically lists attacks targeting security forces and government officials in rural areas, including those bordering Chhattisgarh and Andhra Pradesh. 'Attacks against officers of the Indian government continue to occur sporadically in the rural parts of Chhattisgarh and Jharkhand that share a border with Telangana, Andhra Pradesh, Maharashtra, Madhya Pradesh, Uttar Pradesh, Bihar, West Bengal, and Odisha. Southwest areas of Odisha are also affected,' the advisory stated. While the state capital, Bhubaneswar, and major urban areas have been cited as unaffected by these restrictions, the US government has asked its employees to obtain special authorisation before travelling to regions beyond the capital.
