Officers told to get director's approval before sending summons to lawyers: ED
NEW DELHI: The Enforcement Directorate (ED) on Friday said it has directed its investigating officers not to issue summons to any advocate in violation of the protection extended to advocate-client privileges under Section 132 of the Bhartiya Sakshya Adhiniyam (BNS) and stipulated that summons could only be issued to lawyers under the exceptions provided in the law after the director's approval. Enforcement Directorate (FILE IMAGE) The circular to the federal agency's field formations came hours after ED withdrew the summons issued to two senior lawyers, Arvind Datar and Pratap Venugopal, after the Supreme Court Advocates on Record Association (SCAORA) asked Chief Justice of India Bhushan R Gavai to take up the case. Section 132 of BNS protects the advocate-client privilege and bars lawyers from disclosing communications between them and their clients. However, the section provides for three exceptions when this protection from disclosure shall not apply. In a statement, ED said Friday's circular was issued for guidance of field formations on Section 132 of BNS. 'Further if any summons needs to be issued under the exceptions carved out in proviso to Section 132 of the BSA, 2023, the same shall be issued only with the prior approval of the Director, ED,' the agency statement said. The agency also clarified that the summons were issued to Venugopal in his capacity as independent director of Care Health Insurance Ltd (CHIL), and not as a lawyer. 'In view of the fact that Pratap Venugopal is a Senior Advocate in the Supreme Court, the summons issued to him has been withdrawn and same has been communicated to him,' ED said. 'In the said communication, it has also been stated that if any documents will be required from him in his capacity as an independent director of CHIL, the same will be requested from him to be submitted by email,' the agency said. The financial crimes probe agency is looking into money laundering allegations in connection with a case in which shares of Care Health Insurance Ltd (CHIL) were issued at a much lower price in the form of ESOPs on May 1, 2022, despite the rejection of the same by Insurance Regulatory and Development Authority of India (IRDAI).

Temple panel head booked after 14yoson of retired col suffers electric shock
Dehradun: Police in Dehradun's Garhi Cantt registered a case against the head of a temple's caretaking committee after the 14-year-old son of a retired Army Colonel allegedly suffered an electric shock when he came in contact with metal stairs to which a live wire was attached. Police said the incident took place at Durga temple in Dakra market in Garhi Cantt on May 23, but came to light after a complaint was lodged on May 27, which was converted into an FIR on Thursday. Sub-inspector Mohan Negi of Cantonment police station, who is investigating the case, said a complaint was filed by col Nishith Thakur (retd) who went to visit the temple with his wife and two sons, aged 6 and 14. "He (Thakur) alleged that while entering the temple through metal stairs, his son suffered an electric shock as someone negligently attached a live wire to the stairs. His son collapsed on the ground after losing consciousness. He was rushed to hospital and admitted to the ICU. Col Thakur then lodged a complaint against the temple caretaking committee head, Tarsem Lal Rana," said Negi. The SI added that based on the complaint, a case was registered under BNS section 125 (b) (act endangering life) against Rana. Faridabad mishap: House owner, worker die in septic tank; cops book deceased for negligence
Representative Image FARIDABAD: Over a month after the owner of a house in Sikri village and a daily wager he hired to clean a septic tank choked to death inside it, allegedly after inhaling toxic gases, police on Wednesday booked the deceased owner of the house. Police said Mukesh , an egg hawker, tried to rescue Anand —a daily wager from the same village—when the latter collapsed inside the tank. On May 14, Anand brought along Ravi to clean the tank at Mukesh's house. As the two descended inside it without any safety equipment, Anand inhaled toxic gases and fell unconscious, while Ravi managed to exit with Mukesh's help. The house owner then jumped inside to save Anand but succumbed to the fumes himself. Now, Sector 58 police have booked deceased Mukesh for causing death due to negligence following the complaint of Anand's wife, Anita of Palwal, who accused Mukesh of not providing safety gear to her husband before making them clean the septic tank. The accused was booked under section 106 of BNS and under relevant section 9 of the Prohibition of Employment as Manual Scavengers and their Rehabilitation Act, 2013. Anand is survived by a wife, two daughters, and a son. by Taboola by Taboola Sponsored Links Sponsored Links Promoted Links Promoted Links You May Like เทรด CFDs ด้วยเทคโนโลยีเทรดสุดล้ำ และ รวดเร็วกว่า IC Markets อ่านเพิ่มเติม Undo He resided with his sister in Sikri village. Immediately after the incident on the fateful day, Mukesh's family raised an alarm, prompting neighbours to rush in and pull out the victims using a rope. Anand and Mukesh were rushed to the nearby Civil Hospital, where doctors declared them dead. A team from Sector 58 police station arrived to inspect the tank after being informed about the deaths around 3 pm. Vinod, the SHO of Sector 58 police station, said that a leakage in the septic tank caused asphyxia. 'Mukesh gave the cleaning contract to Anand, who brought Ravi with him. Initially, they intended to clean only a small drain entry. But later, they decided to clean the entire septic tank without using any masks. They should have used a proper mask and other equipment before entering the tank. It is always risky to enter such underground tanks that are full of toxic gases,' he added.
