
False claims: Jail, fine for ex-Rela officer

Kota Kinabalu: A former Rela officer from Tenom who told the court that he submitted the false claims for the assignment allowances during the implementation of the Movement Control Order (MCO) as he wanted to help the Tenom Rela personnel whose income was affected at that time, was jailed 14 days and fined a total of RM147,160 for seven counts of submitting false claims. Venantius Masingga, 63, said this in mitigation after he pleaded guilty to the charges against him before Sessions Court Judge Jason Juga, on Wednesday.
Advertisement He told the court that the money which he obtained using the fake claims were not for his personal use but to buy food baskets for the Tenom Rela personnel affected by the implementation of MCO at that time. According to Venantius, he did not mean to commit the offence but forced to do so to help the Rela personnel. Originally, Venantius have 18 charges against him but he only pleaded guilty to the second, third, fourth, fifth, sixth, seventh and eighth charges while the rest were taken into consideration by court in accordance with Section 171A of the Criminal Procedure Code. The sentences imposed on Venantius as follows: Second count – two days' jail and fined RM16,160 in default three months' jail.
Third count – two days' jail and fined RM27,680 in default three months' jail.
Fourth count - two days' jail and fined RM24,400 in default three months' jail.
Fifth count - two days' jail and fined RM21,240 in default three months' jail.
Sixth count - two days' jail and fined RM19,200 in default three months' jail.
Seventh count - two days' jail and fined RM18,640 in default three months' jail.
Eight count - two days' jail and fined RM19,840 in default three months' jail. The court ordered Venantius to serve the jail sentences concurrently. Venantius did not pay the fines. The charges stated that Venantius had submitted the MCO assignment allowance claims under the names of his wife and children who actually never performed their duties during the MCO with the intention of deceiving the Director of Rela Sabah. He committed the offence between March 2020 and August 2021 at the Rela Sabah Headquarters. The offence under Section 18 of the Malaysian Anti-Corruption Commission (MACC) Act 2009, which is punishable under Section 24(2) of the same Act provides for a jail term of up to 20 years, or a fine of not less than five times the amount or value of the bribe, or RM10,000, whichever is higher, upon conviction. In mitigation, Venantius who was not represented, asked for leniency saying that it was his first offence and very remorseful as well and promised not to repeat the offence in future. He added that he was suffering from hypertension and that he has two small and schoolchildren to look after. Venantius also told the court that he had served 20 years as army, 20 years as Rela personnel and six years being a coach for National Service Training Programme (PLKN). 'I will get ready to do community service if the court orders so,' said Venantius. However, MACC Prosecuting Officer Rekhraj Singh urged the court to hand down an appropriate sentence taking into consideration the rampancy of the case as well as seriousness of the offence. MACC to question 20 witnesses in highway probe
KUALA LUMPUR: About 20 witnesses will be called by the Malaysian Anti-Corruption Commission (MACC) next week as part of its ongoing probe into the alleged misappropriation of sukuk funds meant for the construction of a highway in the Klang Valley. MACC chief commissioner Tan Sri Azam Baki said this includes recalling witnesses who had previously given statements in order to gather further information on the fund, which is worth millions of ringgit. He said the commission aimed to complete the investigation paper within two months. "As of now, the investigation team is scrutinising various documents, including bank records that we must analyse, and recording statements from bank personnel to verify the contents of the bank statements," he told Buletin TV3 today. However, he said that there is currently no need to conduct a new search or recall the corporate figure with a "Tan Sri" title who has been linked to the case. MACC investigators had recorded the corporate figure's statement three times, working alongside a tactical team due to suspicions of weapon and asset possession related to the misappropriated funds. MACC has so far seized RM141 million worth of assets in Malaysia linked to the case and is currently tracking RM15 million in foreign assets.

Drugs: Man freed from two charges

Kota Kinabalu: A 25-year-old, charged with two counts of having drugs, was freed from the charges after full trial. Sessions Court Judge Dayang Ellyn Narisa Abang Ahmad discharged and acquitted Mohd Jamri Basir, after ruling that the prosecution had failed to prove its case beyond reasonable doubt against Jamri. The court made the decision at the end of the defence stage. On the first count, Mohd Jamri was accused of having 158.6gm of cannabis at 10.30pm on May 15, 2020 at Angkasa Apartment in Jalan Tuaran Bypass, here. Bomoh freed of rape charges against teen

Kota Kinabalu: A self-proclaimed traditional healer (bomoh) was freed from two charges of raping a university student, without his defence being called. Sessions Court Judge Marlina Ibrahim discharged and acquitted Ronie Apolinario, 55, after ruling that the prosecution had failed to establish a prima facie case against Ronie. In making the decision, the court stated that the court had thoroughly evaluated all the evidence and submissions before determining that the prosecution had not proven the essential elements of either charge. 'Having read and considered both parties' written submissions in enclosures 43, 46, and 47, and upon maximum evaluation of the evidence, the court finds that the prosecution has failed to prove the ingredients of the offence in the first and second charges. 'Accordingly, a prima facie case has not been made out,' Marlina said. On the first charge, Ronie was accused of raping the 19-year-old girl between 11am and 1pm on June 17, 2021 at a rented room in Lorong Kelapa Bersaudara, Kolombong, Inanam, near here. Advertisement On the second charge, he allegedly raped the same girl between 1.15pm and 3pm on Sept 3, 2022 at a room of a lodging house in Kg Air, here. He was charged under Section 376(1) of the Penal Code, which provides for a jail term of up to 20 years' jail, and whipping, upon conviction. The prosecution had called four witnesses during the hearing which started in October 2024 and concluded on Dec 9, 2024. Deputy Public Prosecutor DK Afiqah Alya conducted the prosecution while counsel Azhier Farhan Arisin represented Ronie.
