MACC detains two individuals for submitting false particulars in RM8.1 mln fraud

PUTRAJAYA: Two individuals have been arrested by the Malaysian Anti-Corruption Commission (MACC) on suspicion of submitting false particulars amounting to approximately RM8.1 million, involving the provision of machinery rental services, facilities, and waste disposal.
According to sources, a former company owner and a former Chief Financial Officer, both in their 40s to 50s, were arrested around 6:30 pm yesterday when they arrived to give their statements at the MACC Headquarters here.
'Both suspects are believed to be involved in corruption and money laundering for the provision of machinery and facility rental services between 2019 and 2021.
'Additionally, the investigation also focuses on claims for waste disposal services that occurred from January to October 2022, as well as the receipt of bribe money,' the source said.
The source added that MACC's investigation is also identifying other criminal offences under the Penal Code and money laundering activities.
Through 'Op Flora,' conducted by MACC's Special Operations Division (BOK) at 11 premises around the Klang Valley and Negeri Sembilan yesterday, MACC has frozen 76 bank accounts, comprising individual and company accounts, totaling approximately RM1.68 million.
The source informed that both individuals are currently remanded for one day after Magistrate Irza Zulaikha Rohanuddin allowed the MACC's application at the Putrajaya Magistrate's Court.
Meanwhile, MACC Special Operations Division Senior Director, Datuk Mohamad Zamri Zainul Abidin, when contacted, confirmed the arrests and stated that the case was being investigated under Section 18 of the MACC Act 2009.

KUALA LUMPUR: The Sessions Court today set 15 days of trial next year beginning April 13, for the case involving FashionValet Sdn Bhd founders Datin Vivy Sofinas, known as Vivy and her husband Datuk Fadzarudin Shah Anuar, who are facing charges of criminal breach of trust (CBT) involving RM8mil in investment funds from Khazanah Nasional Berhad (Khazanah) and Permodalan Nasional Berhad (PNB). Judge Rosli Ahmad set the trial dates for April 13 to 17, May 18 to 22, and June 8 to 12, 2026. "The trial will run for 15 days, and the court has set the next case mention for Oct 27,' said Rosli. Earlier, Deputy Public Prosecutor Datuk Wan Shaharuddin Wan Ladin requested the court fix the trial dates agreed upon by both the prosecution and defence. Lawyer M. Athimulan is representing the couple. Wan Shaharuddin told the court that the prosecution will call 26 witnesses to testify. The accused, both 37, were not present in court today as their attendance had been exempted. On Dec 5 last year, Vivy and Fadzarudin pleaded not guilty to a charge of committing CBT in their capacity as directors of FashionValet Sdn Bhd. They were accused of misappropriating investment funds entrusted to them by Khazanah and PNB by transferring RM8mil from FashionValet Sdn Bhd's company account to 30 Maple Sdn Bhd without the approval of FashionValet's board of directors. The offence was allegedly committed at Public Bank Berhad, Bukit Damansara Branch, 36-40 Medan Setia 2, Plaza Damansara, Bukit Damansara, here, on Aug 21, 2018. The charge, framed under Section 409 of the Penal Code, read together with Section 34 of the same Code, provides for a minimum sentence of two years and a maximum of 20 years in jail, whipping, and a fine upon conviction. They also pleaded not guilty to an alternative charge of jointly and dishonestly misusing company property, namely, RM8mil in investment funds from Khazanah and PNB belonging to FashionValet Sdn Bhd under Section 403 of the Penal Code, read together with Section 34 of the same Code, which provides for an imprisonment of between six months and five years, along with caning and a fine upon conviction. - Bernama

KOTA KINABALU, June 23 — Another politician in the Gabungan Rakyat Sabah state administration has been summoned to the Malaysian Anti-Corruption Commission (MACC) office here today, the latest development in the mining scandal that began last year. According to news portal Info X, Industrial Development and Entrepreneurship Assistant Minister Datuk Andi Muhammad Suryady Bandy arrived at the MACC Sabah office at around 9am today, accompanied by two lawyers, to give his statement. In December last year, a video of Andi was published by Malaysiakini showing him in discussion with a businessman over the procurement of a mining licence. Andi, who is from Barisan Nasional, is the Kalabakan MP and Tanjung Batu state assemblyman. Last week, MACC Chief Commissioner Tan Sri Azam Baki said that three individuals, including two state assemblymen, are expected to be charged later this month as officers begin the process of arrest. Aside from Andi, two other men have been named in media reports as those who may be charged. Sindumin assemblyman Datuk Yusof Yacob — who heads the state's investment arm Qhazanah Sabah Berhad — was questioned by MACC Sabah for nearly four hours last Wednesday. The third individual expected to face charges is businessman Albert Teh, who had brought forward the series of videos that sparked the prospecting licence scandal. KUALA LUMPUR: Senior lawyer Datuk Dr Gurdial Singh Nijar has criticised the Malaysian Anti-Corruption Commission (MACC) for obtaining an ex parte order to freeze millions of assets linked to the family of the late Tun Daim Zainuddin, calling the move a breach of natural justice. An ex parte application is a legal request made to the court by one party without notifying or involving the other party. Guardial, who appeared for Daim's widow Toh Puan Na'imah Abdul Khalid, said the prosecution's failure to name a respondent in the asset-freezing application was not only procedurally flawed, but also denied the affected parties a fair hearing. "I am perplexed and disappointed that a body like the MACC would proceed in this manner. "The person affected must be named. You are effectively crippling someone by freezing their assets for a year," he said during proceedings before judge K. Muniandy here today. Gurdial is submitting in his bid to quash MACC's ex parte application to freeze more than RM544 million in investment funds in Singapore belonging to Na'imah and her family members. When met after the hearing, Gurdial described the application as extraordinary, saying it could take the justice system "back to barbaric times". "The person holding the property is directly affected and the order effectively prohibits them from dealing with the property. "Before such an order can be made, the individual must be named as a party and be given the opportunity to respond." MACC had earlier argued that preliminary investigations showed that the assets were derived from undeclared income in Malaysia and were being held under Na'imah's and her family members' names through various investments in foreign currency. MACC Chief Commissioner Tan Sri Azam Baki reportedly said eight new investigation papers related to Daim's family had been opened as part of the probe into properties valued at over RM2 billion. He said the commission had been conducting a probe into Daim since February 2023 and had opened several investigation papers. Daim died on Nov 12 last year at age 86. Following his passing, the Kuala Lumpur Sessions Court discharged and acquitted him of charges related to failing to comply with a notice under Section 254 of the Criminal Procedure Code.
