'Extraordinary and barbaric': Lawyer tears into MACC's ex parte move to freeze Na'imah's assets

KUALA LUMPUR: Senior lawyer Datuk Dr Gurdial Singh Nijar has criticised the Malaysian Anti-Corruption Commission (MACC) for obtaining an ex parte order to freeze millions of assets linked to the family of the late Tun Daim Zainuddin, calling the move a breach of natural justice.
An ex parte application is a legal request made to the court by one party without notifying or involving the other party.
Guardial, who appeared for Daim's widow Toh Puan Na'imah Abdul Khalid, said the prosecution's failure to name a respondent in the asset-freezing application was not only procedurally flawed, but also denied the affected parties a fair hearing.
"I am perplexed and disappointed that a body like the MACC would proceed in this manner.
"The person affected must be named. You are effectively crippling someone by freezing their assets for a year," he said during proceedings before judge K. Muniandy here today.
Gurdial is submitting in his bid to quash MACC's ex parte application to freeze more than RM544 million in investment funds in Singapore belonging to Na'imah and her family members.
When met after the hearing, Gurdial described the application as extraordinary, saying it could take the justice system "back to barbaric times".
"The person holding the property is directly affected and the order effectively prohibits them from dealing with the property.
"Before such an order can be made, the individual must be named as a party and be given the opportunity to respond."
MACC had earlier argued that preliminary investigations showed that the assets were derived from undeclared income in Malaysia and were being held under Na'imah's and her family members' names through various investments in foreign currency.
MACC Chief Commissioner Tan Sri Azam Baki reportedly said eight new investigation papers related to Daim's family had been opened as part of the probe into properties valued at over RM2 billion.
He said the commission had been conducting a probe into Daim since February 2023 and had opened several investigation papers.
Daim died on Nov 12 last year at age 86.
Following his passing, the Kuala Lumpur Sessions Court discharged and acquitted him of charges related to failing to comply with a notice under Section 254 of the Criminal Procedure Code.

According to reports by Sabah Media, Judge Datuk Dr Lim Hock Leng states that the prosecution had proven the case beyond a reasonable doubt as the 28-year-old victim, Nur Afiyah Daeng Damin, was proven to have died due to injuries sustained from the continuous torture by the couple. The pair had also acted with common intent, as photos and videos from the accused's mobile phones depict clear evidence to record and preserve the victim's suffering. Deputy Prosecutor Raya Dacia Jane Romanus said, 'This was not a murder resulting from anger or provocation. This was a cruel and deliberate, prolonged beating. The injuries suffered by the deceased did not occur all at once, but in a series of continuous torture, which clearly shows the defendant's intention to cause death'. He added that an employer should uphold the responsibility to provide shelter, food and protection. In this case, the victim was denied any basic human rights and was tortured every day, which led to her death. Despite having sought the mandatory death penalty, the judge decided on the minimum sentence allowed under Section 302 of the Penal Code. KUALA LUMPUR: The lawyers for Toh Puan Na'imah Abdul Khalid, widow of former finance minister Tun Daim Zainuddin, have described the police's No Further Action (NFA) decision on her report as "unacceptable" and a breach of the rule of law. Lawyers Rajesh Nagarajan and Sachpreetraj Singh Sohanpal said this in a statement after the police classified the case as NFA recently. Na'imah lodged the police report on Sept 30 last year, following a Bloomberg News article alleging political interference in the MACC's investigation against Daim. The article had claimed that Prime Minister Datuk Seri Anwar Ibrahim and MACC chief commissioner Tan Sri Azam Baki were involved in a coordinated abuse of investigative powers. "This sudden NFA decision was conveyed to us via a letter received on June 21 from the Sentul police chief. "This decision is unacceptable, shocking, and contradicts principles of good governance and the rule of law. "For nine months, the police and the Attorney-General's Chambers (A-GC) remained silent on Na'imah's police report. "The NFA decision came only days after she lodged a complaint with the Independent Police Conduct Commission (IPCC) over the continued failure of authorities to act on her report. "No information was provided regarding who was questioned, what steps were taken, or the actual reasons behind the NFA decision," said the statement. The statement said the report contained serious matters of public interest and should not have been dismissed without proper explanation or accountability. The decision severely undermines the integrity of the police and the Attorney-General's Chambers (AGC), and confirms the deterioration of institutional independence under the current federal administration, it said. "We will not remain silent or be deterred in our pursuit of justice. "This matter will be pursued until the truth is revealed and justice is served. "The Malaysian people deserve institutions that serve the rakyat, not those in power," it added. Last year, a Bloomberg report, citing sources, claimed that the MACC was instructed to investigate Daim as well as former prime minister Dr Mahathir Mohamad and his sons. According to the report, the instruction was purportedly given by Prime Minister Datuk Seri Anwar Ibrahim, a claim the Prime Minister's Office denied. Anwar had said that the government was considering legal action against Bloomberg over the report that MACC acted on his instructions during investigations into certain individuals.

(Bernama pic) PETALING JAYA : The Malaysian Anti-Corruption Commission has reminded the public that whistleblower protection is only granted if reports are made directly to enforcement agencies and through proper legal channels. MACC senior director (legal and prosecution) Wan Shaharuddin Wan Ladin said there is a growing misconception that anyone who exposes misconduct is automatically protected under the Whistleblower Protection Act 2010. He said some believe they can post information on social media or speak to the press first and still claim protection. 'The law is clear. Once information is made public before a report is submitted through proper legal channels, the protection no longer applies,' Bernama quoted him as saying. Wan Shaharuddin said the law requires the whistleblower to act in good faith, without motives such as revenge, personal gain, or defamation. He said whistleblowers cannot be involved in the offence they report, citing the revocation of protection if they are found complicit under Section 11(1) of the Act. 'This is to ensure that whistleblower status is not used as a shield to escape responsibility. Integrity and intent matter,' he said. While the Act protects informants from legal repercussions, he said, many still face stigma, fear of reprisals, and a lack of public understanding about how whistleblower protection actually works. To encourage more reports, especially from civil servants, the government has introduced cash rewards and official recognition for those who report corruption through official channels. Wan Shaharuddin said as of last year, 514 civil servants had received rewards totalling more than RM1 million, with the highest individual reward amounting to RM100,000. He also noted that the Whistleblower Protection (Amendment) Bill 2025 was tabled in Parliament on March 6 to expand protections further, including immunity from civil or criminal action and safeguards against harmful retaliation. With this amendment it is hoped more individuals will come forward to report misconduct without fear, he said.
