JPSC to pay Rs 1L to candidate in recruitment case

Ranchi: Jharkhand high court on Friday imposed a cost of Rs 1 lakh on the Jharkhand Public Service Commission (JPSC), while dismissing an appeal filed by the latter against a candidate. The division bench headed by Chief Justice MS Ramachandra Rao while dismissing the appeal upheld the order of a single judge and imposed the cost of Rs 1 lakh on the Commission which is to be paid to the petitioner, Manoj Kumar Kachhap, in eight weeks. Kachhap had filed a petition before the single bench of the HC stating that he was a candidate and had applied for the post of assistant professor in 2018. He appeared for the exams after scrutiny of his documents by the commission. But at the time of interview, he was told that the fees deposited for the exam was not credited in JPSC's account and therefore his candidature could not be considered. Kachhap told the court that he wasn't informed about it before the interview. In another matter, the high court imposed a cost of Rs 8,000 on former chief minister Madhu Koda for seeking adjournment in a case for the fourth time. RANCHI: Upholding the order of single bench, the double bench of Jharkhand High Court headed by Chief Justice MS Ramachandra Rao, imposed a fine of Rs one lakh on Jharkhand Public Service Commission (JPSC) for wrongfully rejecting a qualified Scheduled Tribe (ST) candidate Manoj Kumar Kachhap's application for the post of Assistant Professor. The court had earlier reserved its judgment after hearing arguments from both the parties. Kachhap had scored 72.10 out of a possible 85 marks in the academic evaluation. However, his name did not appear in the list of candidates shortlisted for interviews. Disappointed Kachhap made an enquiry and discovered that his application had been invalidated because the online examination fee, he had paid, did not reach the JPSC account due to some technical error. Owing to non-payment of the examination fees his application was considered invalid. Significantly, his name was not mentioned in the official rejection list, leaving him unaware of the issue. Kachhap then approached Jharkhand High Court and filed a writ petition. After a thorough hearing, a single bench of the High Court had given the verdict in his favour. The single bench ordered that he be included in the interview process, noting that the final decision would hinge on the court's verdict. JPSC complied, and Kachhap appeared for the interview.

Ranchi: The Jharkhand high court on Thursday pulled up the govt for being unable to produce the status reports on biomedical waste management that it had sought from the deputy commissioners (DCs) of all districts in February.A division bench of Chief Justice MS Ramachandra Rao and Justice Rajesh Shankar was hearing a public interest division (PIL) filed by the Jharkhand Human Rights Confederation on the improper disposal of biomedical court on Thursday expressed annoyance as the DCs have not taken heed of its February order. It told the DCs to furnish the required report by June 16, when the case would next be 2024, the Jharkhand State Pollution Control Board had informed the court that biomedical waste treatment plants have been set up in five districts – Lohardaga, Ramgarh, Pakur, Dhanbad, and Adityapur in Seraikela Kharsawan. Another biomedical waste disposal plant is under construction in Deoghar and would be commissioned very soon, the board petitioner organisation had filed the petition in 2012 for compliance of the Environmental Protection Act , under which Biomedical Waste Disposal Management Rules have been formulated and ought to be implemented. In absence of the rules, biomedical waste generated from hospitals, clinics, nursing homes are required to be disposed of in a manner, which does not adversely affect the environment. But biomedical waste was littered in the open and rummaged by stray dogs, the petitioner added.

Ranchi, The Jharkhand High Court on Thursday pulled up the state government for not being able to produce reports on biomedical waste management sought from deputy commissioners of all districts. The court had, in February, ordered the deputy commissioners of all districts to inform about the status of biomedical waste disposal mechanisms in their respective areas. A division bench of Chief Justice MS Ramachandra Rao and Justice Rajesh Shankar was hearing a public interest litigation filed by Jharkhand Human Rights Confederation on the alleged improper disposal of biomedical waste in the state. The court, while hearing the petition, expressed its annoyance at the point that despite directions of the bench, the deputy commissioners of different districts have not paid heed to the previous order. The bench granted another opportunity to the deputy commissioners to furnish the required report about the disposal of biomedical waste in their districts. The case will again be heard on June 16. Earlier, it was informed by the Jharkhand State Pollution Control Board that biomedical waste treatment plants have been set up in five districts- Lohardaga, Ramgarh, Pakur, Dhanbad and Seraikela Kharsawan. A biomedical waste disposal plant is under construction in Deoghar and will be commissioned very soon, the board informed. The organisation had filed the petition for compliance with the Environmental Protection Act, under which Biomedical Waste Disposal Management Rules have been formulated and ought to be implemented. Ranchi: The state govt on Wednesday informed the Jharkhand high court that investigation into the alleged leak of question papers of the Jharkhand Staff Selection Commission Combined Graduate Level (JSSC CGL) exam would be completed within a month's time. Investigation done till now has not revealed that question paper was leaked, he added. A division bench of Chief Justice MS Ramachandra Rao and Justice Rajesh Shankar were hearing a public interest litigation (PIL) filed for an independent probe into the alleged leak of question papers of the JSSCCGL exams. Earlier, the court had clamped a stay on the release of results of the exams and directed the govt to initiate investigation through the police. The stay on the publication of results will continue. The JSSCCGL examinations were conducted by the conducted by the Jharkhand Staff Selection Commission (JSSC) on January 28, 2024. There were allegations of leak of question paper due to which the examination was cancelled. The exams were again conducted on September 21 and September 22 last year. It was again alleged that the papers were leaked. The examinations were conducted to fill 2025 vacant posts across different departments in the state govt. The case would next be heard on June 18.
