Child custody case: Allahabad HC directs Maharashtra DGP, Pune CJM to declare father absconder
The Lucknow bench of the Allahabad high court has directed the Maharashtra director general of police (DGP) and the Pune chief judicial magistrate (CJM) to initiate proceedings under the Bharatiya Nagarik Suraksha Sanhita (BNSS) to declare a man an absconder after he repeatedly failed to produce his three-year-old child before the court in a habeas corpus plea filed by the child's mother. Justice Rajeev Singh, presiding over the vacation bench, on June 12 also ordered the attachment of the father's property under Sections 84 and 85 of the BNSS (corresponding to Sections 82 and 83 of the CrPC), emphasising the urgency of securing his appearance. The court listed the matter for the next hearing on August 1, 2025. The petitioner, the child's mother, had approached the court last year alleging that the father, originally from Ayodhya and currently residing in Pune, had taken away the child illegally from her lawful custody and denied her access to the child. She maintained that only she could care for the child due to the child's age and well-being. The court expressed strong displeasure over the father's conduct, noting that although he appeared on some earlier dates, he later began evading the court. Despite multiple directions, he has failed to present the child, prompting the bench to issue a non-bailable warrant (NBW) on a previous occasion. However, when Pune police attempted to execute the NBW, they found the father missing, and a missing person report was filed by his mother. The court further ordered the senior registrar to communicate its June 12 order/ directions to the Maharashtra DGP and the Pune CJM for immediate compliance.

School teacher booked for taking leave over ‘false miscarriage'
Bijnor: A case was registered against a govt primary school teacher and six others, including the former and the current Basic Shiksha Adhikari (BSA) in Amroha district, after she was accused of availing leave by falsely claiming a miscarriage. Teacher Varsha Gupta, 41, currently posted at a primary school in Papsara village of Joya block, allegedly took 42 days of leave from July 4 to Aug 14, 2016 claiming treatment after a miscarriage. In 2018, local lawyer Manu Sharma filed a complaint alleging Gupta took paid leave without submitting the required medical documents. However, no action was taken. In 2022, he filed an RTI request with the then Block Education Officer of Joya. The response revealed that Gupta's leave was approved and her salary paid in full despite the absence of a medical certificate. Sharma accused departmental officials of negligence, alleging they failed to act on his earlier complaint. In 2024, he approached the chief judicial magistrate (CJM) court, which recently directed the Kotwali police to file an FIR against those involved. SHO Pankaj Tomar said, "The FIR was registered on Tuesday against Gupta, two BSAs, the block education officer, a clerk, and others under IPC sections 420 (cheating), 120B (criminal conspiracy), and 409 (criminal breach of trust)."

Delhi court orders FIR in 2023 custodial death case, cites injury marks and need for probe
NEW DELHI: A Delhi court has directed that an FIR be registered in connection with the alleged custodial death of a man at a city police station last year, stating that a cognisable offence appears to have been committed and warrants thorough investigation. Chief Judicial Magistrate Vasundhara Chhaunkar of Rohini Courts passed the order on an application filed by Setara Bibi under Section 156(3) of the Criminal Procedure Code. She sought a probe into the death of her husband, Sheikh Saadat, who died while in Delhi Police custody on the night of July 22–23, 2023. The Court, citing photographs and video footage, noted visible injury marks across the deceased's upper and lower back. Observing the matter raised serious questions, the CJM said the investigation must examine both the cause of death and technical aspects related to CCTV footage and preservation efforts. 'Though the inquest report is on record, the same can be considered at the appropriate stage. To dismiss the present application only on the basis of the inquest report will not serve the purpose of justice where the complainant is not in a capacity to record or collect extensive evidence,' the Court said in its May 28 order. According to Bibi, her husband and four others were stopped by police at Netaji Subhash Place on July 21, 2023. After he questioned the officers, they allegedly became aggressive and took all five men to the police station. The next day, an FIR under the Arms Act was registered. On July 23, Bibi was informed her husband had died. Bibi alleged that Saadat's body had black and blue marks across his chest, back, and legs. The CJM directed the concerned SHO to register the FIR and submit a compliance report by June 28.
