Bengaluru: Karnataka high court has ruled that the insurance company must cover compensation for an accident involving a relief or spare vehicle used following the breakdown of a scheduled bus. The court stated that such use doesn't constitute a fundamental breach of permit conditions exempting the insurer from liability. The court's decision came after it allowed appeals filed by two victims and the bus owner in connection with an accident that occurred on Jan 21, 2014. At approximately 11.45am, Ganesh and Basavaraj were travelling on a motorcycle from Mudur to Haveri. Near the sugar factory in Sangur village, a high-speed private bus collided with the motorcycle, causing both riders to fall and sustain grievous injuries. The duo subsequently filed petitions seeking compensation. On Jan 24, 2017, the motor accident claims tribunal in Haveri awarded compensation, placing liability on the bus owner, KM Altaf Hussain, on the grounds that the bus had deviated from its permitted route, violating permit conditions. Ganesh received Rs 3,71,030, and Basavaraj was awarded Rs 1,27,250. Justice Hanchate Sanjeevkumar, after reviewing the materials on record, noted that the vehicle was employed as a relief vehicle under compelling circumstances, which did not amount to a fundamental breach of conditions. He determined that the tribunal had erred by not exempting the case as per Rule 57 of the Karnataka Motor Vehicles Rules 1989, given the route deviation was under compelling circumstances. Allowing the claimants' appeals, the judge also increased the compensation payable to Ganesh to Rs 7,15,550, considering the severity of his injuries. It awarded Basavaraj Rs 2,24,810. The compensation must be paid by United Insurance Company Limited, the insurer of the vehicle.

Bengaluru: The high court refused to quash proceedings in a bribery case against Basavaraj, former commissioner of Harihara municipal council, Davanagere district. Justice M Nagaprasanna observed that "the amount of Rs 2 lakh recovered from the petitioner was lying on the teapoy in his home and not in his neighbour's house". On July 8, 2024, H Karibasappa, a materials supplier, lodged a complaint with Lokayukta police alleging that he supplied materials for water supply works of Harihara municipal council for several years. He claimed for the supplied materials worth between Rs 25 and Rs 30 lakh, Basavaraj demanded a bribe of Rs 2 lakh to generate and clear bills for the amount. Subsequently, Lokayukta police conducted a raid at Basavaraj's residence, where 400 notes of Rs 500 each were found on the tea table, leading to initiation of proceedings. Basavaraj challenged the case, arguing that nothing was recovered from his possession during the raid, thus claiming there was no legal acceptance of the bribe. Justice Nagaprasanna said, "If the petitioner did not demand any amount, why would Rs 2 lakh be lying on the teapoy in his house when Lokayukta sleuths laid a trap?" The presence of money on the tea table and the positive phenolphthalein test (his hands turned pink), constituted prima facie evidence of demand and acceptance of bribe, the judge said.

Bengaluru: Kannada Sahitya Parishat (KSP), the apex body pertaining to Kannada literature, Friday claimed the petition filed by Raajkamal Films International Chennai, producers of Kamal Haasan-starrer Thug Life, is an abuse of the process of law. The KSP, through its president Mahesh Joshi, has sought impleadment, opposing Raajkamal Films International's petition. Appearing for KSP, senior advocate S Basavaraj slammed Kamal's controversial remark that Kannada language originated from Tamil. Basavaraj said he has high regard for Kamal as an actor and even gave the example of his silent movie, Pushpaka Vimaana, which won accolades. According to Basavaraj, the actor set his own house on fire by his own conduct and now he is pleading before the high court with the request, "Please douse the flames." One cannot be an arsonist and a fire-fighter at the same time, he added. Justice M Nagaprasanna adjourned the case hearing while granting time to Raajkamal Films International to file their objections. The undertaking given by the petitioners that they will not release the film in Karnataka until the matter is resolved after holding dialogue with Karnataka Film Chamber of Commerce will continue, the judge said, while orally repeating the suggestion made by the court earlier that "discretion is the best part of valour". RAIPUR: Nambala Keshav Rao, alias Basavaraju, the general secretary of the banned Communist Party of India (Maoist) who was killed in a gunfight with security forces on May 21, was cremated in Narayanpur district under official supervision, the Chhattisgarh police said in a statement on Monday evening. The state police said no legal claimants had come forward to claim his body. 'Following the operation, the authorities recovered the bodies of 27 Maoists. Of these, 20 were claimed by their family members and were handed over after due verification. However, no one came forward to claim the body of Basavaraju, who was carrying a reward of ₹1 crore announced by the Chhattisgarh government, with additional reward from other states and central agencies,' the statement said. Basavaraju, the top leader of the CPI (Maoist) since 2018, was among the 27 Maoists killed in a gunfight with District Reserve Guard (DRG) in the dense Kudmel-Kalhaja-Jatloor forest area of Abujhmad on May 21. 'The cremation was carried out under the supervision of the executive magistrate after obtaining necessary legal orders. Notably, even the family of Kosi alias Hungi, one of the deceased cadres, requested local authorities to perform cremation in Narayanpur due to concerns over health hazards from decomposition,' the statement said. Monday's move comes days after the Andhra Pradesh high court on Saturday told the family members of two slain Maoist leaders, Basvaraju and Sajja Venkata Nageswara Rao alias Rajanna, to approach the Chhattisgarh police to seek custody of their bodies. Basavaraju's mother Bharatamma and Nageshwara Rao's brother Sajja Srinivasa Rao had filed separate petitions to seek directions to the police to hand over their bodies for the final rites. According to the police, Basavaraju, who was previously the head of the Central Military Commission of the banned group, was linked to over 250 criminal cases across various states. 'We have also recovered an AK-47 rifle which Basavaraju allegedly looted from security forces during the infamous 2010 Tadmetla ambush in Dantewada,' said the statement. The CPI (Maoist) has confirmed the death of its top leader in what it has called the 'Gundekot Massacre'. In a statement released by its Dandakaranya Special Zonal Committee (DKSZC), Vikalp, on Monday, it was alleged that the security forces were able to get to him due to intelligence leaks and betrayal by some. It also claimed Basavaraj was captured alive and executed and accused the government of violating a ceasefire previously proposed by Basavaraj.
