Gardeners warned over cutting hedges this month as they risk a fine

One little-known law could see householders face an unlimited fine if they trim their hedge in May.
If you're getting your garden sorted for summer it pays to know about a law that could see you hit with an unlimited fine or even jail time. Trimming your hedge this month could see you prosecuted thanks to an environmental law many might be unaware of.
Gardeners are being urged not fall foul if the laws by checking their hedges carefully before setting about them. Before getting the hedge trimmer out, they need to look for birds nesting in the hedge as intentionally damaging a wild bird nest is an offence under the Wildlife and Countryside Act 1981.

Under the act, farm hedgerows cannot legally be cut between April 1 and August 31 at all, apart from in extreme circumstances. But this would require a licence.

And while it is legal for homeowners to cut hedges at this time of year, the law states that if it causes a bird's nest to be damaged or destroyed - intentionally or otherwise - then you're still breaking the law.
Experts at Husqvana explained: 'Under Section 1 of the Wildlife and Countryside Act 1981, it's an offence to intentionally damage or destroy a wild bird's nest while it is being built or in use," reports The Express.
"That includes consciously using a hedge trimmer when there is a bird's nest in your hedge, and in the process of doing so, causing the nest to be damaged or destroyed.'
The Royal Society for the Protection of Birds (RSPB) backs this up. Wildlife experts Arbtech have explained how the act is prosecuted in practice.
They said: "Pieces of environmental legislation such as the Wildlife and Countryside Act 1981 as amended are regulated by a combination of the police, Natural England / Natural Resources Wales / Scottish Natural Heritage (based on location), the Environment Agency, the Joint Nature Conservation Committee, the Food, Farming and Countryside Commission (FFCC), the local authorities, the Partnership of Action against Wildlife Crime (PAW), various public bodies, and relevant organisations based on the endangered species in question.

"It says that a person is breaking that law if they intentionally damage a bird's nest while it's being used or built, and this applies to trimming hedges, saying: 'The moment it becomes active, it is illegal to destroy it'."
Breaking this law could land you an unlimited fine and six months in prison.
The RSPB adds: "The consequences for the above, even in the event of harm to a single bird, nest or egg, is an unlimited fine, up to six months in jail or both.

"Suffice to say, it is certainly not a risk worth taking.
"Once an action breaking the rules of the Act has been carried out, the offence will inevitably result in a police investigation.

"The police will enforce part 1 of the Act, as it focuses on the fundamental wildlife protection over wildlife species and what exactly necessitates a breach of the rules.
"In fact, dedicated departments of the police specialise in breaches of environmental and wildlife laws, such as the National Wildlife Crime Unit (NWCU) and Wildlife Crime Officers (WCOs).
"Any law relating to the environment and wildlife are taken just as seriously as any other piece of active legislation.
"Even in respect of a breach of the Act involving a single animal or habitat, the person responsible would be liable to pay a potentially unlimited fine, spend up to six months in prison, or possibly even both."

According to dad Rowen, who says he had to "hold the skin on [Bunnie's] arm together" while she awaited treatment, the dog was a small, sandy-coloured Cockapoo. Kent Police confirmed officers are investigating. Rowen said: "It happened parallel to the school on the main road. I was just walking home after the school run. The path is quite narrow, and a woman was walking her dog on the actual road itself. ‌ "Then, out of nowhere, the dog just lunged for my daughter and pulled her to the floor. The owner managed to pull the dog off, but when she did that, it ripped her skin open. I was so shocked. All I had to stop the bleeding was my hands. I had to basically hold her skin together." Rowen said: "People who saw what happened came over and said that my daughter hadn't even put her hand out to the dog. The woman just disappeared. She didn't leave any details or anything." ‌ Bunnie was rushed to Medway Maritime Hospital and then transferred to St Thomas' in Westminster the next morning. There, she had several X-rays to ensure the puncture hadn't hit her bone, before undergoing plastic surgery. According to her dad, Bunnie has been left shaken following the incident. She will need to return to hospital within a week for a check-up, and to assess whether she will need further work done. Rowen said: "She's doing well now. She's just a bit shaken and keeps talking about how scared she is of the dog. "She also has a lung condition and really bad asthma so she had to be marked down as a high-risk category for sedation. It's really upsetting that the woman didn't stop because it makes you fear for the safety of other kids." A Kent Police spokesperson confirmed an investigation is ongoing. A Scots mum was left shaken after her son was allegedly attacked by a dog at a busy local park. Nine-year-old Nicholas Quintero suffered injuries to his face after the horror incident while he and his family attended a surprise birthday party at Leith Links on Thursday night, reports Edinburgh Live. ‌ Nick's mum Maria Cedeno recalled singing happy birthday to a friend before she heard screams and turned round to find blood gushing from her son's face after the dog supposedly lunged at him. ‌ According to Maria, Nick pointed to a Bulldog-type dog as she removed him from the park and called an ambulance. Medics arrived and police were later alerted to the incident. However, Maria claims the owners of the dog attempted to mask the incident from police and initially denied any wrongdoing. Maria is now furious following the ordeal and the handling of the incident by the owners of the dog. She claims they are yet to apologise or take any accountability for the attack which has left her son "traumatised." When approached for comment Police Scotland confirmed a child was taken to hospital after being jumped at by a dog. However, images taken by Maria appear to show a bite mark on her son's body. ‌ Speaking to Edinburgh Live Maria, from Saughton, said: "I took the children to a gathering for a surprise party and it was supposed to be a fun day out and water gun fight. "The children were getting ready and everyone started singing happy birthday but all of a sudden I hear Nicholas shouting and screaming. My son's friends and him say all he did was pet the dog, there was no trigger for it to react like that. "The owners tried to tell the police there was balloons but there was none at all. When I saw all the blood I thought he had a nose bleed as it just wouldn't stop but he was covering his face and pointing to the dog. ‌ "My reaction was I have to take him out of the park and phone an ambulance. The ambulance crew phoned the police and the dog was suddenly gone. It took 30 or 40 minutes for them to admit it was their dog. "We're now in hospital as he needs surgery. He has a cut at his mouth which is properly open and can't be stitched. I'm thankful the dog couldn't properly get a hold of him or he could have lost half his face." Pictures shared by Maria show the severity of the injury sustained in the attack as he was left with a huge cut on his face pouring with blood. ‌ Maria stated that the incident has already had a significant impact on her son as he was spooked by the family's own dog when he returned home on Thursday. The attack was also witnessed by Maria's other son, who is 11-years-old, and a friend of his. Police have since confirmed the matter has been passed to the dog warden. ‌ Maria added: "It is all wrong and I want to make people cautious. I also want the owners to take accountability and responsibility as there hasn't even been an apology or a message to ask if they can help. "Two more children have been left in shock by this as his older brother and his friend were there. As owners we have to take accountability and if this was the other way around I'd be calling an ambulance and helping in any way, but there was no help." A Police Scotland spokesperson said: 'Around 6.45pm on Thursday, 19 June, 2025, officers received a report of a dog having jumped at a child in the Links Place area of Edinburgh. 'The child was taken to hospital for treatment. The matter has been passed to the dog warden.' A Scottish Ambulance Service spokesperson said: 'We received a call at 18:32 on Thursday 19 June to attend an incident on Salamander Place, Edinburgh. We dispatched one ambulance to the scene and transported one patient to Edinburgh Royal Infirmary.'

Emergency services included a trauma team, two ambulances and an air ambulance rushed to the scene on Firthview Terrace, Ardrossan at 9.32am this morning. ‌ The patient was flown to nearby Crosshouse Hospital in Kilmarnock. ‌ The air ambulance had to land near to Stanley Park Primary School just a short distance away from Firthview Terrace. Pictures from the scene show the chopper stationed on a patch of grass next to the school. A spokesperson for the Scottish Ambulance Service said: 'We received a call at 09:32 to attend an incident on Firthview Terrace, Ardrossan. "We dispatched two ambulances and an air ambulance with a trauma team to the scene. We transported one patient via air ambulance to Crosshouse Hospital, Kilmarnock.' The incident comes just hours after the tragic death of man on Saltcoats Beach, just a few miles along the road. He shared an image of the helicopter stationary at the beach's promenade A Police Scotland spokesperson said: "At 2.55 pm on Thursday, June 19, we received a report of a man taking unwell on the beach at Saltcoats, close to Montgomerie Crescent. "Emergency services attended and a 44-year-old man was pronounced dead at the scene. "His next of kin have been informed. The death is not being treated as suspicious and a report will be submitted to the Procurator Fiscal."
