Three MPs seek to join proceedings involving Anwar as observers

KUALA LUMPUR: Three members of parliament have applied to the High Court for permission to join proceedings involving Prime Minister Datuk Seri Anwar Ibrahim's bid to refer eight legal questions to the Federal Court.
The questions include whether Anwar has immunity from a civil suit filed against him four years ago by his former research assistant, Muhammed Yusoff Rawther.
Anwar, who is the Tambun member of Parliament, filed to have the questions referred to the Federal Court and to postpone the main trial until the apex court delivers a decision.
The High Court is scheduled to hear this application tomorrow before Judge Roz Mawar Rozain.
The three applicants, Datuk Seri Hamzah Zainudin (PN-Larut), Datuk Seri Dr Ahmad Samsuri Mokhtar (PN-Kemaman, and Datuk Seri Dr Ronald Kiandee (PN-Beluran), submitted their request via e-filing yesterday to be allowed to attend the hearing as observing counsel.
Their application, filed under Order 92(4) of the Rules of Court 2012, Article 128(2) of the Federal Constitution, and Section 84 of the Courts of Judicature Act 1964, argues that they have a vested interest in the matter as members of parliament.
According to legal firm Wan Jawahir & Takiyuddin, acting for the trio, the legal questions raised, particularly Articles 39, 40, 43, and 128(2) of the Federal Constitution, are of public importance and may influence parliamentary debates and public discourse.
"Given the significance of these constitutional matters, we believe these MPs deserve access to the proceedings in an official capacity as observers to better inform their roles and responsibilities in Parliament," the firm said in its application.
They also requested the court to allow Tan Sri Azhar Azizan Harun, Datuk Seri Takiyuddin Hassan, and Datuk Seri Zulkifli Noordin to attend as observing counsel representing the three parliamentarians throughout the proceedings.
Yusoff's lawyer, Muhammad Rafique Rashid Ali, confirmed receiving a copy of the application and said it may be presented to the court during tomorrow's session.

KUALA LUMPUR: The High Court here has granted a stay on an ex-parte forfeiture order obtained by the Malaysian Anti-Corruption Commission (MACC) earlier this month in its bid to freeze £132mil (RM758.2mil) worth of assets in London belonging to Toh Puan Na'imah Khalid and her family. Justice Azhar Abdul Hamid said the order was stayed pending an application by Na'imah, who is seeking to intervene in the MACC's notice of motion. At the same time, the order dated June 3 is stayed," Justice Azhar said on Monday (June 23). The court fixed July 9 to hear the application to intervene. On June 3, the same court had granted the MACC an order to freeze the assets in London belonging to Na'imah, who is the wife of the late former finance minister Tun Daim Zainuddin. The assets include two commercial buildings, five luxury residences and one bank account. ALSO READ: Dismissal of Na'imah's application a miscarriage of justice, court told According to the MACC, investigations indicated that the assets were linked to suspected offences under Section 4(1) of the Anti-Money Laundering, Anti-Terrorism Financing and Proceeds of Unlawful Activities Act (AMLATFPUAA) 2001. It said the freeze was part of ongoing efforts to trace and recover assets believed to be connected to unlawful activity. At a separate High Court, Justice K. Muniandy fixed Aug 1 to hear Na'imah's application to intervene in another ex-parte notice of motion filed by the MACC. The MACC had sought to obtain an ex-parte court order under Section 53 of the AMLATFPUAA to forfeit more than RM544mil in US dollars and pound sterling. "An investigation has been carried out by the Inland Revenue Board (LHDN). Based on preliminary investigation, we believe the assets owned by Na'imah and her associates had never been declared (to the LHDN). "We say that the assets must be frozen before (they are) disposed of," she said in her oral application. Meanwhile, Na'imah's lawyer Datuk Dr Gurdial Singh Nijar said he was "perplexed and disappointed" over the application as the MACC had never mention any respondent's name in its filing. "The order isn't just against the property but also against the person. This application cannot proceed as an ex parte. It has to proceed as an inter parte. I seek that this court make no order (on the freeze) until an inter parte application is heard," he said. Justice Muniandy then ruled that the application to intervene would be heard inter parte and fixed Aug 1 for hearing.

KOTA KINABALU: Another Sabah politician has been summoned by the Malaysian Anti-Corruption Commission (MACC) to give a statement at the Sabah Federal Government Administrative Complex on Monday (June 23) morning. It is learnt that the state assistant minister was called in as part of the ongoing investigation into a corruption case involving a mining prospecting scandal. A source said that the politician, who is a state assemblyman and also a Member of Parliament, arrived at the MACC office at about 9am, accompanied by two lawyers. Sabah MACC director Datuk S. Karunanithy declined to comment on the matter. A state-owned investment arm company chairman, who was questioned by Sabah MACC for nearly four hours on Wednesday (June 18), is expected to be charged on June 30. Also expected to be charged is a whistleblower known as "Albert", previously linked to the circulation of video clips related to the case. The alleged offences are believed to have occurred between 2023 and last year, involving the solicitation and receipt of bribes amounting to approximately RM200,000 in connection with the processing of mineral exploration licence applications. Both individuals have since been released on MACC bail and are expected to be charged at the end of the month.
