Appointment of IGP yet to be finalised

ISKANDAR PUTERI: Prime Minister Datuk Seri Anwar Ibrahim did not disclose if the name of the individual who will be appointed as the new Inspector-General of Police (IGP) to replace Tan Sri Razarudin Husain, whose contract is scheduled to end on June 22, has been finalised or not. He also declined to say whether a list had been submitted to the palace. 'But who told you? Is it true? I'll ask the King later,' he quipped when asked by reporters about the matter. Anwar's statement came after media reports claimed that a list of IGP candidates had been finalised by the government and submitted to the Yang di-Pertuan Agong. The appointment of the IGP is the prerogative of the Yang di-Pertuan Agong, based on the Prime Minister's advice, as stipulated under Article 140 of the Federal Constitution. Razarudin was appointed as the 14th Inspector-General of Police for a two-year contract after his retirement, effective June 23, 2023, succeeding Tan Sri Acryl Sani Abdullah Sani.

Court decision allowing appeal by SIS Forum will be examined to safeguard fatwa institution

KUALA LUMPUR: The Federal Court's decision to allow an appeal by women's rights group SIS Forum (Malaysia) against a fatwa issued by the Selangior Fatwa Committee, which had declared the organisation deviant from Islamic teachings, will be studied to ensure that the standing and authority of the fatwa institution remain safeguarded in the long term. Minister in the Prime Minister's Department (Religious Affairs) Datuk Dr Mohd Na'im Mokhtar said that fatwas continue to play an important role in guiding Muslims on current issues that require syariah guidance. 'As the Minister in the Prime Minister's Department in charge of Religious Affairs, I respect the principle of the rule of law and judicial decisions made by the Federal Court as the highest judicial institution in the country's legal system. 'Therefore, close cooperation between the judicial, legislative and religious authorities is very important so that the function and authority of the fatwa institution remains respected within the framework of our country's constitutional system,' he said in a statement today. The MADANI Government, he said, would ensure that the administration of Islamic affairs in Malaysia is carried out fairly and based on the principles of shura, knowledge and the country's laws. 'At the same time, the MADANI Government will continue to uphold and defend the position of Islamic religious institutions in line with Article 3 of the Federal Constitution, which provides that Islam is the religion of the Federation,' said Mohd Na'im. The Federal Court today allowed the appeal by SIS Forum Malaysia and its co-founder Zainah Mahfoozah Anwar, in their legal challenge against a fatwa issued in 2014 by the Selangor Fatwa Committee declaring the organisation to have deviated from Islamic teachings. A four-judge panel led by Chief Justice Tun Tengku Maimun Tuan Mat in a 3-1 majority decision set aside the fatwa, insofar as it applied to companies and institutions

Focus on developing Malaysia, not restricting freedom of speech

ARTICLE 10(1)(a) of the Federal Constitution guarantees every Malaysian citizen the right to freedom of speech and expression. This constitutional right ensures that all citizens have the freedom to voice their opinions and share their thoughts. However, this fundamental right seems to be under threat. Recently, several prominent figures and political analysts have faced pressure following their statements or content shared on social media, particularly when discussing issues related to government policies.

Govt to thoroughly review Federal Court decision on SIS fatwa

THE Federal Court's decision to rule that a Selangor fatwa declaring religious liberalism and pluralism as heretical cannot be applied to Sisters in Islam (SIS) will be thoroughly reviewed to ensure that the position and authority of the fatwa institution was not affected in the long term. Minister in the Prime Minister's Department (Religious Affairs), Datuk Dr. Mohd. Na'im Mokhtar (picture) stressed that fatwas still play an important role in guiding Muslims on current issues that require Shariah guidance. 'Therefore, close cooperation between the judiciary, legal and religious authorities is very important so that the function and authority of the fatwa institution remains respected within the framework of our country's constitutional system. 'The government will ensure that the administration of Islamic affairs in Malaysia is carried out fairly and based on the principles of shura, knowledge and based on the full implementation of the country's laws,' he said in a statement today. Mohd. Na'im said he took note of the decision made by the Federal Court in favour of the SIS in its challenge against the fatwa issued by the Selangor State Fatwa Committee on 17 July 2014. 'As the Minister of Religious Affairs, I respect the principle of the rule of law and judicial decisions made by the Federal Court as the highest judicial institution in the country's legal system. 'At the same time, the government will continue to defend the position of Islamic religious institutions in line with Article 3 of the Federal Constitution which provides that Islam is the religion of the Federation,' he added. Today, the Federal Court allowed the appeal filed by SIS Forum and its founder, Datin Paduka Zainah Mahfoozah Anwar, regarding the dispute over the decision of the Selangor Fatwa Committee, Selangor Islamic Religious Council. The decision previously declared the organisation as deviant and perverting the true teachings of Islam which were issued and gazetted 11 years ago, thus setting aside the previous decisions of the High Court and Court of Appeal. The Federal Court ruled that the words 'persons who profess the religion of Islam' used in the fatwa can only refer to real people and not artificial persons such as companies or organisations. The Court also added that they, however do not scrutinised the content of the fatwa as it is the purview of the Fatwa Committee — TMR
