Durban businessman not backing down until City pays nearly half-a-billion owed to him

DURBAN businessman and legal advocate Siyabonga Xulu is taking a hardline stance against the eThekwini Municipality, demanding payment of over R413 million due to his company, Solbeth Security and Risk Management Services.
Xulu, the owner of the Makhathini Group, which oversees 21 companies, told the Daily News, he will not relent until the city settles what's due to him, which includes over R62 million in interest.
Xulu alleged that the municipality refused to pay for the critical security services his company provided to senior officials, including former city manager Sipho Nzuza, dating back to 2019. Now, he is calling on members of the city's Executive Committee (Exco) to intervene and force the city's ANC-IFP-EFF coalition government to act.
'I just want this matter to end now. I want us to find an amicable solution. I'm demanding what is rightfully mine,' said Xulu.
'The city must pay what it owes me. This is a legitimate claim backed by years of services rendered under the city's own instruction. My appeal to Exco is for the councillors to support me because I did the work and I must be paid for that,' he said.
On September 8, 2024, Solbeth sent an official demand to Exco requesting the urgent settlement of R413,161,463. It included unpaid invoices and accumulated interest. Xulu said the city ignored the letter, just one of many signs of what he calls 'intentional delay tactics.'
According to Xulu, his company was brought in during a period of heightened threats against municipal leadership. He alleged that the then city manager, Nzuza, personally appointed Solbeth to provide close protection and covert security operations for high-ranking officials. These services included sweeping and debugging of offices and homes, installing secret surveillance equipment, and monitoring movements of personnel through advanced systems.

The original agreement was for eight months, with an option for renewal. Xulu claimed that even after the contract lapsed, Nzuza instructed him to continue the work, which he did, for years, believing the city would honor its financial obligations.
'This wasn't casual work,' said Xulu. 'We deployed high-level resources, and expensive technology, and trained personnel to safeguard the lives of municipal leaders. The city knew exactly what we were doing and why. Their refusal to pay now is not only dishonest, it's criminal. That is why we took the matter to court, where the city is also using all the tricks available to delay the matter.'
Xulu said the fallout has been devastating for his business. His lawyer, Theyagaraj Chetty of Theyagaraj Chetty Attorneys, told the Daily News that the city is weaponising the legal system, dragging the matter through the courts while relying on public funds, leaving Xulu to cover all legal expenses himself.
'It's a disgrace. The city is using taxpayers' money to fight a man who protected their officials. Meanwhile, my client is left struggling to cover his business and personal expenses,' said Chetty. 'Solbeth is a major company, and what the city has done has had a knock-on effect on his business.'
Chetty also slammed the court delays, saying the city benefits from a legal system that cannot offer Xulu timely justice. 'You can't even get a court date soon. That delay plays directly into the city's hands while my client suffers.'
Municipal spokesperson Gugu Sisilana defended the city's actions, saying: 'The Municipality is entitled to legally defend itself against unclear claims in order to protect taxpayers' money. Any legal action taken is in the best interests of the public.'
But Xulu was unmoved. He insisted that his claim was not only clear, it's fully justified and backed by documentation.
'I have got all the documents to prove that I did work for the city and was authorised to do that. It is a shame because the city officials are benefitting from something they are not paying for. My equipment is there (city).'

'Of these, 56 were wanted individuals tracked down in various provinces,' she said. 'Police seized multiple electronic devices during their arrest. Next Stay Close ✕ In another recent case, Van Wyk said a 24-year-old suspect was arrested by the Family Violence, Child Protection and Sexual Offences (FCS) Unit in Tonga, Mpumalanga, on June 19, 2025, following the gang-rape of a 27-year-old woman earlier this week. Investigations into this incident are ongoing, she added. Van Wyk also listed notable convictions this past week, including the sentencing of a 33-year-old serial rapist on June 9, 2025, by the Polokwane High Court. Lesley Morwamashobe Mohlala was sentenced to 222 years' imprisonment. 'He was found guilty on multiple counts of rape and aggravated robbery.' In another case, Van Wyk said the East London High Court sentenced a 42-year-old accused to life imprisonment for the rape of a 13-year-old girl, who became pregnant as a result of the assault. On June 18, 2025, she said the Waterval Regional Court sentenced a 25-year-old man from Tshiozwi, Limpopo, to life imprisonment for raping his nine-year-old cousin in 2021. Van Wyk said the SAPS remains committed to ensuring justice prevails for victims by 'removing sexual predators from our communities'. As part of a broader initiative, Nomgqibelo Mdlalose, Movement Navigator for the End GBVF 100-Day Challenges, stated that many teams within the movement are working closely with young people to address GBVF at a grassroots level. With over 200 challenges planned for 2025, the End GBVF 100-Day Challenges are accelerating action against GBVF within courts, municipalities, and higher education. 'Youth engagement isn't about campaigns or one-day events - it's a commitment to show up and respond. What's been powerful to see through the 100-Day Challenge teams is how they're showing up consistently in the spaces where young people spend most of their time, such as preschools, classrooms, and college campuses,' said Mdlalose. In the Drakenstein Municipality in the Western Cape, an ambitious effort is under way to train 500 Early Childhood Development (ECD) teachers as GBVF first responders. The movement said on Thursday that over the next 100 days, 15 preschools will become part of a network of care where teachers are trained to identify early signs of abuse and respond in trauma-sensitive ways. The importance of this work lies in its timing, it said, stating that these are the years when children first learn what safety feels like, when trust is built or broken. And because many survivors never disclose what happened to them as children, interventions at this stage could be life-altering. 'GBVF prevention starts with the relationships and environments that shape how young people understand harm and support avenues,' added Mdlalose. According to the movement, Taletso TVET College in Mafikeng, in partnership with the National Prosecuting Authority, is fostering accountability and legal literacy through workshops on the Sexual Offences and Domestic Violence Acts. These sessions aim to empower students to report abuse and understand their rights, addressing the normalisation of harmful behaviour on campus and the hundreds of GBVF-related misconduct cases reported in higher education. Limpopo's 100-Day Challenge teams have held Moot Court sessions for high schoolers, demonstrating sexual offence trials and minimum sentences for rape. The movement said this teaches young people that violence is wrong and shows them how justice is served, making the law tangible and fairness achievable.

Image: File Accused killer, Bulelani Yosana's bail appeal again failed in the Western Cape High Court this week, where he argued that the State's case against him has considerably weakened after a Section 204 witness recanted on their statement. Yosana is currently awaiting trial alongside accused hitman James Easton for the contract murder of Bloekombos teacher and ANC activist Vuyo Dana. A trial date is yet to be set for the matter. After a previous unsuccessful attempt, Yosana, a former police officer and ANC branch secretary, filed a new bail bid appeal with the High Court, citing the recanted statement, that a trial date remains unset, and that his bank account is about to be closed for non-compliance with the Financial Intelligence Centre Act. Dana was shot and killed at his home in February 2022 while on his way to work at Bloekombos Senior Secondary School, in Kraaifontein, in what has been alleged to be a politically motivated killing. Next Stay Close ✕ Yosana brought the second bail application on the basis that new facts have arisen since the initial bail court (Regional Court) refused to admit him on bail, pending the finalisation of his trial. Yosana and Easton face a variety of offences arising out of the murder which occurred on February 22, 2022. The offences include a contravention of Section 18 of the Riotous Assemblies Act, conspiracy to murder, and murder. Through his attorney, Yosana submitted that following the bail application, hearing, and the appeal, they discovered a statement in which the Section 204 witness recanted what he stated in his Section 204 affidavit. According to Yosana's lawyer, there are no eyewitness accounts that place Yosana on the scene, and he claims that due to the recanting statement, there is insufficient evidence. 'According to Mr Booth (Yosana's attorney), this recanting statement was never discovered by the State, and as such, it alters the overall picture of the State's case. 'In this (newly) discovered statement, the Section 204 witness is recanting what he initially told the police about the involvement of the applicant (Yosana) in the commission of the offences the applicant is arraigned on. Booth advanced the argument that the State case is based primarily on the evidence of the Section 204 witness. 'Booth's argument postulates that if the Section 204 witness has recanted his original police affidavit, wherein he originally implicated the applicant in the crimes, the necessary corollary is that the State's case has since been considerably weakened. According to the applicant, this discovery presents an insurmountable hurdle for the State,' the court record read. The State did not dispute that the Section 204 witness has since recanted his first key pre-trial statement. 'According to the State's heads of argument, the Section 204 witness filed a recanting statement after the residence of the witness was visited by the applicant and after the applicant's arrest. To this end, the State specifical contends that the recanting statement is a product of interference with a State witness,' the judgment further read. High Court judge Constance Nziweni, said: 'There is no doubt that the existence of a recanting statement presents considerable odds in the prosecution's case. Undoubtedly, the strength of the State's case is now called into question. It is appropriate at this stage to say something about the presumption of innocence. 'It should be observed that, according to the Constitution's principles, the bail court is deeply concerned with the right of a person who is presumed to be innocent, whose right to liberty is at stake. However, despite the right to be presumed innocent, there are instances where an accused person has to be detained pending the trial.' Judge Nziweni said that Yosana did not satisfy the court with reasons to be released on bail. 'In view of the foregoing, this court is of the firm opinion that in this matter, it cannot be said that there is no longer a 'just cause' behind the accused's detention. Though the prolonged detention of the applicant is regrettable, it cannot be said that the delay is unreasonable, as such, it amounts to a new fact that warrants his release,' said Judge Nziweni.

Police shoot five armed suspects in Inanda during violent crime crackdown
Five armed suspects were shot dead during separate operations in Inanda, north of Durban, KwaZulu-Natal. Image: File KwaZulu-Natal police have killed five suspects in two separate incidents in the Inanda township north of Durban on Friday. Provincial police spokesperson Colonel Robert Netshiunda stated that in both incidents, police responded to shots fired at them by the armed suspects. Netshiunda said in the first incident, police operationalised intelligence about the whereabouts of a wanted suspect in the area. They then managed to corner the suspect along the Etafuleni main road. 'The suspect opened fire at police officers, and a shootout ensued. During the shootout, the suspect, who was wanted for murder, three counts of attempted murder, and for business robbery, was shot and fatally wounded,' said Netshiunda. Next Stay Close ✕ Detailing the events that unfolded in the second incident, Netshiunda said police followed up on intelligence about suspects who were wanted for murder, attempted murder, and house robberies in and around Inanda. He said the police then pounced on the suspects at the cottages on Dr Langalibalele Road in Inanda. According to Netshiunda, when the suspects saw the police, they started shooting at them, and the officers retaliated. 'After the shootout, four suspects were found to have sustained fatal gunshot wounds,' he said. Three firearms, whose serial numbers had been filed off, were found in the possession of the suspects, he added. No police officer was injured during either of the shootout incidents.
