BMC pulls up hotel next to razed Jain temple for illegal construction

Mumbai: Barely a week after the Brihanmumbai Municipal Corporation (BMC) razed a Jain temple in the Neminath Co-operative Housing Society premises in Vile Parle East, the civic body on Wednesday issued a notice for unauthorised construction to Ramkrishna hotel, which owns a majority of the flats in the building.
The notice was issued under section 53(1) of the Maharashtra Regional and Town Planning (MRTP) Act, 1996 after civic officials compared the original building plan with the existing structure to ascertain alterations, sources in the civic body told Hindustan Times.
'We compared the changes with the approved plan of the building, which is with the BMC's development plan (DP) department, and issued the notice accordingly,' a BMC official told Hindustan Times on condition of anonymity.
The hotel owners have been asked to respond to the notice within 30 days, with documents showing the alterations are legal, failing which they will have to be demolished, he official mentioned.
Trustees of the now demolished Jain temple welcomed the move, saying they had been complaining about the hotel's unauthorised expansion for many years. The hotel owns several apartments in Neminath co-operative housing society which have been converted into guest rooms that are rented out commercially, they alleged.
'Besides, the hotel owners have constructed a makeshift brick and mortar structure right next the temple where its staff is housed,' said Anil Shah, a member of the Shree 1008 Digambar Jain Mandir Trust which managed the demolished temple. 'We have been complaining against the illegal constructions since 2006 but no action had been taken till now,' said Shah.
Similar notices for unauthorised construction had been issued earlier to the Jain temple, said trustees. On April 7, the city civil court had rejected the temple trust's plea against demolition but granted interim protection for seven days to allow the trust to appeal against the decision. While the interim protection expired on April 15, the temple was demolished the next day before the trustees got a stay order on the demolition from the Bombay high court.
The BMC's punitive action prompted thousands of Jains to hit the streets on April 19 for a massive silent rally. Protestors including trustees of the temple claimed that it was razed at the behest of the owners of Ramkrishna hotel, which wanted to expand its business to other parts of the housing society.
Three days later, on April 22, the state minority commission took cognisance of the matter and conducted a survey of the site. The commission rapped the BMC for acting in haste and using excessive force to raze the temple. It also directed the civic body to initiate action against all unauthorised structures in the premises.
'We conducted a survey of the premises following the commission's order to identify all the unauthorised structures,' said an official. 'We have issued a notice to the owners of Ramkrishna hotel based on the findings and more such notices will be issued as and when discrepancies are highlighted during inspection.'

Mumbai: Aspirants seeking admission in the institutional round for engineering, management and pharmacy courses can now apply centrally through the state's CET cell too. Previously, candidates only had the option of approaching individual colleges directly and often faced the risk of being turned away on various pretexts. To bring in more transparency in admissions to institutional quota seats across technical courses, including diploma, undergraduate and postgraduate, the state govt has decided to step up precautionary measures. For instance, the govt has now removed the ambiguity in the definition of 'NRI', paving the way for only genuine candidates to secure seats under the quota. Additionally, the state's Fees Regulatory Authority (FRA) also fixed fees for institutional quota seats for the first time in technical colleges—private, unaided colleges can now charge up to five times the fees for merit seats from NRI students and three times from students taking admission in management seats. The govt issued a notification bringing in amendments in the Maharashtra Unaided Private Professional Educational Institutions (Regulation of Admissions and Fees) Act, 2015 on Friday. One of the provisions in the notification stated, "In case a candidate is unable to submit the application directly to the concerned institute for any reason, the candidate shall have the opportunity to apply through the website of the CET cell till the date of allotment of final admission round. " These applications will be forwarded to the respective institutions after the allotment process of round four and will be considered for merit, it mentioned. Vinod Mohitkar, director, directorate of technical education, said the govt is not overstepping on the rights of management to conduct the institutional round. "We receive some complaints from students about certain institutions refusing applications for the institutional round. We are, therefore, only offering students an additional platform to apply. These applications will be compiled and sent to respective institutions and they will include these names, while preparing their merit list," said the director. Some of the admission rules were also modified in the notification, but were announced before. The state's cabinet, in a meeting this week, also announced aspirants seeking admission under the NRI quota for any courses will have to submit a certificate from respective consulate offices or documents mentioned in Guardians and Wards Act, 1890. A department official said even local students claimed admissions under NRI quota by submitting affidavits. Higher and technical education minister Chandrakant Patil had announced revision in admission process for more transparency.

Bengaluru: The high court has stayed BBMP's new tender notification for solid waste management issued on May 28, while directing the state govt to submit an affidavit explaining its actions. Justice M Nagaprasanna said the move appeared to be prima facie contempt of court. The order came while hearing a review petition filed by the Bengaluru Mahanagara Swachate Mattu Lorry Malikara Hagoo Gutthigedarara Sangha. The petitioner challenged the fresh tender notification and sought a review of the court's earlier judgment dated April 22, which had upheld a previous BBMP tender issued on Nov 7, 2024. In the earlier order, the judge had allowed the petitioners to participate in the new tender process and directed the state to submit an affidavit outlining a revised timeline for completing it. "The state shall redraw the timeline for the completion of the process of tender at an outer limit of four months, if not earlier. The timeline shall be filed before this court, by way of an affidavit, for its strict adherence," Justice Nagaprasanna had said in the April 22 order. He had added that if the timeline was violated, the petitioners had the liberty to return to the court. In contrast, the advocate general submitted that there was no breach of undertaking as the May 28 tender was distinct from the earlier one. He said an affidavit would be filed to clarify the sequence of events. The Sangha has also raised objections to a govt order dated May 26, which it claims includes clauses that require ministerial approval — allegedly in violation of the Karnataka Transparency in Public Procurements (KTPP) Act. According to the petitioners, the issuance of the new request for proposal (RFP) two days later further undermined the court's April 22 judgment, where the state's undertaking was explicitly recorded. The court will continue hearing the matter after the affidavit is filed.

Bhopal: In a major crackdown on alleged benami transactions , the Benami Prohibition Unit of the Income Tax department has provisionally attached 170 acres of land in Rewa district, Madhya Pradesh, under Section 24(3) of the Prohibition of Benami Property Transactions (PBPT) Act, 1988. The attached land is part of a larger block of approximately 700 acres across 112 khasras, originally purchased in 2011 for Rs 10.35 crore. The transactions were made in the names of Kardam Mishra and Ajay Kumar — both salaried employees of a wholly-owned subsidiary firm of a major private company. According to the department's findings, Mishra and Kumar were employees with nominal salaries, and their financial profiles did not support such a substantial investment in immovable property. During investigation, Mishra admitted under oath that the properties were purchased by senior officials of the private company in their names. A forensic financial analysis revealed that payments to the original landowners were made directly from the company's bank accounts. Subsequently, these properties were registered in the name of Prosperous Energy Pvt. Ltd. Meanwhile, the "consideration amount" was shown as routed through the bank accounts of Mishra and Kumar, only to be transferred back to the company in multiple tranches, indicating a classic case of layered benami transactions. The Income Tax department has determined that the real ownership and beneficial use of these properties rested with the private company and its subsidiary. This arrangement falls squarely under the definition of a "benami transaction" as per Section 2(9)(A) of the PBPT Act. A show-cause notice under Section 24(1) has been served to both the benamidars and the beneficial owners. Adding another layer to the case, it was discovered that the company had secured a short-term loan of Rs 925 crore from IDBI Bank by mortgaging these properties, along with others belonging to private firm. Due to default in repayment, IDBI Bank auctioned several of these properties. However, 46 khasras, covering approximately 170 acres, remained unsold and have now been provisionally attached to prevent any further alienation. Further proceedings under the PBPT Act are underway.
