Community-targeted killings need to be probed by NIA, says forum

Mangaluru: All India Practising Lawyers Council president and high court advocate S Balan demanded that the murders of Ashraf and Abdul Rahiman be handed over to the
National Investigation Agency
(NIA).
Balan told reporters here on Saturday that the murders of Ashraf and Abdul Rahiman are 'community-targeted killings', which is a scheduled crime.
He demanded an NIA probe into it, besides invoking the Unlawful Activities (Prevention) Act (UAPA) against the accused in both cases.
Balan, who led a fact-finding delegation of the council, said that Rahiman of Kolthamajalu was a victim of community-targeted murder. "The accused in the Rahiman murder case were very close to the family of the deceased. We visited Rahiman's house and interacted with the family and relatives.
Those accused participated in the protest meeting held in Bajpe, where leaders made provocative speeches. The police should not have allowed the VHP to hold a public rally in Bajpe after the murder of Suhas Shetty," he said.
Further, Balan said that Ashraf, who was mob lynched in Kudupu, did not have any connection to the communal crimes reported in the district. He said that Ashraf was killed only because of his religious identity.

He accused the central govt of demonstrating a discriminatory attitude towards Muslims by not referring the two murder cases to the NIA, despite their qualification for the same. He said that the murder case of rowdy-sheeter and Hindutva activist Suhas Shetty was referred to the NIA, even though it was an 'individual targeted revenge killing', a non-scheduled crime. "Handing over Shetty's murder to the NIA is a misuse of constitutional provisions and political power," he said.
On the involvement of PFI members in the murder of Shetty, which was considered a ground for an NIA probe, Balan said PFI is not a declared terrorist organisation, but only an unlawful association.
Balan stressed the need for the state govt to amend the Karnataka Control of Organised Crimes Act, stating that existing laws cannot curb hate speech.

Dehradun: Uttarakhand high court on Monday declined to grant immediate relief to Dehradun-based builder and industrialist Sudhir Kumar Windlass and his three associates, who are facing fraud charges. A single bench of Justice Pankaj Purohit scheduled the next hearing on Windlass's third bail application for the first week of July. Windlass's counsel said the 72-year-old was undergoing treatment for health complications at Himalayan Hospital in Dehradun, as per court directions. "We told the court that the chargesheet is under cloud before the Supreme Court, and since the trial is unlikely to conclude soon, he cannot be incarcerated indefinitely. There is no justification for keeping him in judicial custody without a conviction," said Sanjeev Agarwal, Windlass's lawyer. He was arrested by the Central Bureau of Investigation (CBI) in Dec 2023. Windlass is accused of defrauding individuals by persuading them to sell land, which he then allegedly transferred to another businessman. Dehradun: Thirty-two Nepali nationals, including three minors, were rescued on Thursday from a house in Uttarakhand's Udham Singh Nagar (US Nagar) district, where they were allegedly held captive for around four months after being lured to India with promises of lucrative jobs. The joint operation was conducted by the Nepal embassy, Uttarakhand Police, and NGO, KIN India. Three men, including a Nepali citizen, Birendra Shahi, 21, have been arrested. In a post on X, the Nepal embassy in India on Saturday said the rescued individuals will be repatriated after the legal process is completed. US Nagar SSP Manikant Mishra told TOI on Sunday that police were alerted by an embassy official on Thursday. "Acting on the input, police along with the NGO representatives raided the house of Maharaj Singh in Kashipur, where 32 people, including three boys aged around 14–15, were found," Mishra said. He said the victims were from poor families in Nepal and had been brought to India by Shahi on the promise of jobs. "He had taken Rs 10,000 to 30,000 from each of them.
