Supreme Court warns governments against invoking stringent laws as tool of harassment

NEW DELHI: Cautioning govts not to invoke stringent laws like UP Gangsters Act "as an instrument of harassment or intimidation, particularly where political motivations may be at play", Supreme Court has quashed an FIR lodged under the Act against people taking part in a demonstration after a communal flare-up arising out of a controversial social media post targeting a religious group, reports Amit Anand Choudhary.
It said the accused were arrested and booked under various provisions of IPC for vandalising a shop owned by a person who had put an "incendiary" social media post.

Noting the stringent law was invoked 13 days after an accused's daughter-in- law filed nomination for chairmanship of Nagar Panchayat Khargupur (UP), a bench of Justices Vikram Nath and Sandeep Mehta said, "This timing lends credence to their contention the Act may have been weaponised for extraneous considerations.

Allowing the plea of Lal Mohammad and other accused, the bench said the Act was enacted to combat organised gang-based crime and dismantle criminal syndicates, and invoking the law "based on a single incident of communal violence... is a significant departure from its legislative purpose". It said mere involvement of the accused in a demonstration after the communal flare-up, however serious, did not transform the participants into a 'gang' without evidence of organised and continuous criminal activity.

"The constitutional guarantee of personal liberty acquires even greater significance when extraordinary legislation with stringent provisions, such as UP Gangsters Act, is invoked. While the state has broad discretion in criminal prosecution, this discretion must be exercised judiciously, based on relevant considerations, and in conformity with the statutory purpose. The power conferred upon the state cannot be wielded as an instrument of harassment or intimidation, particularly where political motivations may be at play," said Justice Mehta, who penned the judgment.
"It is a cardinal principle of criminal jurisprudence that extraordinary penal provisions, particularly those that substantially abridge regular procedural safeguards, must be invoked based on evidence that meets a threshold of credibility and substantiality. The materials relied upon must establish a reasonable nexus between the accused and the alleged criminal activity, demonstrating actual probability of involvement rather than mere theoretical possibility. When a statute creates serious fetters on personal liberty, the evidentiary foundation for its invocation must be commensurately strong, supported by concrete, verifiable facts rather than vague assertions."

Malik's representative said on Friday that the former governor is undergoing treatment for a serious medical condition and that there would be no comment apart from whatever Malik has already said on X . On June 7, in a post on X , Malik said: 'The tender they want to implicate me in was one I personally cancelled. I had informed the Prime Minister about the corruption in that matter, and after informing him, I cancelled that tender myself. After my transfer, that tender was approved with someone else's signature.' The former governor said at the time that he was in the Intensive Unit Care (ICU) of a hospital for a kidney-related ailment. In its first information report (FIR), CBI said: 'Though a decision was taken in the 47th board meeting of CVPPPL (Chenab Valley Power Projects (P) Ltd) for re-tender through e-tendering with a reverse auction after the cancellation of the ongoing tendering process, the same was not implemented (according to the decision taken in the 48th board meeting) and the tender was finally awarded to Patel Engineering Limited'. High Court notice to Goa govt over fees waved for land zone corrections
The High Court of Bombay at Goa Thursday issued notice to the state government, Secretary Town and Country Planning department, Town and Country Planning Department, Directorate of Vigilance and former chief town planner in a petition seeking directions to the authorities to recover the fees allegedly 'illegally waived' under a contentious provision of the Goa Town and Country Planning (TCP) Act. According to the petitioner, activist Swapnesh Sherlekar, the fees for correction of certain land zones was illegally waived under section 17 (2) of the Goa Town and Country Planning (TCP) Act on the 'specious' ground that 'deletion of proposed road fee is not applicable'. The section 17(2), which was introduced through an amendment to the TCP Act and notified in 2023, allows the conversion of privately owned plots in Goa's Regional Plan 2021, based on individual applications from such parties to 'correct inadvertent errors' and 'rectify inconsistent or incoherent zoning'. The government notified the fees for correction of zones under section 17 (2) of the Act on March 16, 2023. Subsequently, the revised fee for zone changes was notified through the supplement official gazette on March 28 last year. The HC read down the section in March this year. The petition states in the list of cases considered for correction of zone under section 17 (2) of the Act, several entries contained a notation 'deletion of proposed road fee not applicable' without any statutory basis for such exemption. The petition stated that among such cases were properties belonging to TCP Minister Vishwajit Rane, who is also a respondent in the petition, alleging that he 'benefited from an unauthorized exemption of fees'. The petition said there are 'numerous' cases of deletion of proposed roads since the Act was notified, which require scrutiny for similar unauthorised exemptions. It further said that there is no provision in the TCP Act or any rules, regulations or notifications thereunder that provide exemption of fees for deletion of proposed roads under section 17 (2) of the Act. The petition said the respondent authorities have acted with 'manifest arbitrariness, mala fide and abuse of power in exempting certain applications from payment of statutory fees without any legal basis or justification.' The petition further claimed that the respondent authorities have failed to discharge their duties in accordance with law and have instead acted in a manner that suggests collusion to confer undue benefit on certain individuals at the expense of the public exchequer. On Thursday, the High Court heard the submissions of the petitioners. In the order, the court said: 'At this stage, we deem it appropriate to issue notice to respondent 1 to 4 as well as respondent 6 in the capacity of chief town planner (planning)…' The Court also directed the respondents to file an affidavit in response within three weeks. The court said it has 'noted the specific pleadings in the petition, which revolve around the properties' belonging to Rane, but did not issue a notice to him.
