Employee doesn't have right to promotion but consideration if not disqualified: SC

Time of India02-05-2025

The
Supreme Court
on Friday said while an employee did not possess a right to promotion, they had the right to be considered for promotion unless disqualified. A bench of
Justices Sudhanshu Dhulia and K Vinod Chandran
was dealing with an appeal filed by a police constable in Tamil Nadu who was aggrieved by the denial of consideration of promotion for the sub-inspector's post.

"It is trite that the employee has no right to be promoted but has a right to be considered, when selections for promotions are carried out, unless disqualified; which right has been impinged, unjustly, in the above case," it said.
The apex court observed he had faced both departmental and criminal action for allegedly thrashing a colleague during their posting at a check post.

While in the criminal case, the appellant was arrested but acquitted later, the government set aside the punishment stemming from the departmental proceedings in 2009, it noted.
However, the superintended of police said the appellant was not considered for promotion since he was disentitled in line with the rules for reason of a punishment of postponement of next increment for one year without cumulative effect, imposed in May 2005.
Live Events
The appellant's punishment, the bench said, was interfered with and was set aside in November 2009.
"In such circumstances, the appellant could not have been disentitled from a consideration in the year 2019," the bench's verdict said.
It added, "In the above circumstances we are of the opinion that the appellant must be considered for promotion, dehors any disentitlement due to his having become overaged."
The consideration will be made and if found eligible, he shall be promoted from 2019 and consequential benefits shall also be paid to him, since it was not his fault that the authority denied his
consideration for promotion
based on a punishment which was already set aside, the bench said.
The bench allowed the man's appeal challenging an order of the Madras High Court passed on October, 2023, dismissing his plea to consider him for promotion as an in-service candidate.
The apex court said he was initially appointed in March 2002 and was eligible for consideration in 2019 when a notification was issued for considering eligible constables for in-service promotion in 20 percent departmental quota.

INS Tamal, last Indian warship built abroad, to be commissioned in Russia on July 1

NEW DELHI: The last Indian warship to be built abroad, a 3,900 tonne multi-role stealth frigate packed with sensors and weapons like BrahMos supersonic cruise missiles, will be commissioned as INS Tamal in Russia on July 1. The Navy currently has 59 warships and vessels under construction in Indian shipyards at an overall cost of around Rs 1.2 lakh crore to add to its expanding blue-water combat capabilities. It also has the initial approval or 'acceptance of necessity (AoN)' for indigenous construction of another 31 warships, including big projects for nine diesel-electric submarines, seven new-generation frigates and eight anti-submarine warfare corvettes. "The force has fully transformed from a 'Buyer's Navy' to a 'Builder's Navy' over the years. There is no plan for an Indian warship to be constructed abroad in future," a officer told TOI. The Navy, which currently has 140 warships and submarines along with over 250 aircraft and helicopters, plans to expand to around 180 warships and 350 aircraft and helicopters by 2030. This is crucial for tackling the rapidly-growing maritime collusiveness between Pakistan and China, which has the world's largest Navy with 370 warships but is currently constrained by the 'tyranny of logistics' in the Indian Ocean Region. by Taboola by Taboola Sponsored Links Sponsored Links Promoted Links Promoted Links You May Like Memperdagangkan CFD Emas dengan salah satu spread terendah? India in Oct 2018 had inked an umbrella agreement with Russia for four upgraded Krivak-III class frigates, with the first two to be imported for around Rs 8,000 crore. The other two, Triput and Tavasya, in turn, are being built at the Goa shipyard with transfer of technology at an overall cost of around Rs 13,000 crore. The first frigate, INS Tushil, reached her home port of Karwar from Russia in Feb. These four new warships will add to the six such Russian frigates, 3 Talwar-class and 3 Teg-class warships, already inducted from 2003-2004 onwards. Designed for blue-water operations across the spectrum of naval warfare in four dimensions of air, surface, underwater and electromagnetic, these frigates are armed with a wide array of advanced weapon systems. "INS Tamal has significant upgrades over her predecessors, punching well above her weight," an officer said. Besides BrahMos missiles, the frigate has Shtil vertical launched surface-to-air missiles, an improved A190-01 100mm gun and a new age electro-optical/infrared Sandal V system. She is also equipped with a 30mm close-in weapon system, heavyweight torpedoes, urgent attack anti-submarine rockets, apart from various surveillance and fire control radars and systems.

International Olympic Day: Juan Antonio Samaranch Senior - The controversial figure who saved the Olympics

Juan Antonio Samaranch Sr. helmed the IOC for 21 years (1980 until 2001) and saved it from financial ruin. (Image: X/IOCMedia) International Olympic Committee's (IOC) incoming president Kirsty Coventry and outgoing president Thomas Bach will honour each other at Monday's handover ceremony in Paris, with both acknowledging Juan Antonio Samaranch Senior's crucial role in saving the Olympic movement from potential extinction, transforming it into a financially robust organisation during his presidency from 1980 to 2001. Coventry and Samaranch Senior share a background of serving in controversial regimes before their IOC roles. Coventry served as sports and arts minister in Zimbabwe's government, whose 2023 election was deemed unfair by international observers, while Samaranch held a high position in General Francisco Franco's fascist Spanish regime. Samaranch Senior's presidency faced scrutiny during the 2002 Salt Lake City Winter Olympics votes-for-favours scandal, yet his contributions to the Olympic movement remain significant. "His legacy is that we have an Olympic Games to talk about," former IOC marketing executive Terrence Burns told AFP. "He saved it from financial and political ruin." After Franco's death and Spain's return to monarchy, Samaranch Senior became ambassador to the Soviet Union, acknowledging his political career in Spain had ended. He consistently maintained he was not a fascist. His election as IOC president occurred during the 1980 Moscow Games, which were affected by boycotts following the Soviet invasion of Afghanistan. by Taboola by Taboola Sponsored Links Sponsored Links Promoted Links Promoted Links You May Like Perdagangkan CFD Emas dengan Broker Tepercaya IC Markets Mendaftar Undo Former IOC marketing chief Michael Payne emphasised Samaranch's impact: "Within the IOC I think the Samaranch legacy is fully understood: that he saved the Olympic Movement." Payne highlighted Samaranch's success in developing the business model, including television strategy and the TOP programme, which became the most successful sports marketing program ever. According to Payne, Samaranch Senior was more introverted than his son, who recently finished second to Coventry in the IOC presidential election. "He was very introverted, a great listener, didn't do a lot of talking, and a great strategic thinker," said Payne. "But because he wasn't at the forefront, communicating and explaining, he was often misunderstood. He only learned English as his third or fourth language when he was 60." Samaranch's leadership during the Salt Lake City scandal demonstrated his resilience, resulting in six members' expulsion and implementation of reform measures. "He was calm under unbelievable pressure and stress," Payne recalled. "Honestly, you went to the office every day and you didn't know if the organisation would survive... And that was for three months. It was brutal. And yet, Samaranch Senior displayed absolute calm, focus." In a rare moment of vulnerability, Samaranch told the Los Angeles Times in 2000: "Retiring myself after the Barcelona Games (in 1992), I could have been a hero, no? I cannot regret. I have to write my history again." Samaranch demonstrated his tough negotiating skills when Greece opposed the Olympic torch lighting for the 1984 Los Angeles Games due to commercialisation concerns. "Samaranch sent one of his relatives to Olympia to privately film the lighting of the flame, put it in a miner's lamp, and brought it back to Lausanne," Payne revealed. "Then Samaranch called the Greeks and said, 'just for you to understand, I now have the Olympic flame on my desk. Either you will agree to let the Americans come and properly light it or there will never be another torch lighting in Olympia. Because it will be lit at the Olympic Museum in Lausanne. ' So he wasn't shy of being very tough." Follow all the live updates, scores, and highlights from the India vs England Test match here . 'Big mistake': Khamenei again warns Israel of 'punishment'; no mention of US strike on Iran

Iran's Supreme Leader Ayatollah Khamenei has once again issued a warning to Israel, saying that the "Zionist enemy" has made a grave mistake and is being "punished right now." His comments were posted just one day after the United States launched strikes on Iran's nuclear facilities. However, notably, Khamenei made no reference to the US attacks in his statement. Iran 'CHOKES' Hormuz Strait In Retaliation To Trump's Attack On Nuke Sites, Parl Approves Blockade "The punishment continues. The Zionist enemy has made a big mistake, committed a big crime; it must be punished and it is being punished; it is being punished right now," the post read. The strikes, which hit Iran's nuclear sites at Fordo, Isfahan and Natanz, were carried out by American B-2 stealth bombers using 30,000-pound bunker buster bombs. Satellite imagery analysed after the attack revealed a crater above Natanz's underground enrichment site, suggesting that the damage reached below hardened concrete defences. The US operation, officials said, was designed to take advantage of unique American capabilities to penetrate Iran's deeply buried facilities. 'Iran will decide timing, nature and scale of response' However, since the strikes the rhetoric from Iran has been of 'propotionate' response to the US attack. by Taboola by Taboola Sponsored Links Sponsored Links Promoted Links Promoted Links You May Like Giao dịch CFD với công nghệ và tốc độ tốt hơn IC Markets Đăng ký Undo Iranian officials have vowed to retaliate and warned that US bases in the region could become legitimate targets. Iran has accused the United States of destroying diplomacy with its strikes saying that the Iranian military will determine the 'timing, nature and scale of Iran's proportionate response'. Speaking at an emergency UN Security Council meeting on Sunday, Iran's UN Ambassador, Amir Saeid Iravani, said: 'Iran had repeatedly warned the warmongering US regime to refrain from stumbling into this quagmire.' He added, 'We will take all measures necessary,' and labelled the strikes a 'clear and flagrant breach of international law'. Iravani also blamed Israeli Prime Minister Benjamin Netanyahu for influencing US President Donald Trump into 'dragging the United States into yet another costly and baseless war' and doing the West's 'dirty work'. The envoy said that even as Iran's foreign minister engaged with European officials, 'the United States decided to destroy that diplomacy.' He asked, 'What conclusion can be drawn from this situation?' and echoed the foreign minister's remark: 'how can Iran return to something it never left -- let alone'. Trump further defended the operation against domestic criticism, responding to Representative Thomas Massie by saying, 'We had a spectacular military success yesterday, taking the 'bomb' right out of their hands (and they would use it if they could!).'* He also said that Massie is 'not MAGA,' distancing himself from the Kentucky congressman's calls for Congressional authorisation. Trump also hinted at possible regime change, posting, 'If the current Iranian Regime is unable to MAKE IRAN GREAT AGAIN, why wouldn't there be a Regime change??? MIGA!!!' Meanwhile, Israel continues its offensive, saying its objectives, eliminating Iran's nuclear and missile capabilities, are nearly achieved.
