'A huge relief': Man who feared fine or jail time over insulation added to house receives planning permission

A MAN WHO was threatened with jail or a €5,000 fine for retrofitting his home has been granted retrospective planning permission.
Clive Ryan had put new insulation in the wall at the front of his home in Kilnamanagh in the Ballymount area of Dublin in 2018.
Earlier this year
, he received a letter from South Dublin County Council telling him that he had to 'cease and discontinue the use of the insulation' and to 'remove the insulation and, in so far as is practicable, reinstate the facade to its condition prior to the commencement of the development'.
Otherwise, under the terms of the Planning and Development Act 2000, he could face a fine which can reach up to €5,000, or even a jail term for up to six months.
He had received a grant worth more than €4,000 to help pay for the costs from the Sustainable Energy Authority of Ireland. The other €13,000 came from his own pocket.
'Huge relief'
With the help of councillors, Ryan applied for planning permission, which has since been granted. He said it's a 'huge relief'.
Ryan believes the publicity around his case, as well as the support of local representatives, ultimately helped him.
'We tried ourselves and I don't think we would've got any further with it … I was down an avenue I'd never been.'

Ryan says, despite the arduous process to get planning permission, he still recommends people retrofit their homes.
'I think it's brilliant,' he said. 'It brought down our bills significantly.'
When Ryan spoke to The Journal in March, he said he found the case 'baffling', explaining that while the insulation expanded the facade of the house, it is not visible when looking at the home.
'It probably moves the house forward a few inches – that's what the insulation does. But that's the only logical thing I can come up with.
'The rest of the house is done like every other house. The insulation is just around the window. It's not a new structure, we tried to finish it as neat and as clean as we could.'
While some forms of insulation and solar panels are exempt from planning permission, the situation with insulation for external walls is not so cut and dried.
The Green Party is calling on the government to introduce further planning exemptions.
'It's hard enough for people to take time out of their busy lives to begin the process of a home retrofit. Government, including local councils, should be making it as easy as possible,' a spokesperson said.
As well as the planning exemption, Green Party want specific grants tailored for neighbours to retrofit together, to speed up retrofitting around the country and lower household energy bills.
Mark Lynch, a Green Party councillor for the Rathfarnham-Templeogue area said it needs to be made 'as easy as possible' for people to retrofit their homes.

Politicians condemn attack on Belfast Islamic Centre while people prayed

An attack on the Islamic Centre in Belfast while people were praying on Friday has been condemned by politicians. A local MLA said a device was thrown inside the building during evening prayer and forced it to be evacuated. Police said they attended a security alert on University Road in south Belfast on Friday night. A number of cordons were put in place and members of the public were asked to avoid the area. A 34-year-old man was arrested and was taken into police custody. 'I would like to express my solidarity with all those who were evacuated and my thanks to all those who worked to ensure their safety.' Sinn Féin MLA Deirdre Hargey said 'no-one should ever feel unsafe in their place of worship'. 'Acts like these, fuelled by hate, spread fear and division, and target people who have come to our communities to build a life and call this place home. 'It's vital that all political leaders speak out and stand united against this disgusting behaviour.' Green Party Councillor Aine Groogan condemned the attack as a 'cowardly and vicious act'. 'I am horrified to hear about the attack on the Islamic Centre during evening prayers,' she said. 'I want to pay tribute to the courageous passer-by who intervened and prevented what could have been a far more tragic outcome. 'It is terrifying to consider what might have happened and I sincerely hope that all those present are recovering from this traumatic ordeal.' She added: 'This attack is yet another reminder of the very real danger faced by our Islamic community. The recent rise in racist hate and violence on our streets is a shameful stain on our society. 'We must all take responsibility for actively challenging racism, misinformation and bigotry wherever it appears before someone is seriously hurt. 'I urge those politicians who continue to hide behind the notion of so-called 'legitimate concerns' around migration to reflect on the consequences of their words. 'Such narratives are as disingenuous as they are dangerous. They help foster a culture in which hate can thrive. Frankly, they should know better.'

Hotel manager ran red light and crashed into parked car after drinking bottle of wine

The court heard that a urine sample later returned a reading of 347 milligrams of alcohol per 100 millilitres of urine, well over the legal limit. The court heard that Ryan had no previous convictions. Her defence counsel, Lauren Flanagan BL, said that Ryan was 'desperately sorry' and had been under significant emotional strain at the time. She told the court that her client had consumed a full bottle of wine in one sitting and had since voluntarily given up driving, prompting Judge John O'Leary to ask: 'Would it not be easier for her to give up alcohol than driving?' Ms Flanagan said her client accepted she had an issue with alcohol and was actively engaging with support services. She said Ryan is currently receiving treatment through St John of God's addiction programme. Judge O'Leary convicted the defendant, imposed a €400 fine with six months to pay and disqualified her from driving for three years. He also ordered that she complete a restorative justice programme under the supervision of the Probation Service, and adjourned the case to September 5 next for a progress review. If the fine is paid and the restorative justice programme is completed, the court indicated no further penalty will be imposed. Funded by the Courts Reporting Scheme.

Olympic rider, 66, filmed striking horse '40 times' in ‘most awful video' banned a year on from Charlotte Dujardin shame
