Who's responsible for online harms? Responsibility for troubled file floats between ministers

OTTAWA — As ministers settle into their new roles, discussions are underway about who is best suited to steer the government's efforts to legislate against online harms, cabinet minister Steven Guilbeault said on Tuesday.
Questions have arisen about which minister and department would be best suited to handle the complicated issue after the Liberals' proposed Online Harms Act died in Parliament when Prime Minister Mark Carney triggered a federal election in March.
'It's a good question,' said Guilbeault, who oversees the Canadian Heritage department, told reporters on his way into the Liberals' weekly cabinet meeting.
'We're having conversations to see what would be the most appropriate department to bring this forward.'
Canadian Heritage had been the first department to develop and later introduce the Liberals' initial plan to combat the harms Canadian users experience online.
That proposal, which was released in 2021, was met with widespread backlash over concerns about the requirement for social media companies to remove content within 24 hours after receiving a complaint.
Experts had warned the provision was overly broad and risked infringing on free expression, given that companies could remove legal content.
The Liberals then struck an advisory group and got to work on figuring out a Plan B.
Responsibility for the bill also shifted from Canadian Heritage to the Justice Department.
In early 2024, former justice minister Arif Vriani introduced Bill C-63, which proposed to create a new digital safety regulator that would be tasked with ensuring social media giants took steps to reduce users' access to content, such as child sex abuse images and incite extremism and violence.
That bill was also met with backlash over its proposal to introduce stiffer sentences for hate-related offences and reintroduce a controversial section to the Canadian Human Rights Act to allow people to bring forward complaints of hate speech, which civil liberties advocates and Parliamentarians said risked violating free speech.
Virani spent months defending the need for the tougher Criminal Code measures to be included in the online safety bill, but last December announced the government was prepared to split the bill to help get it passed.
In January, former prime minister Justin Trudeau announced his resignation and that Parliament would be suspended until March.
Emily Laidlaw, a Canada Research Chair in cybersecurity law at the University of Calgary, who sat on the government's expert advisory group, said it was a mistake for the government to have combined different provisions into the same legislation and that by the time it announced the legislation would be split, 'it was too late.'
'What I'm hoping is, when they reintroduce it, they have very firmly the platform regulation law,' she says.
Should the Liberals want to propose changes to the Criminal Code or the Canadian Human Rights Act, that should be separate, she said.
Justice Minister Sean Fraser told reporters on Tuesday that the government was going to look at different measures when it comes to protecting children online, but would have more to say in the months ahead.
One new factor in how the Liberals may decide to proceed is the fact that Carney named to his cabinet the country's first minister responsible for artificial intelligence and digital innovation, a position currently held by former broadcaster Evan Solomon, who was elected in late April's general election.
The Liberals in their last bill listed AI-generated sexualized 'deepfakes' as one of the harms companies would have to take steps to tackle.
Asked whether online harms would fall under his mandate, Solomon told reporters on Tuesday that it was 'up for debate.'
'But probably yeah.'
Laidlaw said while she does not believe the government needs to start a new round of consultations, it ought to take a second look at the scope of harms it is seeking to tackle.
For example, she suggested there was room to include the issue of identity fraud.
'I actually think it should be broadened to include some of the ways that AI can be used to facilitate harm, so it might not just be the typical social media on Instagram.'

Justin Trudeau leaving the stage has eased the rage. And credit Donald Trump with giving Canadian politicians a bump. That's the suggestion from Pollara Strategic Insights' latest 'Rage Index' poll . Since the firm's last such survey in November , Canadians' anger toward the federal government has plunged 18 percentage points and there was a 10 percentage point drop in frustration with various provincial governments. 'One of the main theories on this is Trudeau himself was obviously a focal point of a lot of anger in Canada. We haven't done the poll since he left as prime minister,' said Dan Arnold, Pollara's chief strategy officer. Trudeau governed from 2015 until being succeeded in March by Prime Minister Mark Carney, who then kept the Liberals in power by securing a minority government in the April federal election. 'You don't see as many 'F—- Carney' flags as you did 'F—- Trudeau' flags,' said Arnold, referring to the profane banners that became commonplace around the time of the so-called ' Freedom Convoy ' protest in Ottawa three years ago. Overall, 37 per cent were angry with the federal government — down from 55 per cent in November — while 28 per cent were happy and 35 per cent were neutral. Similarly, 42 per cent were angry with their provincial government — compared with 52 per cent in the last poll — with 27 per cent happy and 31 per cent neutral. But 78 per cent of respondents were angry with the new U.S. president, who has launched a trade war against Canada, while eight per cent were happy and 14 per cent had no opinion. 'The other thing that's going on is that Donald Trump is a big source of anger. Trump has become a bit of a lightning rod of anger,' said Arnold. 'A lot of the frustrations that people would normally put on their Canadian political leaders have been redirected toward Trump,' he said. Using online panels, Pollara surveyed 3,400 people across the country May 16-20. While opt-in polls cannot be assigned a margin of error, for comparison purposes, a random sample of this size would have one of plus or minus 1.7 percentage points, 19 times out of 20. The firm found 49 per cent were unhappy with 'the types of changes happening in Canada,' an improvement on the 59 per cent finding last fall. Only 16 per cent were happy on that metric with 35 per cent neutral. But 40 per cent of respondents were happy with the results of the April 28 election while 34 per cent were unhappy and 26 per cent were neutral. About one-third — 32 per cent — were happy with Carney's new cabinet sworn in last month while 26 per cent were unhappy and 42 per cent had no opinion. However, 56 per cent are angry about the Canadian economy, a one percentage point uptick from November's poll, with only 14 per cent happy and 30 per cent were neutral. In that same vein, 38 per cent were unhappy with their own personal financial situation, up from 36 per cent in the last survey while 32 per cent were happy and 30 per cent were neutral. 'That's the one area where we don't see people feeling better,' noted Arnold. 'Actually, the anger level has gone up a little bit on things like the Canadian economy and personal finances — and that is absolutely because of the uncertainty that's going on right now,' the pollster said. 'We've seen unemployment figures starting to tick up and there's ... a lot of angst out there about what tariffs are going to mean and what this is going to have as an impact on Canada,' he said. 'So that is where we do see anger increasing. Trump himself is obviously catching a lot of the negative sentiment that otherwise would be going towards Canadian leaders. People are upset with the economy, but they're blaming it on Trump, instead of blaming it on Mark Carney or the provincial premiers right now.'

As it turns out, entertainment giant Paramount (PARA) was actually fairly close to a deal with President Trump over the 60 Minutes lawsuit. But, when the deal was fairly close, a 'roadblock' emerged and put a halt to the whole matter, at least for now. Investors reacted with surprising strength, and perhaps even more surprising positivity. Paramount shares gained nearly 2.5% in the closing minutes of Friday's trading. Confident Investing Starts Here: The settlement had reached $35 million, reports noted, when Paramount suddenly found itself paralyzed by indecision. That delay caused Trump lawyers to pivot and pull back to their original demand, calling for a $50 million settlement. The biggest problem seems to be that the Federal Communications Commission (FCC) is also involved in this, and needs to sign off on the merger with Skydance as well. Reports suggested that Paramount brass believes that the FCC's sign-off on the deal needs to be contingent on settling the case, but by like token, the idea that requiring FCC approval as part of the settlement looks a lot like a bribe. Trump's legal team, reports note, has already been clear that the Trump suit and the FCC case are two separate matters. But with outside organizations looking to launch their own lawsuits should the settlement go through, looks may count for more here than anyone expected. South Park Losses Mount Meanwhile, as Paramount faces the prospect of losing South Park exclusivity, it quietly pulled another old episode from the field. The pull this time showed up in the Canadian and Australian markets, reports noted, and this time, featured Butters' Very Own Episode pulled from Paramount+. Why, however, is a bit of a mystery. Several South Park episodes are apparently a bit too spicy for streaming, in retrospect, with around a dozen classic episodes set to be pulled from the catalog and relegated to a 'ban list', reports noted. The reports got stranger as an Australian viewer noted that the Paramount+ listing had been pulled, but the episode could still be watched by watching through Paramount+ on Amazon (AMZN) Prime Video. Is Paramount Stock a Good Buy Right Now? Turning to Wall Street, analysts have a Hold consensus rating on PARA stock based on two Buys, eight Holds and five Sells assigned in the past three months, as indicated by the graphic below. After a 18.62% rally in its share price over the past year, the average PARA price target of $12.08 per share implies 2.23% downside risk.
