Selection of judges for CB: Justice Mansoor urges JCP to develop formal criteria
ISLAMABAD: Justice Mansoor Ali Shah urged the Judicial Commission of Pakistan that formal criteria must be developed for selection of judges to the Constitutional Bench.
'The ad-hocism has already cast a long shadow on the legitimacy of the Constitutional Bench, and continued exclusion of senior judges without reason only worsens that perception,' said a letter written by Justice Mansoor to the Secretary JCP and sent its copy to all Commission's members.
In his June 16, 2025 letter, three days before the JCP meeting, the senior puisne judge expressed his inability to attend the meeting saying, 'I will not be available in Pakistan.' He expected that keeping with past practice, the meeting would be deferred due to non-availability of one of its members.
At the same time complained; 'It appears that the meeting in continuing as scheduled – perhaps due to the judiciary's minority position in the Commission.'
The JCP on June 19 extended the term of the Constitutional Benches of the Supreme Court till 30th November, and the Sindh High Court for six months w.e.f. 23rd July 2025. The JCP chairperson constituted a broad-based committee for the Judicial Performance Evaluation of Judges of all High Courts, comprising members from the Judiciary, Parliament, Executive, and the legal fraternity, to prepare draft rules for the Annual Judicial Performance Evaluation of High Court Judges.
The strength of the judiciary rests on its credibility, its internal coherence, and its fidelity to constitutional principle – not on expediency or executive preference.
Appointment of Justice Mansoor as CJP: No official notification issued: ministry
If the Commission is to retain its institutional legitimacy, it must lead with integrity, transparency, and collective wisdom.
It had asked the Commission that all the judges of the Supreme Court must be nominated to the constitutional bench in the interim.
Any selective inclusion without a transparent process or identifiable criteria is patently discriminatory and damaging to the institutional harmony.
Justice Mansoor December 6, 2024 had also written a letter to the Chief Justice of Pakistan Yahya Afridi, who is also the Chairman of the Commission, to postpone the JCP meeting until the fate of 26th Constitutional Amendment is decided by the Full Court of the Supreme Court.
In his latest letter, the senior puisne judge, reiterated the same stance that the JCP should wait on extending the term of judges on the constitutional bench till the constitutionality of the 26th Constitutional Amendment was decided by the SC.
'Proceeding with extensions or re-appointments to a constitutional bench whose very legal foundations is under serious constitutional challenge further deepens the institutional crisis and weakens the court's legitimacy,' he stated.
Justice Mansoor emphasised that the JCP must realise that continued delay in this matter was 'visibly eroding the credibility of the court and shaking public confidence in its neutrality'.

Ensure translation of evidence into Urdu simultaneously: LHC
LAHORE: The Lahore High Court (LHC) remarked that Urdu had been declared as the language of subordinate courts since 2015 but the same has not been implemented in Punjab till now. The court said the Supreme Court on September 8, 2015, had directed the government to implement Urdu as an official language but unfortunately no significant steps have been taken and up-till now evidence is being recorded in English in sessions courts. The court directed all the sessions' judges, additional sessions' judges, as well as, judges of special courts to ensure translation of the evidence of a witness recorded in English into Urdu simultaneously. The court passed this order in murder reference of Irfan alias Pomi after noting that the translation of the prosecution evidence and the statements of the accused have been made by the reader of the court after recording the whole evidence. The court said that law is very much clear on the point that the evidence should be taken down in the language of witnesses by the magistrate or judge himself or be recorded in his presence, hearing and superintendence. However, the translation of the evidence of a witness recorded in English should be translated into Urdu simultaneously at the same sitting, as well as, in the presence of witnesses, accused and the presiding officer, the court added. The court said this is necessary as if any ambiguity in the evidence recorded in English comes on the surface, the same can be removed in the light of translation of evidence in Urdu. The court said normally the witnesses during the trial depose in Urdu and the presiding officer, while transcribing the same in English, dictates to his stenographer and hence Urdu transcript of such deposition is not prepared. The court said this practice diminishes the very purpose of preparing and keeping Urdu translation of evidence recorded by the presiding officer in English. The court; therefore, directed the registrar to send copies of this judgment to all the sessions judges and judges of special courts, as well as, the secretary, ministry of law and justice Islamabad and the secretary ministry of law and parliamentary affairs Punjab for compliance. KSA envoy calls on CJP
ISLAMABAD: Ambassador of the Kingdom of Saudi Arabia Nawaf bin Saeed Ahmad Al-Malkiy on Friday called on the Chief Justice of Pakistan, Yahya Afridi, at the Supreme Court, Islamabad. The chief justice warmly welcomed the ambassador and expressed appreciation for the longstanding, historic, and fraternal ties between Pakistan and the Kingdom of Saudi Arabia, rooted in shared faith and mutual respect. During the meeting, both dignitaries discussed avenues for strengthening bilateral cooperation in the field of justice. Emphasis was laid on expanding judicial collaboration under the framework of Saudi Arabia's Vision 2030, which includes modernisation and reform of the Kingdom's judicial system. It was noted that Pakistan holds Saudi Arabia in high esteem and values the opportunity to learn from each other's judicial systems and experiences. Both sides agreed that meaningful collaboration through exchange programmes and partnerships between judicial academies can significantly enhance capacity building and promote shared learning. Joint training initiatives were also discussed to equip judicial officers and legal professionals with modern tools and comparative legal perspectives. The discussion further covered areas such as the modernisation of judicial processes, establishment of specialised commercial and labour courts, collaborative research in Islamic jurisprudence, and comparative legal studies focusing on interfaith dialogue. The possibility of jurisprudential dialogue on thematic legal areas, regional judicial engagement, and hosting a Regional Judicial Conference also featured prominently.
