
High court pulls up state for not producing sound pollution data

on Tuesday pulled up the state govt for not having complied with its earlier order of furnishing information with regards to steps taken to curb
sound pollution
in the state.
A division bench of Chief Justice M S Ramachandra Rao and Justice Rajesh Shankar were hearing a
public interest litigation
filed by Jharkhand Civil Society, a non-govt organisation, to check sound pollution in the capital and other districts of the state. The high court had also initiated a petition suo motu in the matter.
Earlier, the court had ordered the state govt to provide district wise data of steps taken to check sound pollution. The govt affidavit revealed about steps taken in the capital by the administration to curb sound pollution. However, affidavits of the other districts with information of steps taken to check sound pollution was absent.
The court granted a last opportunity to the govt to furnish the data of all districts with regards to steps taken to control sound pollution and file the affidavit on May 6. The court also observed that the govt failed to produce information with regards to measures taken to control sound pollution during festivals.
The PIL informed that sound pollution norms have been set for residential, commercial and industrial areas, respectively by the Prevention of Sound Pollution Act. However, there is no check on the fixed sound levels, the petitioner said. The case will again be heard on May 6.

JPSC to pay Rs 1L to candidate in recruitment case
Ranchi: Jharkhand high court on Friday imposed a cost of Rs 1 lakh on the Jharkhand Public Service Commission (JPSC), while dismissing an appeal filed by the latter against a candidate. The division bench headed by Chief Justice MS Ramachandra Rao while dismissing the appeal upheld the order of a single judge and imposed the cost of Rs 1 lakh on the Commission which is to be paid to the petitioner, Manoj Kumar Kachhap, in eight weeks. He appeared for the exams after scrutiny of his documents by the commission. But at the time of interview, he was told that the fees deposited for the exam was not credited in JPSC's account and therefore his candidature could not be considered. Kachhap told the court that he wasn't informed about it before the interview. In another matter, the high court imposed a cost of Rs 8,000 on former chief minister Madhu Koda for seeking adjournment in a case for the fourth time. Jharkhand HC imposes Rs one lakh fine on JPSC for denying job to competent ST candidate
RANCHI: Upholding the order of single bench, the double bench of Jharkhand High Court headed by Chief Justice MS Ramachandra Rao, imposed a fine of Rs one lakh on Jharkhand Public Service Commission (JPSC) for wrongfully rejecting a qualified Scheduled Tribe (ST) candidate Manoj Kumar Kachhap's application for the post of Assistant Professor. The court had earlier reserved its judgment after hearing arguments from both the parties. Kachhap had scored 72.10 out of a possible 85 marks in the academic evaluation. However, his name did not appear in the list of candidates shortlisted for interviews. Disappointed Kachhap made an enquiry and discovered that his application had been invalidated because the online examination fee, he had paid, did not reach the JPSC account due to some technical error. Owing to non-payment of the examination fees his application was considered invalid. Significantly, his name was not mentioned in the official rejection list, leaving him unaware of the issue. Kachhap then approached Jharkhand High Court and filed a writ petition. After a thorough hearing, a single bench of the High Court had given the verdict in his favour. The single bench ordered that he be included in the interview process, noting that the final decision would hinge on the court's verdict. JPSC complied, and Kachhap appeared for the interview.

Will complete JSSCCGL paper leak probe in a month: State in HC
Ranchi: The state govt on Wednesday informed the Jharkhand high court that investigation into the alleged leak of question papers of the Jharkhand Staff Selection Commission Combined Graduate Level (JSSC CGL) exam would be completed within a month's time. Investigation done till now has not revealed that question paper was leaked, he added. A division bench of Chief Justice MS Ramachandra Rao and Justice Rajesh Shankar were hearing a public interest litigation (PIL) filed for an independent probe into the alleged leak of question papers of the JSSCCGL exams. Earlier, the court had clamped a stay on the release of results of the exams and directed the govt to initiate investigation through the police. The stay on the publication of results will continue. The JSSCCGL examinations were conducted by the conducted by the Jharkhand Staff Selection Commission (JSSC) on January 28, 2024. There were allegations of leak of question paper due to which the examination was cancelled. The exams were again conducted on September 21 and September 22 last year. It was again alleged that the papers were leaked. The examinations were conducted to fill 2025 vacant posts across different departments in the state govt. The case would next be heard on June 18.
