Karnataka HC strikes down amendment laws on civic body's retrospective levies

, the high court has struck down the
Karnataka
Municipal Corporations and Certain Other Law (Amendment) Acts of 2021 and 2023. These acts aimed to validate previous collections of various fees from Bengaluru residents and builders.
The 2021 Amendment Act was enacted to override the high court's earlier decision in the Sundaram Shetty case rendered in 2021, which declared the practice of linking levies to guidance value as illegal. While litigation against the legislation was under way, the govt promulgated a second amendment in Aug 2023, introducing further definitions of "ground rent," "guidance value," and "scrutiny fee," amending Section 240A of the BBMP Act and attempting once again to validate past levies retrospectively.
The petitioners, comprising developers and property owners, challenged the levies imposed by BBMP and BDA during the layout and building approval process. These included scrutiny fees, ground rent, licence fees, security deposits, lake rejuvenation fees, and compound wall charges under the BBMP Act 2020, and water supply cess, slum cess, surcharges for mass rapid transit and ring road, administrative charges, and betterment charges under the Karnataka Town and Country Planning Act, 1961 (KTCP Act).
In his order, Justice R Devdas noted that after a coordinate bench ruling in Oct 2021 (Sundaram Shetty case) declared these levies unenforceable, the authorities had an opportunity to reconsider the rates. However, they maintained similar rates through govt circulars without proper justification or empirical data collection, as suggested in that order.
Development plan
The judge also declared the provisions contained in Section 18A of KTCP Act (collection of cess and surcharge by a planning authority), read with rules 37-A and 37-C of Karnataka Planning Authority Rules, 1965, are applicable only in respect of a development plan for construction on plots measuring over 20,000sqm and not for plots measuring less than that. If a fee was earlier collected for a change of land use or while approving a layout plan, a fee shall not be collected for a subsequent development plan, the judge added.
While the govt and BBMP retain the right to establish new standards based on empirical data, Justice Devdas also suggested implementing a one-time settlement scheme to resolve the situation. The court highlighted that the fee collection was intended for large construction projects but was being applied indiscriminately. Citizens began objecting after a Sept 4, 2015, circular revised ground rents and linked them to guidance values.
The provision made in clause 3.8 of the building by-laws permitting a person to stock building materials on public land/roads/pavements would be directly in the teeth of the statutory provision contained in Section 229(2) of the BBMP Act, 2020, which empowers the zonal commissioner to summarily evict any encroachment, either temporary or permanent, caused on a public street including footpaths, the judge pointed out while emphasising that public safety should not be compromised, particularly regarding road and pavement maintenance. The court noted that the fees should correspond to the services provided by BBMP, following the principle of quid pro quo.
The petitioners demonstrated through BBMP's financial records that relevant factors weren't considered when determining fees. The court agreed that service charges should be uniform across localities and vary only based on plot size and construction extent, rather than property's guidance market values.

With uncleared bills, land acquisition issues, and just 50 per cent of the construction complete over eight years, the flyover has been creating more troubles instead of easing congestion in the area. Meant to connect Kendriya Sadan in Koramangala to the inner Ring Road at Ejipura Junction, the flyover stretches across 2.5 km. Its construction was approved in 2014 and a tender was awarded in 2017 with a 30-month deadline. The project was supposed to be completed in November 2019 but the Bruhat Bengaluru Mahanagara Palike (BBMP) extended the deadline to December 2020 and imposed a penalty for delay. Despite protests from residents and elected representatives, nothing changed. However, after the Karnataka Congress government came into power, Deputy Chief Minister D K Shivakumar said in August 2023 that an additional Rs 141 crore was required for the project and assured to solve the problem soon. 'It is really unfortunate that the project has been delayed. I will ensure that it is completed,' he said then. Last month, Transport Minister Ramalinga Reddy said that around 50 per cent of the flyover's work was complete and the rest was underway. 'Initially, there was no need for land acquisition, but the BBMP still went ahead and notified 32 properties. Issues related to one property and the St John's (hospital) property are likely to be resolved in the coming days,' he said, adding that pending bills for the completed works will also be cleared soon. 'In view of the monsoon, I have instructed officials to lay an additional layer of asphalt under the flyover to ensure smooth traffic movement. We expect 90–95 per cent of the work to be completed by December,' he said. However, an official associated with the project said they are yet to iron out land acquisition issues. 'A portion of land close to St John's Hospital is yet to be acquired. A meeting has to be held with the stakeholders,' the official told The Indian Express. As of now, 416 segments out of the planned 762 have been cast, and 291 segments have been erected, according to the BBMP. On the ground, commuters and shopkeepers remain frustrated. While construction is going on, its pace is slow. Mohan Kumar, a traffic police constable stationed at the site, says, 'Peak traffic hours are from 8 am to 11.30 am and from 4.30 pm to 9 pm. It is always congested, and when it rains it becomes worse.' Muthu, an employee at TVS which is located near the construction site, said part of the flyover now passes in front of his shop, which is a sign of recent progress but beyond that point, there are 'just bare pillars.' Alim Pasha, manager of the long-standing Sapphire Gift shop in the area, said the situation has affected business, especially for smaller shops. 'Business has been bad, and people barely come. The store is mostly empty. Even if they come, it is mostly during the afternoon when the traffic is moderate. When it rains, the place in front of the shop gets clogged, so there is hardly any access. This flyover is a tragedy,' he said. Bhoomika Roy Banerjee is an intern with The Indian Express.

Bengaluru: The high court has stayed BBMP's new tender notification for solid waste management issued on May 28, while directing the state govt to submit an affidavit explaining its actions. Justice M Nagaprasanna said the move appeared to be prima facie contempt of court. The order came while hearing a review petition filed by the Bengaluru Mahanagara Swachate Mattu Lorry Malikara Hagoo Gutthigedarara Sangha. The petitioner challenged the fresh tender notification and sought a review of the court's earlier judgment dated April 22, which had upheld a previous BBMP tender issued on Nov 7, 2024. In the earlier order, the judge had allowed the petitioners to participate in the new tender process and directed the state to submit an affidavit outlining a revised timeline for completing it. "The state shall redraw the timeline for the completion of the process of tender at an outer limit of four months, if not earlier. The timeline shall be filed before this court, by way of an affidavit, for its strict adherence," Justice Nagaprasanna had said in the April 22 order. He had added that if the timeline was violated, the petitioners had the liberty to return to the court. In contrast, the advocate general submitted that there was no breach of undertaking as the May 28 tender was distinct from the earlier one. He said an affidavit would be filed to clarify the sequence of events. The Sangha has also raised objections to a govt order dated May 26, which it claims includes clauses that require ministerial approval — allegedly in violation of the Karnataka Transparency in Public Procurements (KTPP) Act. According to the petitioners, the issuance of the new request for proposal (RFP) two days later further undermined the court's April 22 judgment, where the state's undertaking was explicitly recorded. The court will continue hearing the matter after the affidavit is filed.
