Sinking of MSC ELSA 3: Kerala HC orders conditional arrest of sister ship in claims plea
Kochi: The HC on Wednesday ordered the conditional arrest of the vessel MSC Polo II, a sister vessel of MSC ELSA 3, which had capsized and sunk off the Kerala coast on May 25. The order was passed in a petition filed by Sans Cashew India Private Ltd, seeking compensation for the loss of cargo valued at Rs 74 lakh.
Justice M A Abdul Hakhim further clarified that the vessel may be released upon the production of a demand draft for the said amount before the HC registrar general. Earlier, HC had similarly detained another vessel, MSC MANASA F, in connection with petitions filed by various companies to recover compensation for consignment losses arising from the sinking of ELSA 3.
In the present petition, the petitioner submitted that it had lost two consignments of Ghana dried raw cashew nuts (in shell) shipped from Tema port, Ghana, to Tuticorin port, India.

he cargo was transhipped via Adani Vizhinjam Port and loaded onto ELSA 3, which later sank due to technical and operational failures, as confirmed by the mercantile marine department (MMD) and directorate general of shipping. The petitioner contended that they are entitled to recover the maritime claim under the Admiralty (Jurisdiction and Settlement of Maritime Claims) Act, 2017, amounting to Rs 73.49 lakh.
Meanwhile, the counsel for the vessel owner submitted that they had filed caveats before HC to prevent the arrest of vessels operated by the company within Indian territorial waters. It was also contended that the vessel is beyond 14 nautical miles from the Vizhinjam port and hence not available within the jurisdiction of this court. Nevertheless, HC ordered the conditional arrest of MSC Polo II until the production of the demand draft.
Later in the afternoon, the shipping company produced the demand draft before the registrar. The petition has been adjourned to June 23.

New Delhi: The Enforcement Directorate (ED), Delhi Zonal Office conducted search operations at 37 locations across the national Capital under the provisions of the Prevention of Money Laundering Act (PMLA), 2002 in the Delhi classroom construction irregularities case and recovered digital evidence and 322 bank passbooks linked to mule accounts opened in the names of labourers, allegedly to divert government funds. "During the searches, original departmental files belonging to the Government of National Capital Territory of Delhi (GNCTD) and rubber stamps of officials of Public Works Department (PWD), various incriminating documents showing fake invoices submitted to GNCTD departments, showing inflated/bogus claims, digital evidence and 322 bank passbooks linked to mule accounts opened in the names of labourers to divert government funds were recovered and seized", said an ED Press statement on Friday. It is pertinent to note here that the ED initiated this investigation on the basis of a First Information Report (FIR) registered by the Anti-Corruption Branch (ACB) on April 30, alleging irregularities in the construction of 12,748 classrooms or semi-permanent structures in government schools. On April 30, the ACB registered a FIR against senior Aam Aadmi Party (AAP) ministers Manish Sisodia (the then Education Minister) and Satyendar Jain (the then Public Works Department minister) and others, over alleged corruption in the construction of classrooms. The FIR was pertaining to financial misappropriation exceeding Rs 2,000 crore in the construction of approximately 12,748 additional classrooms by the PWD, between 2015 and 2023. Notably, Manish Sisodia on Friday was questioned for nearly three hours by the ACB over the same case. The former Deputy Chief Minister of Delhi left the ACB's office at around 2.40 P.M. after appearing before investigators around noon. While the former education minister accused the ruling Bharatiya Janata Party (BJP) of misusing investigative agencies for political vendetta, the ACB said that the scam involved inflated costs in the construction of classrooms and school buildings under the Delhi government.

Centre flags possible tax evasion as Indian funds in Swiss banks triple to Rs 38,000 crore
Amid reports that Indian funds in Swiss banks tripled to Rs 38,000 crore in 2024, the Centre said it is closely monitoring possible tax evasion, leveraging various information exchange mechanisms with Switzerland on foreign assets and income. In a statement issued on Friday, the finance ministry said that India regularly receives information about such foreign accounts and assets from 100+ tax jurisdictions, including Switzerland. It further said that Switzerland has been providing annual financial information about Indian residents since 2018 under the Automatic Exchange of Information (AEOI) framework. The first data transmission to Indian authorities occurred in September 2019, and the exchange has continued regularly since then, covering even those accounts suspected of involvement in financial irregularities. According to a Swiss National Bank report, money parked by Indians in Swiss banks more than tripled in 2024, reaching 3.54 billion Swiss francs, or Rs 37,600 crore. Elaborating the mechanism to check tax evasion, the finance ministry has said that the tax department regularly undertakes a systematic review of data so received and identifies taxpayers, whose cases require further verification.
