A GOP challenge to the Pennsylvania Supreme Court's ruling on provisional ballots is dead, after the U.S. Supreme Court declined to hear the case Friday.
The high court's rejection means county boards of elections must count provisional ballots cast by voters who find out their mail-in ballots have been rejected under the state Supreme Court's decision in October.
The case at issue, Faith Genser et al vs. the Butler County Board of Elections, stemmed from a lawsuit filed after the 2024 primary election by two Butler County voters. They claimed they were disenfranchised when the board refused to count provisional ballots the voters cast on Election Day, after learning their mail ballots were disqualified for missing dates.
The board of elections reasoned that the Pennsylvania Election Code says provisional ballots from voters whose mail-in ballots are 'timely received' can't be counted, even if the voters' mail-in ballots are rejected.
In its 4-3 decision, the state Supreme Court found the Elections Code requires county elections officials to count provisional ballots if no other ballot is attributable to the voter, and as long as there are no other issues that would disqualify their provisional ballot.
The U.S. Supreme Court did not explain its decision not to hear the appeal. Attorneys for the RNC and Republican Party of Pennsylvania did not respond to an email requesting comment.
'Republicans don't think every rightful vote should count. We disagree, and now, the Supreme Court has sided with us. Pennsylvanians deserve to have their say in every election – full stop,' Democratic National Committee Chairperson Ken Martin said in a statement.
The case is one of many involving 'paperwork errors' on vote-by-mail-ballots, since absentee voting without an excuse became an option in 2019 with the passage of Act 77.
'Every election, thousands of Pennsylvania mail ballots are voided due to common technical mistakes made by voters,' Rich Ting, senior staff attorney at the ACLU of Pennsylvania, said. 'Thanks to Faith Genser and Frank Matis fighting for their right to vote, all Pennsylvania voters who make those mistakes are guaranteed the right to vote by provisional ballot as a failsafe.'
The ACLU of Pennsylvania and the Public Interest Law Center with pro-bono counsel from Dechert LLP represented Genser and Matis in their lawsuit.
'The Supreme Court's determination not to hear this case means that Pennsylvanians who make a technical mistake with their mail-in ballots will have a way to fix the mistake instead of losing the opportunity to vote,' Ben Geffen, senior attorney at the Public Interest Law Center, said.
In its petition to the U.S. Supreme Court, the GOP argued the state Supreme Court usurped the Pennsylvania Legislature's authority to set the 'times, places and manner' for congressional elections, leaning on a premise known as the 'independent state legislature theory.' That theory asserts that the U.S. Constitution reserves the authority to set the times, places and manner of elections exclusively for state legislatures.
In opposition, the DNC and Pennsylvania Democratic Party asserted that the U.S. Supreme Court lacks jurisdiction, because the case falls outside the limited circumstances in which it can review the judgment of a state's highest court. Such appeals are allowed only when a federal law is in question, a state law is claimed to conflict with federal law or 'where any title, right, privilege, or immunity is specially set up or claimed under the Constitution.'
The decision last week is the second time the U.S. Supreme Court has passed on reviewing the Pennsylvania Supreme Court's decision. In November it refused to place a stay on enforcement of the ruling days before the presidential election.
The Pennsylvania General Assembly has taken steps to pass amendments to clarify the vote-by-mail law in recent weeks.
House Bill 1396, sponsored by Speaker Joanna McClinton (D-Philadelphia) would give election workers up to a week before Election Day to prepare to count mail-in ballots, a process that has been a bottleneck for election results in parts of the state, and has provided fodder for election deniers. The measure would remedy other ambiguities in Act 77, such as making clear that county election officials must notify voters if their mail ballots are rejected. It passed the House with a 102-101 vote along party lines May 13.

She defied court orders to issue the licenses until a federal judge jailed her for contempt of court in September 2015. Davis said her faith forbade her from what she saw as an endorsement of same-sex marriage. Faith leaders and conservative political leaders including former Arkansas Gov. Mike Huckabee and then-Kentucky Gov. Matt Bevin rallied to her cause. After her release from jail, Davis addressed the media, saying that issuing same-sex marriage licenses 'would be conflicting with God's definition of marriage as a union between one man and one woman. This would be an act of disobedience to my God.' Davis declined a request for an interview from The Associated Press for this story. In 2018, one of the men who had confronted Davis over her defiance ran for her office. David Ermold said he believed people in Rowan County were sick of Davis and wanted to move on. When he went to file his papers for the Democratic primary, Davis, a Republican, was there in her capacity as clerk to sign him up. Sitting across a desk from each other, the cordial meeting contrasted the first time they met three years earlier. Both candidates lost; Ermold in the primary and Davis in the general election. She has not returned to politics. Davis' lawyers are attempting again to get her case before the Supreme Court, after the high court declined to hear an appeal from her in 2020. A federal judge has ordered Davis to pay a total of $360,000 in damages and attorney fees to Ermold and his partner. Republicans on Capitol Hill quickly lined up behind President Trump after he announced that the U.S. conducted a strike on three Iranian nuclear facilities, a strong show of support for the White House with few detractors inside the GOP. Trump announced on Truth Social just before 8 p.m. EDT on Saturday that the U.S. 'completed our very successful attack on the three Nuclear sites in Iran,' including Fordow, the nuclear site hidden in a mountain south of Tehran. He is scheduled to address the nation from the White House at 10 p.m. Republican leaders in the House and Senate backed the action, which had become a debate of sorts in Washington — especially among GOP — since Israel struck Iranian nuclear facilities earlier this month in what it called a 'pre-emptive' attack. Two of the Senate GOP's top Iran hawks — South Carolina Sen. Lindsey Graham and Arkansas Sen. Tom Cotton — passionately defended President Donald Trump's Saturday strikes on key Iranian nuclear infrastructure as the White House looks ahead to Tehran's response. Speaking with NBC's Kristen Welker on Sunday, Graham, who has long advocated forcefully targeting the country's nuclear capability, pushed back on the view that an assault on Iran would bear similarities to America's long, difficult war in Iraq. "The country is in the hands of religious Nazis," Graham said of Iran on "Meet the Press." "They want to kill at the Jews. And they're coming after us. And they were set back. And to Steve Bannon and all those people, Iran is different. Nuclear weapons in the hands of the Ayatollah is a nightmare for the world." Republicans largely sided with the President after he announced the attacks on nuclear sites Natanz, Fordo (also known as Fordow) and Esfahan on Saturday. Even some with isolationist tendencies, Vice President JD Vance among them, are supporting the idea of targeted strikes as a means to return to the negotiating table. But some Democrats, and a handful of Republicans, say that Trump didn't have the constitutional authority to launch the attack, and that he should have sought approval from Congress. "We can't be the commander-in-chief," Graham told Welker. "You can't have 535 commander-in-chiefs. If you don't like what the president does in terms of war, you can cut off the funding. But declaring war is left to the Congress. We've declared war five times in the history of America. All of these other military operations were lawful. He had all the authority he needs under the Constitution." Speaking with ABC's Jonathan Karl on Sunday, Cotton insisted the White House still holds the leverage ahead of any diplomatic talks or military escalation. "We haven't targeted the supreme leader; we haven't targeted their energy infrastructure," he said on "This Week." "We haven't targeted other critical infrastructure. That's an implicit message that Iran still has things that they hold dear that neither the United States nor Israel has struck. Iran needs to heed President Trump's warning."
