
‘Anti-competitive practices'; CAT upholds Rs50mn fine on Vanaspati Manufacturers Association
The Competition Appellate Tribunal (CAT) dismissed the appeal filed by the Pakistan Vanaspati Manufacturers Association (PVMA), thereby upholding the Competition Commission of Pakistan's (CCP) order imposing a Rs50 million penalty for engaging in anti-competitive conduct and discriminatory practices, a statement said on Friday.
PVMA, an association representing nearly 100 ghee and cooking oil manufacturers across Pakistan, had challenged the CCP's 2011 decision that found it in violation of Sections 3 and 4 of the Competition Act, 2010.
According to the statement, the case originated from an inquiry and subsequent show cause proceedings initiated in April 2011 after CCP observed coordinated price hikes in the edible oil sector.

'The commission concluded that PVMA had used its platform to orchestrate price-fixing arrangements, whereby it negotiated prices with government authorities and advised its members to implement uniform pricing.'
Though PVMA claimed these were mere recommendations, the commission found that such directives were in fact enforced, resulting in reduced price competition.
The CCP also established that PVMA had entered into agreements with oil tanker associations and the National Logistics Cell (NLC) to fix transportation rates.
'These arrangements, in the commission's view, distorted fair competition in the logistics sector and disadvantaged non-member market players. In addition to collusive pricing and logistics agreements, PVMA was found to have abused its dominant position by charging discriminatory fees for the verification of import invoices—a responsibility delegated to it by customs authorities to address under-invoicing concerns,' the statement said.
PVMA charged its own members Rs4 per metric ton for this service, while charging commercial importers Rs10 per metric ton without offering a valid justification.
In its defense, PVMA argued that its members paid a substantial membership fee and annual dues, and that the commercial importers ultimately sold their products to PVMA's member manufacturers.
It further claimed that it lacked the statutory authority to enforce any pricing arrangements and had only acted on government pressure to stabilise prices in response to fluctuating international palm oil rates. However, both the CCP and the Tribunal rejected these justifications.
The tribunal observed that the verification service was delegated to PVMA by customs authorities for all importers, and that distinguishing between members and non-members in charging service fees was unjustified.

The order stated that such discriminatory charges could not be rationalised under the concept of 'objective justification,' especially when the burden of these charges ultimately fell on the members of PVMA.
While the CAT upheld the Rs50 million fine imposed by the CCP, it modified the commission's order by granting PVMA a 15-day period to rectify its discriminatory conduct.
'Should PVMA fail to comply within the stipulated timeframe, an additional penalty of Rs1 million per day of default—originally part of CCP's order—would be reinstated.'
The tribunal emphasised that even non-binding or advisory decisions taken by associations can violate competition law if they lead to a reduction in market competition.

In its report, presented in the upper house of parliament on Saturday, the committee also opposed increased taxation on 800cc vehicles, suggesting a 12.5% cap. It also called for a review and further increase in government employees' salaries. Earlier, Senate Leader of Opposition Shibli Faraz objected that the report had not been presented to them earlier and questioned how a 100-page document could be read and reviewed in 10 minutes. He criticized the government for not reducing its expenditures and instead taxing those already burdened with taxes. Responding to the criticism, Senator Mandviwalla stated that he had remained in contact with Shibli and Mohsin Aziz of the PTI. He said all parties, including the PML-N, the PPP, and the PTI, participated in the discussions, offered suggestions, and voiced their concerns. He said the committee staff worked till 2 am and while the draft may not have been shared due to an oversight, all recommendations in the final version reflected the committee's discussions. Concluding the budget debate, Finance Minister Muhammad Aurangzeb acknowledged the valuable, balanced, and constructive input provided by senators over the past one and a half weeks. He said this consultation helped guide the government's economic policies and reinforced its commitment to transparency, fiscal responsibility, and sustainable development. "During the past fiscal year, no mini-budget was introduced, inflation was brought under control, foreign reserves increased, and the current account improved significantly," he added. He announced tax relief for salaried individuals earning between Rs600,000 and Rs1.2 million annually by reducing the income tax rate from 2.5% to 1%. This, he said, was a symbolic and practical gesture to show that the government does not wish to overburden the middle class. He also announced a 10% increase in government employees' salaries and a 7% raise in pensions. Taxes on agricultural pesticides were removed, and, following the prime minister's direction, 1,000 graduates would be sent to China for further opportunities. Regarding solar panels, the finance minister said the proposed 18% sales tax on imported parts was meant to protect local industry and create a competitive environment for solar technology investment in Pakistan. However, after consultation, the government decided to reduce the tax to 10%, applicable only to 46% of imported components, resulting in a 4.6% price hike for imported panels. He warned against profiteering, noting that some opportunistic elements had already begun increasing prices before the tax's implementation. He assured that the government would take strict legal action against such exploitation in the public interest. Aurangzeb said the relief and social protection measures included in the 2025-26 budget are not merely temporary reliefs but a practical reflection of the state's recognition and acceptance of its responsibilities. "A key measure is the increase in the budget of the Benazir Income Support Programme (BISP) from Rs592 billion to Rs716 billion. "Expanding the scope of financial assistance under BISP reflects the government's commitment to providing economic protection to the most vulnerable segments of society," he added.

Proposed sweeping powers for FBR will cripple economy: PBF
LAHORE: Pakistan Business Forum (PBF) has strongly denounced the Federal Budget 2025; calling it a direct assault on the business community and warning that the sweeping powers proposed for the Federal Board of Revenue (FBR) will cripple the economy and trigger widespread unrest if not immediately reversed. Speaking to the media, Muhammad Naseer Malik, Chairman (Central Punjab) of the PBF, said the Finance Bill introduces a range of unprecedented and undemocratic enforcement clauses that violate the principles of fair taxation and due process. He warned that these proposals will create an environment of fear and intimidation, where businesses operate under constant threat of legal action without the protection of proper checks and balances. PBF highlighted specific provisions of the Finance Bill 2025 that it says are particularly damaging to business confidence and fundamental rights: Section 37AA allows for the arrest of individuals without a warrant, solely on the basis of suspicion of tax fraud, paving the way for arbitrary detentions and harassment. Section 14AE empowers FBR officials to seize business premises and property without judicial oversight or meaningful safeguards. The Section 37B authorizes the detention of businesspersons for up to 14 days, with possible extension by a magistrate, even before the conclusion of an investigation. Further, Section 11E permits FBR to make tax assessments and initiate recovery based purely on suspicion, bypassing the need for a complete inquiry or verifiable evidence. Section 33 (13 & 13A) introduces 10-year prison terms and Rs10 million fines for vaguely defined 'tax fraud,' which the PBF warns could criminalize genuine business errors or disputes. Section 32B grants private auditors quasi-legal authority, allowing them to act with powers that blur the line between auditing and prosecution — a move PBF considers both unconstitutional and dangerous. 'These provisions do not promote tax compliance — they institutionalize fear, harassment, and unchecked power,' Malik said. 'They will push the business community to the edge, and many will be forced to shut down operations or move abroad.' The PBF also criticized the existing tax structure, pointing out that the effective tax burden on businesses has soared to between 50% and 60%, the highest in the region. This includes a 25% corporate tax, 25% tax on dividends, super tax, sales tax, withholding taxes, and high import duties. According to the Forum, these combined pressures make investment, expansion, and job creation impossible under the current fiscal regime. In addition to demanding the complete withdrawal of the above clauses, the PBF is calling for a reduction in interest rates to 6% to support business recovery and economic growth. The Forum believes that a more balanced tax policy - coupled with targeted reforms and incentives - could double public spending on education and health without suffocating the productive economy. Naseer Malik also warned if the Finance Bill 2025 is passed in its current form, Pakistan's economy will face irreversible damage. If the government thinks it can collect taxes without taxpayers, it is free to try. IMF rejects tax rebate for teachers, researchers: FBR
ISLAMABAD: Federal Board of Revenue (FBR) Chairman Rashid Mahmood Langrial, Saturday, informed the National Assembly Standing Committee on Finance that the International Monetary Fund (IMF) has rejected proposal of the FBR to allow 25 percent tax rebate to teachers and researchers from July 1, 2025. The FBR chairman informed the committee that the FBR has twice approached the fund, but they have not agreed. The IMF wants harmonisation of taxes and not allowed the said tax rebate to teachers/researchers. However, the government can give subsidy from budget if possible. MNA Nafeesa Shah stated that the government can give some kind of special allowance to teachers. Budget FY26: Aurangzeb announces major tax relief for salaried class, solar sector State Minister of Finance Bilal Azhar Kayani regretted that there is no fiscal space available in 2025-26. The National Assembly Standing Committee on Finance approved the revised procedure of arrest in cases of tax fraud as approved by Senate Standing Committee on Finance. The FBR chairman informed the committee that the FBR has its own jails to keep persons involved in tax fraud and it can also use other jails for this purpose. The government has incorporated four major safeguards for allowing arrests on tax frauds in order to avoid misuse of powers. In the first pre-requisite, the minister said that the accused of tax fraud would be arrested where there was a fear of his escape, but it would be done with the approval of three members of the Board, including FBR Member IR (Operations) and FBR Member Legal. The tampering of proof could be the second reason, and the third reason could be tax fraud amounting to Rs50 million. The fourth condition of the arrest, he said, would only be possible if someone received three notices but not bothered to respond. The FBR chairman informed that the relevant clause of income tax exemption to pensioners has been deleted from the Income Tax Ordinance to tax only pensions above Rs10 million. The committee recommended that the withholding tax should be increased from 0.6 per cent to 0.8 per cent on cash withdrawals from banks by non-filers. However, the committee rejected the proposal of Senate Standing Committee on Finance to raise tax rate from 0.6 per cent to 1 percent. On the taxation of salaried individuals, the FBR chairman informed that only one per cent tax would be applicable on salaried individuals where taxable income exceeds Rs600,000 but does not exceed Rs1,200,000.
