Charges are dropped against college students in 'Catch a Predator' case

A judge has dismissed conspiracy and kidnapping charges against five Massachusetts college students who were accused of plotting to lure a man to their campus through a dating app and then seizing him as part of a trend on social media.
The Assumption University students, all teenagers, were arraigned in January and entered not guilty pleas. Since then, their lawyers had filed motions seeking to dismiss the charges, saying authorities lacked probable cause to believe they committed crimes.
Following a hearing last month, a Worcester District Court judge on Tuesday dismissed the conspiracy and kidnapping charges against Kelsy Brainard, Easton Randall, Kevin Carroll, Isabella Trudeau and Joaquin Smith. It wasn't immediately known if charges were still pending against a sixth student, whose case was being handled in juvenile court.
One of the students who was charged had told police that the trend was modeled on 'To Catch a Predator,' NBC's discontinued program that, during its three seasons, aimed to catch adults seeking to prey on minors using undercover cameras and decoys impersonating underage dates, according to a statement of facts in the case.
Police say Brainard's Tinder account was used to lure the man to the private, Roman Catholic university in Worcester last October and that the encounter was caught on video.
Brainard still faces a charge of witness intimidation and Carroll faces a charge of assault and battery with a dangerous weapon.
'We are grateful that the court, after a fair hearing and due consideration, applied the law properly,' Brainard's lawyer, Christopher Todd, said in an email Wednesday. 'No decisions have been made about our path to resolution of the remaining count.'
A message seeking comment was emailed Wednesday to Carroll's lawyer.
The Assumption University Police Department 'fulfilled its duty as an accredited law enforcement agency by filing charges describing the facts of the incident and the elements of a crime under Massachusetts law,' university spokesperson Matt McDermott said in an email Wednesday. 'The district attorney accepted and prosecuted those charges. All of the charges in the case, including those that remain in place, are within the purview of the judicial system to resolve.'
The district attorney office's rules of professional conduct preclude it from commenting, 'as there are still pending cases in this matter,' spokesperson Lindsay Corcoran said in an email.
A report filed by campus police said a 22-year-old active-duty military service member connected with a woman on Tinder in October and was invited inside a basement lounge. Within minutes, 'a group of people came out of nowhere and started calling him a pedophile,' accusing him of wanting sex with 17-year-old girls, according to the report.
The man told police that he broke free and was chased by at least 25 people to his car, where he was punched in the head and his car door was slammed on him before he managed to flee.
Campus surveillance video shows a large group of students, including the woman, 'all with their cellphones out in what seems to be a recording of the whole episode,' the police statement said. They are seen 'laughing and high fiving with each other' in what appeared to be 'a deliberately staged event,' and there was no evidence to indicate the man was seeking sexual relations with girls, the police report said.
Todd's motion to dismiss said the video does not show anyone making an active effort to restrain the man and that Brainard stays on the couch in the lounge after he leaves. He said it was insufficient evidence to show 'that she was willing to assist in this 'kidnapping.'' Todd also said there was no evidence of a plan to hold the man against his will.
Todd said a review of the conversation on the Tinder app shows the woman says she is 17, soon to turn 18. The man says 'that's fine, you're in college.'
"To Catch a Predator," which aired from 2004 to 2007, used hidden cameras and people posing as minors in online chat rooms to lure alleged predators to houses where the host would confront them. The program did not condone or include any violence.

One worker at the Nikolus Tavern said of the first argument: 'We recognised him as the footballer Andy Carroll immediately. 'He seemed very drunk and furious with his partner. 'He was using very bad words. It was improper behaviour. The woman looked very upset.' Police arrived and took the former Newcastle, Liverpool and West Ham ace to one side for a chat. He was later allowed to return to Lou, 42. The shocked restaurant worker said: 'Police spoke to him. He was allowed to return, and the couple left after paying for their meal. Andy was very calm when the police arrived — he stood up and spoke to them outside the restaurant.' But just hours later, police were called again by alarmed staff after reports of damage to the couple's room at a £500-a-night boutique hotel. But she shared only one from Mykonos — a beach scene with neither of them in it. However, they appear to have patched up their differences, with the latest images shared including spending time together with Lou's dad on Father's Day last Sunday. Bearded Andy was reportedly planning to propose to Lou despite still being married to Billi, 36. The millionaire striker and wife confirmed their split last September. Weeks later, he and Lou revealed their romance. They moved to France after he joined fourth-tier club Bordeaux. But Carroll last week announced he was quitting the club to be closer to his children. As well as three with Billi, he has two from a previous relationship. A joint statement from Carroll and Lou last night said: 'Whilst having a private dinner in a restaurant on a quiet holiday in Mykonos, we had a heated discussion of the sort that most couples have had on occasion. It quickly became apparent to the police that there was no reason for them to be there. 'We went outside the restaurant with them together as they insisted they wanted to 'look after' us. 'As far as we are concerned, the situation has been blown out of all proportion by an interested member of the public. No one was arrested and no one was charged with anything. We are very happy, in love and looking forward to our future together and we are disappointed that a private disagreement has become a public matter.' The Minnesota lawmaker who survived an attack by a gunman on his doorstep is still in a critical condition and has revealed details of the terrifying moment he and his wife were shot multiple times. Sen. John Hoffman and his wife, Yvette, released a statement Thursday, obtained by NBC affiliate KARE of Minneapolis, outlining the events in the early hours of June 14. The Hoffmans continue their recovery in the hospital — Sen. Hoffman is in a critical but stable condition, while his wife is in a stable condition, the statement said. The suspected gunman, Vance Boelter, is accused of shooting them and killing the state's top legislator, Melissa Hortman and her husband, Mark Hortman. Minnesota Gov. Tim Walz described the shootings as "targeted political violence." In the statement, the Hoffmans described the night of the shooting, which occurred after they returned to their Champlin home from a dinner. Their adult daughter Hope was also present. "At approximately 2:00 a.m., we were all awakened by the sounds of pounding on the front door and shouts of someone seeking entry, identifying himself as a police officer," the couple's statement said. "When the door was opened, all three of us were in the entryway. John initially lunged at the gunman as the weapon was pointed directly at him, getting struck nine times. As John fell, Yvette reached out to push the man and shut the door, succeeding before she was also hit eight times by gunfire," the statement continued. The couple's daughter then shut the door and locked it before phoning 911. "Her brave actions and quick thinking triggered the notice to public safety officials that a politically-motivated act was potentially underway," the statement said. The Hoffmans thanked the medical professionals who cared for them and the law enforcement officers who attended the scene and eventually caught Boelter after what became the biggest manhunt in Minnesota history. The couple also said they were "heartbroken to know that our friends Melissa and Mark Hortman were assassinated," adding that their daughters went to school together In the statement, the couple also thanked the local community and Fernbrook School, where Yvette Hoffman works, for organizing a GoFundMe page that has raised almost $200,000 to pay for medical expenses and increased security measures. Prosecutors said that notebooks found in Boelter's SUV and at his home showed the names of more than 45 state and federal elected officials. The Hoffmans reflected on the threat faced by public officials and said they understood that public sector figures sacrifice some level of privacy. "But now we are grappling with the reality that we live in a world where public service carries such risks as being targeted because someone disagrees with you or doesn't like what you stand for," they said.

Despite its abundance of sheep and rolling hills, it seems Welsh residents are in search of greener pastures, with a depressing 46% having cheated on a partner. It's not like there's stiff competition either – Wales has proved to be the most unfaithful area in the UK by 13%. *Limits Tinder range to England and Scotland only*. Welsh residents were also the most likely to say they'd been cheated on, too, with 62% saying this had happened to them, compared to the national average of 48%. The new study by Eflorist found West Midlands residents were next on the list with a third of them having cheated on a partner. Now, cheating doesn't just mean they've had sex with someone behind their partners back, it could also mean a drunken kiss or breaching your partners trust in regards to someone else – but we're talking physical cheating here. Places like Berkshire, Hampshire, East Sussex, Surrey and Kent in the South East are also seeing relationships thrive, with just a fifth of the population being unfaithful. But when it comes to the most faithful of them all, England is out of the running. The most faithful area in the UK is actually Northern Ireland. Only 13% of its population has cheated, but this area of the UK also had the highest number of residents who wanted to be in a non-monogamous relationship. So, maybe they're just exploring consensually. Sheela Mackintosh-Stewart a matrimonial consultant and a divorce lawyer previously told Metro there's certain triggers she sees time and time again which lead to infidelity. 'Modern relationships undergo constant pressures, whether that's handling the demands of everyday life, having to constantly juggle a hefty work-life balance or dealing with pressures on social media,' Sheela said. Have you ever cheated on a partner 'Common triggers I've seen include boredom, loneliness, depression, marital unhappiness, the need to spice it up and escape from the ordered predictability and humdrum of daily life, and domestic routine with the intoxicating edge of danger and thrill.' She also says that cheaters are often looking for validation or support. 'Often infidelity will occur when a person is feeling particularly vulnerable and doesn't feel their additional emotional needs are being met – such as when a parent dies, when work becomes stressful, or a midlife crisis,' she added.
