Nation awaits verdict in Joshlin Smith human trafficking and kidnapping case

The day the entire nation has been waiting for has arrived - the day of sentencing in the Joshlin Smith disappearance.
Jacquen 'Boeta' Appollis, Steveno van Rhyn, and Kelly Smith will know their fate on Thursday.
On Wednesday, State Advocate Zelda Swanepoel urged the Western Cape High Court to impose the prescribed minimum sentence of life imprisonment for the human trafficking conviction. While she left sentencing on the kidnapping charge to the discretion of the court, she emphasised the severity of the crime.
'We use today's evidence to be the voice of Joshlin,' said Swanepoel.
Judge Nathan Erasmus also referred to the trauma this case has left behind, recalling an earlier statement of Kelly's mother, Amanda Smith Daniels, where she stated she would go in a frantic search for Kelly's son should he be only two minutes later on his way home from school.
'Will Saldanha ever be the same after this case?' Judge Erasmus asked.
'This instance has changed the whole community and changed how we all look at things,' Swanepoel submitted.
She called on the court to take the victim impact statements into account that were handed in as evidence during the morning.

Swanepoel told the court on the day Joshlin was reported missing, February 19, 2024, Boeta was in a parental position.
Van Rhyn she stated, was identified as a menace to society.
'We have seen Ms Smith getting emotional and crying in court. But, respectfully, I want to say. It's a little too late,' Swanepoel submitted.
Judge Erasmus also advised the trio to bring all their belongings along with them.
'You will probably be transferred to maximum security facilities and will not back to to the prison where you stayed for the night,' he said.

We appreciate the fact that the SAPS acted immediately by sending out a convoy (vehicle in front and behind) our water tankers. The situation has completely calmed down. However, we are calling on the community of Mthatha to help us locate a black [Toyota] Fortuner. Mchunu was in Mthatha at the weekend to engage with and thank members of the SAPS for their efforts during the floods, which have, to date, claimed 90 lives and displaced hundreds more. 'The police will not tolerate any attempt to intimidate or obstruct those who are working tirelessly to save lives and bring relief to our people. Gift of the Givers has consistently been a source of hope and dignity to South Africans in their hour of need. Any attack on them is an attack on the very principle of Ubuntu. No individual or group will be allowed to profiteer off disaster or compromise the safety and well-being of our people. Law enforcement will act decisively,' Mchunu said. He further stated the SAPS will ensure the safety of all humanitarian workers in the area and hold those responsible fully accountable under the law. 'We have also been made aware of individuals who go to the homes of those who lost their lives due to these floods, with a view to committing acts of theft from these homes. Justice for Valentino Grootetjie: Gangsters sentenced for the murder of a 5-year-old in Lavender Hill

Image: Supplied Two Fast Gun gangsters have been convicted and sentenced to life imprisonment for the murder of 5-year-old Valentino Grootetjie from Lavender Hill, who was murdered in 2019 while protecting his little brother from their bullets. The Western Cape High Court on June 5 convicted Carlo Hoffmeester and Chadwin Isaacs of Valentino's murder and the attempted murder of a 22-year-old man and seven others. The little boy was killed as he rushed to shield his 2-year-old brother, pushing him aside, to protect him from the hail of bullets. The State proved the two gunmen entered the premises in Drury Court, Lavender Hill, on December 21, 2019, and opened fire, leading to the death of Valentino and wounding the man. The duo were found guilty under the Prevention Against Organised Crime Act (Poca), murder, eight counts of attempted murder, unlawful possession of a firearm and ammunition. They were sentenced to life imprisonment on the murder count, 90 years for the attempted murders, five years on the Poca count, five years for the illegal possession of a firearm and three years for the illegal possession of ammunition. 'The investigation of the murder and attempted murder case was taken over by the Anti-Gang Unit detectives who worked tirelessly to apprehend the people behind the shooting. "On December 23, 2019, their hard work was rewarded as they arrested two suspects aged 30 and 34 who made their first appearance in the Wynberg Magistrate's Court where bail was successfully opposed. The case was then transferred to the Western Cape Town High court for trial.' National Prosecuting Authority (NPA) spokesperson, Eric Ntabazalila, said State Advocate Leon Snyman proved the accused were members of the Fast Guns gang who were engaged in drug turf wars with the Mongrels Gang in Lavender Hill and surrounding areas. In her sentencing judgment, Judge Melanie Holderness agreed with the State that the accused did not show remorse, failed to take the court into their confidence, and downplayed the seriousness of the offences as they appeared bored during the trial. "There were no substantial and compelling circumstances which allowed the court to deviate from the prescribed minimum sentence of life imprisonment," Ntabazalila said. Western Cape Director of Public Prosecutions, Advocate Nicolette Bell, lamented the loss of an innocent life of a child due to the scourge of gangsterism. Urgent investigation needed into illegal water sales in KwaZulu-Natal
Residents of Mkhambathini in KwaZulu-Natal express outrage over the illegal sale of water by municipal tanker drivers, prompting a call for an investigation by local councillor Tanki Tsoananyana. Image: Supplied Residents of Mkhambathini in KwaZulu-Natal have raised concerns about having to purchase water from contracted water tanker drivers. Concerned about the issue, Tanki Tsoananyana, a Democratic Alliance councillor in the uMgungundlovu District Municipality, wrote to the Municipal Manager, Dr Xolani Muthwa, to request an urgent investigation and action following allegations of tanker drivers illegally selling water to destitute communities. Tsoananyana requested that Muthwa publicise clear mechanisms for residents to report any misconduct by water tanker operators without fear of reprisal. 'According to residents of Mkhambathini, this issue has reportedly persisted for years, with the uMgungundlovu District Municipality appearing complacent and disinterested in addressing this gross violation of human rights,' he said. Tsoananyana said that in one of the wards, they allege that they are forced to wait for more than a week for a single public JoJo tank to be filled. Next Stay Close ✕ Tsoananyana intends to table a motion requesting the municipal manager to launch a full-scale investigation into these claims and to take decisive action against any individuals found to be implicated. 'The illegal sale of water is not merely a procedural breach; it is an act that directly undermines the municipality's mandate to provide basic services and inflicts significant hardship on our most vulnerable residents. It is a source of great frustration and distress for community members who wait patiently for water, only to be bypassed or extorted,' he said. Muthwa said the municipality did not own water tankers, and if there was any misconduct, the contracted company would be informed to take further action against its employees. In September 2024, the uMgungundlovu District Municipality put out a tender for the provision of water tanker services for three years. An estimated 35 trucks were required to deliver water to JoJo tanks within six local municipalities scattered throughout Mgungundlovu District, seven days a week. Contractors were also informed that water is required to be delivered to individual community groupings or informal settlements. Commenting on the illegal sale of water on Facebook and the call for a probe into the matter, Wendy White said: 'I am very glad to see this. My employee lives in the Edendale South area and has had no water at her house all year. She pays a council employee driving a council tanker, R3,000 a month, to fill her JoJo. The excuse is that she has to pay because he delivers to her on a Saturday when she is not working.'
