Two Fast Gun gangsters have been convicted and sentenced to life imprisonment for the murder of 5-year-old Valentino Grootetjie from Lavender Hill, who was murdered in 2019 while protecting his little brother from their bullets.
The Western Cape High Court on June 5 convicted Carlo Hoffmeester and Chadwin Isaacs of Valentino's murder and the attempted murder of a 22-year-old man and seven others.
The little boy was killed as he rushed to shield his 2-year-old brother, pushing him aside, to protect him from the hail of bullets.
The State proved the two gunmen entered the premises in Drury Court, Lavender Hill, on December 21, 2019, and opened fire, leading to the death of Valentino and wounding the man.
The duo were found guilty under the Prevention Against Organised Crime Act (Poca), murder, eight counts of attempted murder, unlawful possession of a firearm and ammunition.
They were sentenced to life imprisonment on the murder count, 90 years for the attempted murders, five years on the Poca count, five years for the illegal possession of a firearm and three years for the illegal possession of ammunition.
The sentences will run concurrently with the murder count.
Anelisiwe Manyana, spokesperson for the police, said the State had proven their case beyond a reasonable doubt.

'Initial reports revealed that on December 21, 2019, two unknown suspects boldly entered a premises in Drury Court, Lavender Hill, and opened fire which led to the death of a 5-year-old and serious injury to a 22-year-old man,' said Manyana.
'The investigation of the murder and attempted murder case was taken over by the Anti-Gang Unit detectives who worked tirelessly to apprehend the people behind the shooting.
"On December 23, 2019, their hard work was rewarded as they arrested two suspects aged 30 and 34 who made their first appearance in the Wynberg Magistrate's Court where bail was successfully opposed. The case was then transferred to the Western Cape Town High court for trial.'
National Prosecuting Authority (NPA) spokesperson, Eric Ntabazalila, said State Advocate Leon Snyman proved the accused were members of the Fast Guns gang who were engaged in drug turf wars with the Mongrels Gang in Lavender Hill and surrounding areas.
In her sentencing judgment, Judge Melanie Holderness agreed with the State that the accused did not show remorse, failed to take the court into their confidence, and downplayed the seriousness of the offences as they appeared bored during the trial.
"There were no substantial and compelling circumstances which allowed the court to deviate from the prescribed minimum sentence of life imprisonment," Ntabazalila said.

Image: File Bogus tax practitioner, Faried van der Schyff, has been sentenced to three years' direct imprisonment for defrauding the South African Revenue Service (SARS) to the tune of R60,000. Van der Schyff, 59, was sentenced in the Cape Town Regional Court on Friday. Hawks spokesperson, Zinzi Hani, confirmed that he was convicted on five of the seven criminal charges he had faced. Van der Schyff is also a co-accused in the mammoth trial against Nafiz Modack and 14 others in the Western Cape High Court, where the accused face approximately 3,000 criminal charges, which include counts of murder, extortion, and contraventions of POCA. Modack was recently also convicted in the Cape Town Regional Court on corruption charges. Van der Schyff was found guilty of income tax fraud, contravention of the Tax Administration Act, and contravention of the Correctional Services Act, and will serve three years in jail. It was reported that Van der Schyff committed fraud from 2016 to 2019 by operating illegally as a tax practitioner without being registered with SARS. 'The accused made clients believe that he was authorised to submit tax-related documents to SARS on behalf of the clients. Due to the accused's criminal activities, SARS suffered actual loss of R60,000,' said Hani. Van der Schyff was sentenced to three years' imprisonment for fraud, two years for contravention of the Administration Act, and two years for the contravention of the Correctional Act for the illegal possession of a cellular device while in custody.

The appeal was heard before Judge Robin Mossop and Judge Mahendra Chetty. The rapist was described as the brother-in-law of the young girl's mother. During the trial, the State led evidence and relied on minor children. The Ulundi Regional Court found the evidence of the victim and other minor children corroborative. Hence; the rapist was sentenced to life imprisonment. The victim told the regional court that she was raped on five separate occasions in 2010. The first rape happened in daylight hours when she visited the homestead of the rapist accompanied by two other young children. She said they went to visit the rapist's child but instead found him. While the other child had gone to the shop, the man told the victim to brush her hair inside the house and he followed her in, locked the door and raped her. When she cried, he threatened to kill her. After that, he gave her R1 to buy ice lollies. When the companion came back from the shop, she testified that she had slightly pushed the door, but the man told her not to get in. She testified that she saw him on top of his victim naked. This was also corroborated by another child who had peed into the window of the room. Moreover, at night, the victim was raped again. One child who had peed through the window said he saw the man again. He said he entered the bedroom where all four children slept. He said that despite being dark, he saw him as he was wearing a white T-shirt. The child also stated that he was the only adult in the house. The victim did not report the incident until a year later, as she was fearful. She and other children were watching a digital versatile disc (DVD) movie where the issue of sex was alluded to. The children mentioned loudly that the victim knew something about sex, her mother overheard this, and inquired more. The victim was taken to Dr Salona Prahladh, who stated that the victim had been raped and the last sexual assault was more than a year ago. The High Court found that the magistrate who sentenced the man did not make any error in finding him guilty. Judge Mossop said there was no doubt that the magistrate applied the cautionary rule used when dealing with evidence of children. 'The person who she was entitled to believe that she would be safe with, the appellant (rapist), turned out to be a predator intent on abusing her,' he said.

JOHANNESBURG - The judge presiding over the corruption case of former Defence Minister Nosiviwe Mapisa-Nqakula is unhappy with the progress of the case, following yet another appeared at the Pretoria High Court on Friday, where she faces 12 counts of corruption and one of money alleged that as defence minister, she solicited and received kickbacks, amounting to R4.5 million from a defence April, Judge Mokhine Mosopa made a ruling that Mapisa-Nqakula's lawyers should be given access to a Dequar Military Police docket. READ: High Court says State isn't infringing on Mapisa-Nqakula's right to a fair trial Prosecutor Paul Louw said that since the docket was from another court, he could not disclose it."I only received confirmation from my colleagues in the SCCU (Specialised Commercial Crimes Court), where the military matter was being held yesterday afternoon, that the docket is available to me as a member of the investigating director. I cannot disclose it, it must formally happen via the office of the national director of public prosecutions." Judge Mosopa adjourned the matter to 18 August for a progress report on the disclosure process.
