Albert Luthuli's funeral a powerful symbol of defiance against apartheid
A reopened inquest into Inkosi Albert Luthuli's death on July 21, 1967, is being held at the Pietermaritzburg High Court.

Pictures of Inkosi Albert Luthuli's body lying emotionless in a coffin during his funeral on July 30, 1967, depicted nothing of a person hit by a train, as it had no dismembered limbs or facial scars, the inquest held at the Pietermaritzburg High Court heard.
Luthuli, a staunch Christian and prayer warrior, was buried eight days after his death on July 21, the same year. His funeral, attended by scores of people from various racial groups, was held at the Groutville Congregational Church Graveyard.
The pictures of his body dressed in a black suit and tie in the coffin were shown on a big screen in the courtroom on Monday during the ongoing reopened inquest.
They were another piece of evidence to reject the 1967 findings that he was killed by injuries sustained from being hit by a steam goods train that was running at 40km/h.

Testifying on Tuesday, Thulani Thusi, a heritage educator at the museum named after the iconic ANC president-general and Nobel Peace Prize winner, concurred with the National Prosecuting Authority (NPA)'s evidence leader, Advocate Annah Chuene, that the elderly man's body appeared intact.
'I see an individual in a casket or a coffin whose body is intact, in other words, there are no missing limbs or any body parts from what I am seeing. Are you seeing the same thing?
'Looking at the facial features of the individual whom you say is Chief Albert Luthuli, on his face, there are no available scars from what I can see on the screen. Is that what you also see?' Chuene asked, to which Thusi responded, 'That is correct, my Lady'.
According to evidence accepted by the initial inquest held on September 21, 1967, Luthuli met with the accident at the Mvoti railway bridge at Groutville village in Stanger, the north coast, in the morning.
He died at the Stanger Provincial Hospital in the afternoon.
It was revealed that before the accident, on that fateful morning, he woke up to take his normal daily routine of going to open his general deal shop, and proceeded to his sugar cane fields using the same route he always used, which was to cross the bridge.
Police officers and a medical expert who testified in the current inquest said it was a fallacy that Luthuli died as a result of the train accident.
Instead, they presented documented medical evidence that the injuries indicated that he had been attacked and assaulted until he lost consciousness.
According to KwaZulu-Natal Department of Health's senior forensic pathologist, Dr Sibusiso Johannes Nsele, who testified last week about his findings after reinvestigating medical reports, Luthuli's injuries on his arms indicated that he was trying to protect himself from his attackers.
Nsele believed that during the assault with a blunt object, Luthuli lost consciousness, which might have led the attackers to believe that he was dead.
They then carried him to the bridge to create a false impression that he had been hit by the train.
In his sworn statement, Thusi said one of the newspapers, which covered the funeral that was held on a Sunday, described the event as 'a theatre for defiance and political dynamism' because of its unusual attendance under the situation created by the apartheid regime.
According to the Albert Luthuli Timeline published on the University of Pretoria website, his funeral was attended by over 7 000 people and 'was the first major public gathering since the ANC's banning in 1960'.
Describing the funeral, Thusi said the articles that were produced after the funeral reflected what happened at that event.
'This was a day that brought multiracial groups to the funeral of Chief Luthuli,' said Thusi.
He said, according to the archives and people who attended the funeral, the funeral was under the watchful eye of the police and special branch members.
The NPA's aim of reopening the inquest into Luthuli's death was to provide evidence that would expose collusion between the security police, district surgeons, pathologists, prosecutors, and magistrate CI Boswell, who presided over the initial inquest, in covering up the killing and protecting the killers from being held accountable.
Meanwhile, the reopened inquest was initially scheduled to run between April 14 and May 16, but its completion was delayed due to postponements as a result of court officials, including presiding Judge Qondeni Radebe, having to deal with other work-related commitments.
The matter was on Tuesday postponed to Wednesday because the next witness to give evidence did not show up in court. It remained unclear when these hearings would be completed.

SAPS intensifies crackdown on gender-based violence with over 200 arrests in one week

Image: Supplied The South African Police Service (SAPS) has arrested more than 200 suspects for rape during operations across the country in a week to intensify efforts in the fight against gender-based violence and femicide (GBVF). Police spokesperson Lieutenant-Colonel Amanda van Wyk said over the past week, a total of 201 suspects were arrested for rape during operations across the country. 'Of these, 56 were wanted individuals tracked down in various provinces,' she said. According to Van Wyk, among the arrests was that of a man and woman in Bloubergstrand, Western Cape, for the alleged sexual abuse of their daughters, aged three and eight. 'Police seized multiple electronic devices during their arrest. They face several charges, including the production of child sexual abuse material ('child pornography'), rape, sexual assault, and sexual grooming,' she stated. Video Player is loading. Next Stay Close ✕ In another recent case, Van Wyk said a 24-year-old suspect was arrested by the Family Violence, Child Protection and Sexual Offences (FCS) Unit in Tonga, Mpumalanga, on June 19, 2025, following the gang-rape of a 27-year-old woman earlier this week. Investigations into this incident are ongoing, she added. Van Wyk also listed notable convictions this past week, including the sentencing of a 33-year-old serial rapist on June 9, 2025, by the Polokwane High Court. Lesley Morwamashobe Mohlala was sentenced to 222 years' imprisonment. 'He was found guilty on multiple counts of rape and aggravated robbery.' In another case, Van Wyk said the East London High Court sentenced a 42-year-old accused to life imprisonment for the rape of a 13-year-old girl, who became pregnant as a result of the assault. On June 18, 2025, she said the Waterval Regional Court sentenced a 25-year-old man from Tshiozwi, Limpopo, to life imprisonment for raping his nine-year-old cousin in 2021. Van Wyk said the SAPS remains committed to ensuring justice prevails for victims by 'removing sexual predators from our communities'. As part of a broader initiative, Nomgqibelo Mdlalose, Movement Navigator for the End GBVF 100-Day Challenges, stated that many teams within the movement are working closely with young people to address GBVF at a grassroots level. With over 200 challenges planned for 2025, the End GBVF 100-Day Challenges are accelerating action against GBVF within courts, municipalities, and higher education. 'Youth engagement isn't about campaigns or one-day events - it's a commitment to show up and respond. What's been powerful to see through the 100-Day Challenge teams is how they're showing up consistently in the spaces where young people spend most of their time, such as preschools, classrooms, and college campuses,' said Mdlalose. In the Drakenstein Municipality in the Western Cape, an ambitious effort is under way to train 500 Early Childhood Development (ECD) teachers as GBVF first responders. The movement said on Thursday that over the next 100 days, 15 preschools will become part of a network of care where teachers are trained to identify early signs of abuse and respond in trauma-sensitive ways. The importance of this work lies in its timing, it said, stating that these are the years when children first learn what safety feels like, when trust is built or broken. And because many survivors never disclose what happened to them as children, interventions at this stage could be life-altering. 'GBVF prevention starts with the relationships and environments that shape how young people understand harm and support avenues,' added Mdlalose. According to the movement, Taletso TVET College in Mafikeng, in partnership with the National Prosecuting Authority, is fostering accountability and legal literacy through workshops on the Sexual Offences and Domestic Violence Acts. These sessions aim to empower students to report abuse and understand their rights, addressing the normalisation of harmful behaviour on campus and the hundreds of GBVF-related misconduct cases reported in higher education. Limpopo's 100-Day Challenge teams have held Moot Court sessions for high schoolers, demonstrating sexual offence trials and minimum sentences for rape. The movement said this teaches young people that violence is wrong and shows them how justice is served, making the law tangible and fairness achievable.

Witness recants, undermining State's case against Bulelani Yosana in murder trial

Image: File Accused killer, Bulelani Yosana's bail appeal again failed in the Western Cape High Court this week, where he argued that the State's case against him has considerably weakened after a Section 204 witness recanted on their statement. Yosana is currently awaiting trial alongside accused hitman James Easton for the contract murder of Bloekombos teacher and ANC activist Vuyo Dana. A trial date is yet to be set for the matter. After a previous unsuccessful attempt, Yosana, a former police officer and ANC branch secretary, filed a new bail bid appeal with the High Court, citing the recanted statement, that a trial date remains unset, and that his bank account is about to be closed for non-compliance with the Financial Intelligence Centre Act. Dana was shot and killed at his home in February 2022 while on his way to work at Bloekombos Senior Secondary School, in Kraaifontein, in what has been alleged to be a politically motivated killing. Next Stay Close ✕ Yosana brought the second bail application on the basis that new facts have arisen since the initial bail court (Regional Court) refused to admit him on bail, pending the finalisation of his trial. Yosana and Easton face a variety of offences arising out of the murder which occurred on February 22, 2022. The offences include a contravention of Section 18 of the Riotous Assemblies Act, conspiracy to murder, and murder. Through his attorney, Yosana submitted that following the bail application, hearing, and the appeal, they discovered a statement in which the Section 204 witness recanted what he stated in his Section 204 affidavit. According to Yosana's lawyer, there are no eyewitness accounts that place Yosana on the scene, and he claims that due to the recanting statement, there is insufficient evidence. 'According to Mr Booth (Yosana's attorney), this recanting statement was never discovered by the State, and as such, it alters the overall picture of the State's case. 'In this (newly) discovered statement, the Section 204 witness is recanting what he initially told the police about the involvement of the applicant (Yosana) in the commission of the offences the applicant is arraigned on. Booth advanced the argument that the State case is based primarily on the evidence of the Section 204 witness. 'Booth's argument postulates that if the Section 204 witness has recanted his original police affidavit, wherein he originally implicated the applicant in the crimes, the necessary corollary is that the State's case has since been considerably weakened. According to the applicant, this discovery presents an insurmountable hurdle for the State,' the court record read. The State did not dispute that the Section 204 witness has since recanted his first key pre-trial statement. 'According to the State's heads of argument, the Section 204 witness filed a recanting statement after the residence of the witness was visited by the applicant and after the applicant's arrest. To this end, the State specifical contends that the recanting statement is a product of interference with a State witness,' the judgment further read. High Court judge Constance Nziweni, said: 'There is no doubt that the existence of a recanting statement presents considerable odds in the prosecution's case. Undoubtedly, the strength of the State's case is now called into question. It is appropriate at this stage to say something about the presumption of innocence. 'It should be observed that, according to the Constitution's principles, the bail court is deeply concerned with the right of a person who is presumed to be innocent, whose right to liberty is at stake. However, despite the right to be presumed innocent, there are instances where an accused person has to be detained pending the trial.' Judge Nziweni said that Yosana did not satisfy the court with reasons to be released on bail. 'In view of the foregoing, this court is of the firm opinion that in this matter, it cannot be said that there is no longer a 'just cause' behind the accused's detention. Though the prolonged detention of the applicant is regrettable, it cannot be said that the delay is unreasonable, as such, it amounts to a new fact that warrants his release,' said Judge Nziweni.
