Plea in High Court to declare shipwreck a State disaster; Bench orders notice

The Madurai Bench of the Madras High Court on Tuesday ordered notice to the Union and Tamil Nadu governments and sought a report on a public interest litigation petition that sought the removal of plastic pellets and other hazardous materials which washed ashore along the Kanniyakumari coast from the Liberian container ship MSC Elsa 3 that sank off the Kochi coast on May 25.
A Division Bench of Justices S.M. Subramaniam and A.D. Maria Clete sought the response of the authorities to the joint petition filed by four CPI (ML) Liberation functionaries — S.M. Anthony Muthu, R. Justin Sundar, R. Suseela, and C. Carmel Lourdhu Boi — of Kanniyakumari district.
The petitioners said the ship sank in the Arabian Sea with 643 containers, and so far 54 containers had washed ashore along the Kerala and Kanniyakumari coasts. The containers are said to have calcium carbonate and plastic pellets. However, there had been no official statement yet on the contents.
The plastic pellets that washed ashore along the Kanniyakumari coast were a dangerous pollutant and their breaking down into nano-plastics would enter the food chain of the marine species. Fish is a staple food in Kanniyakumari. The plastic pellets in the sea could cause a prolonged and irreversible damage to the food chain, they said.
The plastic pellets were getting deposited on the seashore and polluting the environment. The containers drifting in the sea posed a threat to the fisherfolk who were advised not to venture into the sea. Given the alarming situation, the Kerala government had declared the shipwreck a State disaster, and was providing relief to the fisherfolk, they said.
The plastic pellets and other hazardous materials should be removed from the sea on a war footing, the petitioners said. They also sought a direction to the authorities to disclose the contents of the containers, declare the shipwreck a State disaster, and provide relief to the affected fisherfolk.
The court posted the matter for hearing after two weeks.

According to the release, the second leg would see the Minister visiting Madagascar on June 26 to celebrate the 65th Anniversary of Madagascar's Independence and the creation of the Malagasy Armed Forces at Antananarivo. India and Kenya are maritime neighbours. Contemporary ties between the two countries are marked by high-level exchanges, robust trade and investment, medical-value travel from Kenya, and extensive people-to-people contacts. The two nations share a common legacy of struggle against colonialism. Many Indians participated in and supported the freedom struggle in Kenya. According to the official statement, India and Madagascar enjoy a multifaceted relationship rooted in historical ties, shared values, and a commitment to regional stability and development. The partnership spans political, military, economic, and diplomatic domains, underscoring a shared vision for mutual growth and collaboration. The visit to the two African nations comes following invitations from the Cabinet Secretary, Ministry of Defence, Kenya (Minister of Defence, Kenya), and the Minister of Armed Forces of Madagascar, as per the release. The shadow of insurgency deepened once again in Chhattisgarh's conflict-hit Bijapur district, as Maoist rebels executed two civilians, who had surrendered earlier. The two were murdered in a late-night assault on Saturday. Both the victims were recently surrendered Maoists. They had laid down arms only months ago in hopes of rebuilding a peaceful life. The attack occurred in Empur village under the Pamed police station area, where a group of armed Maoists abducted the men from their homes. "Their bruised and lifeless bodies were later found in the nearby area. The victims have been identified as Samaiya, a former Maoist who surrendered earlier this year, and Veko Deva, a resident of Empur village," Chandrakant Governa, Additional Superintendent of Police, Bijapur, told IANS. Both men were abducted from their homes in the Naxal-affected villages of Sendrabor and Empur by a group of armed Maoists, the officer said. According to local sources, they were brutally assaulted before being executed. Their bodies were later dumped in the village, triggering panic among residents. A group of armed Maoists stormed the residence of a surrendered cadre late Saturday evening. The victim, along with another villager, was forcibly taken away and later executed on suspicion of being a police informer, they said. "The bodies were discovered early Sunday, prompting the Bijapur police to dispatch a verification team to the site," the police officer said. This latest act of violence comes amid intensified anti-Maoist operations across the state. Security forces have recently launched coordinated offensives such as Operation Black Forest and Operation Kagar, resulting in the elimination of several high-ranking Maoist leaders, including CPI(Maoist) General Secretary Nambala Keshava Rao alias Basavaraju. This marks the fifth targeted killing in the district in just seven days, underscoring a dangerous escalation in retaliation tactics as Maoists react to intensified security operations in the region. These successes, however, appear to have provoked retaliatory attacks by the insurgents, who have increasingly targeted civilians and surrendered cadres. The killings also coincide with Union Home Minister Amit Shah's two-day visit to Chhattisgarh, during which he is expected to review the state's counterinsurgency strategy and meet with security personnel in Narayanpur. Police officials have reiterated their commitment to bringing the perpetrators to justice and ensuring the safety of civilians in conflict-affected zones. Investigations are ongoing, and additional security measures are being considered in vulnerable areas.
