Federal Court dismisses habeas corpus appeal by GISB Holdings CEO, wife

PUTRAJAYA: The Federal Court has dismissed the habeas corpus appeal filed by GISB Holdings Sdn Bhd (GISBH) CEO Nasiruddin Mohd Ali and his wife, Azura Md Yusof.
The two had filed an appeal challenging their detention under the Security Offences (Special Measures) Act 2012 (Sosma).
The three-judge panel chaired by Chief Justice Tun Tengku Maimun Tuan Mat, decided on Thursday (May 15) that the application by Nasiruddin, 66, and Azura, 58, lacked merit.
In the unanimous decision, she and Justices Datuk Abu Bakar Jais and Datuk Vazeer Alam Mydin Meera said the court rejected their appeal.
"This appeal lacks merit, the application is dismissed, and the decision of the High Court is upheld," she said.
Nasiruddin and Azura filed the habeas corpus application naming the Home Minister, the Inspector-General of Police, the Public Prosecutor, the Director of Selangor State and Kuala Lumpur Prisons, and the Government of Malaysia as respondents.
Previously, on Jan 14, the Johor Bahru High Court dismissed the couple's habeas corpus application.
Judge Datuk Abu Bakar Katar stated that when the Notice of Motion for the habeas corpus application was filed on Oct 24 last year, the applicants were not under Sosma detention.
He stated that the applicants were under a valid Detention Warrant issued by the Selayang Sessions Court.
For the record, the Shah Alam High Court granted eight female defendants, including Azura bail. All eight were charged with being members of a criminal group.
However, Nasiruddin and 12 other applicants on the same charge were not granted bail.
Last October, Nasiruddin, Azura, and 19 others were charged at the Selayang Sessions Court, but no pleas were recorded from all the accused after the charges were read out, as the case falls under the jurisdiction of the High Court.
According to the charges read separately, they were found to be members of an organised criminal group, Global Ikhwan Services and Business Holdings (GISBH), at a location on Jalan Desa, in Bandar Country Homes, Rawang, between October 2020 and 11 September 2024.
The charges were filed under Section 130V(1) of the Penal Code, which carries a minimum prison sentence of five years and a maximum of 20 years if convicted.

BUTTERWORTH: A man was arrested following a high-speed chase in the Bagan Dalam area here last night, after he allegedly attempted to flee from policemen and obstructed civil servants in the performance of their duties. The incident, which happened at about 10pm yesterday, came to light after a video of the chase went viral on social media. Seberang Prai Utara district police chief Assistant Commissioner Anuar Abd Rahman said policemen from the motorcycle patrol unit of the district police headquarters had ordered a suspicious locally manufactured vehicle to stop three times using beacon lights and sirens. He said the driver, however, ignored the instructions and sped off. "The suspect was eventually apprehended in front of the Ampang Jajar Flats in Butterworth. "A body search revealed a transparent plastic packet believed to contain syabu. "A subsequent urine test revealed the suspect tested positive for methamphetamine," he said in a statement tonight. The suspect has been remanded for four days until June 23 for investigation. The case is being investigated under Section 186 of the Penal Code for obstructing a public servant, as well as Sections 12(2) and 15(1)(a) of the Dangerous Drugs Act 1952. Anuar said a background check also revealed that the suspect had three prior drug-related offences. He urged the public not to sensationalise the incident, warning that it could disrupt public order and interfere with the ongoing investigation. KUALA LUMPUR: The Attorney-General's Chambers (A-GC) has refuted claims that the prosecution in the money laundering case involving funds from SRC International Sdn Bhd (SRC) was flawed. In a statement, the A-GC said it has consistently upheld the highest standards and quality in discharging its prosecutorial duties, in line with public expectations. "The A-GC remains committed to upholding the rule of law and will continue to carry out its responsibilities under the Federal Constitution with integrity, fairness and respect for judicial processes," the statement read. The statement followed the High Court's decision to grant a discharge not amounting to an acquittal (DNAA) to former prime minister Datuk Seri Najib Razak over three money laundering charges involving RM27 million linked to SRC. High Court Judge K. Muniandy issued the ruling today after the prosecution failed to furnish the defence with hundreds of documents related to the trial, despite the charges being filed as early as 2019. Addressing the delay in trial proceedings, the A-GC said the case, first registered at the High Court in February 2019, was postponed on five occasions due to various factors, including the Covid-19 pandemic, defence requests and applications by the prosecution itself. The A-GC said that proceedings for the 1Malaysia Development Bhd (1MDB) trial had commenced while the first SRC case was still ongoing at the High Court, Court of Appeal and Federal Court levels. This overlap led to delays in the second SRC trial, as both cases involved the use of key material documents required for the prosecution, it said. Following this, it said, there was no choice but to wait until the documents were made available. "Both cases involved the use of certain material documents that were also intended to be used in the second SRC trial. "As the documents in question are material to the second SRC trial, the prosecution had no choice but to wait until those documents became available, which is after the 1MDB trial proceedings have concluded. "It must be emphasised that the material documents are already available but are currently being used as evidence in the ongoing 1MDB trial," it said. The A-GC also said the prosecution had requested additional time to compile all the material documents to present them as evidence in the second SRC trial.
