Company, two directors charged with dumping hazardous waste in PD
SEREMBAN: A company and its two directors, including a former state Environment Department (DOE) deputy director, claimed trial at the Sessions Court here to a charge of illegally dumping hazardous wastes.
Nature Energy Products Sdn Bhd and its directors S. Sivanathiran, 62, who was former state DOE deputy director, and Chan Kwai Soon, 47, pleaded not guilty after the charge was read to them before Judge Mohamad Kamil Nizam.
Chan also represented the company.
They were charged with dumping the waste (code SW322) on Lot 11224, in Jimah, Port Dickson at around 4.30pm on Oct 14, 2024.
SW322 refers to "waste of non-halogenated organic solvents". This classification falls under the broader category of hazardous waste and requires specific handling and disposal procedures.
The company and both directors were charged under Section 34B(1)(a) of the Environmental Quality Act 1974 (EQA) which prohibits the placement, deposit, or disposal of scheduled waste without the approval of the Director-General of Environment.
Section 34B(1)(a) directly addresses the illegal disposal of scheduled wastes, which are hazardous materials designated by the government.
Offenders can be jailed up to five years and fined between RM100,000 and RM10mil upon conviction.
Deputy Public Prosecutor from the DOE Nurliyana R. Azmi then told the court the offence was non-bailable but left it to the court's discretion.
She said in the event the court allowed bail, her team proposed an amount of RM50,000 for each director.
She also asked the court to order the directors to surrender their passports and to not contact prosecution witnesses.
Lawyer Ramzani Idris, who represented the accused, then asked the court to impose bail adding that the directors have been cooperative in the department's probe.
Haresh Mahadevan, who assisted Ramzani, then got up to say that the directors should not be asked to surrender their passports as both were businessmen who travelled often.
Sivanathiran, he added, was a retired government servant and was not a flight risk.
He said if the court were to impose bail, an amount of RM5,000 was sufficient.
Judge Mohamad Kamil then set bail at RM9,000 each for the directors and fixed July 3 for mention.
He also ordered the duo to report to the nearest DOE office monthly until the case is disposed of and to stay away from prosecution witnesses.

KOTA KINABALU: Another Sabah politician has been summoned by the Malaysian Anti-Corruption Commission (MACC) to give a statement at the Sabah Federal Government Administrative Complex on Monday (June 23) morning. The alleged offences are believed to have occurred between 2023 and last year, involving the solicitation and receipt of bribes amounting to approximately RM200,000 in connection with the processing of mineral exploration licence applications. Both individuals have since been released on MACC bail and are expected to be charged at the end of the month.

GOF seizes Thai saplings, lorry worth RM400,000 over disease fears
RANTAU PANJANG: The General Operations Force (GOF) has seized 10,000 plant saplings and a lorry worth about RM400,000 over concerns the plants may carry harmful disease. GOF Southeast Brigade commander Datuk Nik Ros Azhan Nik Abd Hamid said a 34-year-old lorry driver was also arrested during the operation. A GOF team from the Ninth Battalion stopped the lorry near the Gual Tinggi health clinic around 11am, he said. "After checking the vehicle, they found 5,000 Barbados cherry saplings and 5,000 clove flower saplings inside it. "The GOF personnel believe the plants may be infested with harmful pests and disease. "They then detained the lorry driver and confiscated the plant saplings. The value of the seizure, including the lorry, is RM400,000," he added. Ros Azhan said initial investigations showed the saplings were headed to a local nursery. In a separate operation, the GOF seized various types of cosmetic products, estimated to be worth RM28,000, at an illegal jetty in Tumpat on Sunday. The suspected smugglers, however, fled to Thailand by boat upon realising the presence of the GOF team.

Seven arrested in Serdang police ops on burglars and snatch thieves
SERDANG: District police have solved a house break-in and a series of snatch thefts with the arrest of seven suspects in two separate cases. In the first case, two men with criminal records were detained over a burglary in Bandar Putra Permai here. Serdang OCPD Asst Comm Muhamad Farid Ahmad said the victim left his home at about 7am on June 7. "When he returned at 4pm the next day, he discovered his house had been broken into. "The house was in shambles and his car and valuables were missing," he told a press conference at Serdang district police headquarters on Monday (June 23). ACP Farid said the losses, including the car, two laptops, sunglasses and cash, came up to about RM42,000. "An investigation led to the arrest of two men, aged 38 and 44, in Klang on June 18. "We recovered the stolen items as well," he said, adding that the suspects had been remanded until today and police would apply for an extension. In the second case, ACP Farid said a snatch theft gang consisting of three men and two women, believed to be responsible for 39 cases in Selangor, was busted in an operation codenamed Ops Sentap Jay. "The suspects aged 20 to 30 were detained on June 19. "We believe they are responsible for cases in Serdang, Kajang and Subang Jaya," he said. Several items were seized, including a motorcycle, helmets, a laptop, a pawn shop receipt and jewellery, he added.
