KOTA KINABALU (June 20): A used clothes seller was acquitted and discharged by a Sessions Court here today from two counts of possessing cannabis and syabu. Judge Dayang Ellyn Narisa Abang Ahmad freed Mohd Jamri Basir, 24, after a full trial. The first count accused Mohd Jamri of possessing 158.6 grams of cannabis at an apartment at Jalan Tuaran Bypass on May 15, 2020. The charge was under Section 39A (2) of the Dangerous Drugs Act 1952, punishable under Section 6 of the same Act. The second count accused him of having 6.64 grams of syabu at the same place and on the same day. The alleged offence was under Section 12 (2), punishable under Section 39A (1), both of the same Act. The prosecution commended the case on December 7, 2022 and rested it on August 15, 2024. Ten witnesses were called by the prosecution while the defence called three witnesses, including Mohd Jamri. Mohd Jamri was represented by counsel Dominic Chew Ban Huat.

KOTA KINABALU (June 20): A foreigner, who claimed himself to be a traditional healer, was freed by a Sessions Court here from two charges of raping a university student. In her reserved ruling, judge Marlina Ibrahim acquitted and discharged Ronie Apolinario, 52, without calling for his defence. The court held that the prosecution had failed to establish a prima facie case against Ronie. On the first charge, Ronie was alleged to have raped the victim, who was 19 years old at the time, at a rented room in Inanam on June 17, 2021. On the second charge, he was accused of committing a similar offence on the same victim at a lodging at the City area on September 3, 2022. Both charges were brought under Section 376(1) of the Penal Code, which provides for a sentence of up to 20 years' imprisonment and whipping, upon conviction. The prosecution had called four witnesses to testify against Ronie since the trial began in October 2024 and concluded on December 9, 2024. Defence counsel Azhier Farhan Arisin represented Ronie.

High Court upholds senior cop's one-year jail sentence for graft

KUANTAN: The High Court here today upheld the jail sentence and fine imposed on a senior police officer convicted of accepting a RM5,000 bribe in connection with a drug case seven years ago. Judge Datuk Mohd Radzi Harun dismissed the appeal by Assistant Superintendent Hasbullah Ali Alias, 48, against the one-year jail term and RM25,000 fine meted out by the Sessions Court here on Dec 15, 2023. Hasbullah, who is attached to the Pahang Narcotics Crime Investigation Department, was charged with receiving a bribe from a man at a restaurant in Jalan Beserah here at 12.37pm on May 7, 2018. The prosecution was handled by Malaysian Anti-Corruption Commission (MACC) deputy public prosecutor Muhamad Asraf Mohamed Tahir, while the accused was represented by lawyer Ahmad Nur Faid Afiq Aziz. Ahmad Nur Faid applied for a stay of execution, pending Hasbullah's appeal at the Court of Appeal. Asraf told the court to impose a higher bail amount to ensure that Hasbullah attends court. Radzi granted the stay, offering bail at RM15,000 and ordered the accused to report to the nearest MACC office on the first Monday of every month. Hasbullah was told to surrender his passport until the case concludes. Hasbullah, who has been suspended from duty, has 14 days to file an appeal to a higher court.

Sessions Court Judge Marlina Ibrahim ruled that the prosecution failed to establish a prima facie case against Ronie Apolinario after assessing the evidence and submissions. Ronie had faced prosecution under Section 376(1) of the Penal Code, which carries up to 20 years in jail and whipping upon conviction. SEPANG: A man claimed his phone had fallen into the water while fishing after he was charged with 11 counts of posting offensive comments about the prime minister's daughter, Nurul Izzah Anwar. Ruslan Mat Ali, 48, pleaded not guilty before Sessions Court judge Ahmad Fuad Othman yesterday for the offences allegedly committed between January and February this year using the Facebook account "Ruslan Mat Ali". He was charged under Section 233(1)(a) of the Communications and Multimedia Act 1998, for using network services to transmit offensive content. The offence carries a maximum fine of RM50,000, a one-year jail term, or both upon conviction. For the first 10 charges, Ruslan, a father of three, was accused of posting offensive comments that were read at the Malaysian Communications and Multimedia Commission's (MCMC) Centre of Excellence in Cyberjaya on Feb 4 and Feb 26. The posts were allegedly made between Jan 2 and Feb 25. For the 11th charge, he allegedly posted an excessively offensive post on Feb 25. Ruslan pleaded not guilty before Judge Ahmad Fuad Othman. "I dropped my phone while I was fishing. I don't know where the comments came from. They just kept coming in," he told the court. Deputy public prosecutor Fadhli Ab Wahab requested bail to be set at RM15,000 with one surety, saying that the cases should be jointly tried due to the involvement of the same witnesses and evidence. Ruslan, who was unrepresented, appealed for a lower bail, saying he had no steady income, was divorced, and had three children to support. The court granted bail at RM10,000 with one surety and fixed July 18 for mention. All 11 charges will be tried together. It was understood that Ruslan was unable to post bail and will remain in custody until the next court date.
