
Delhi High Court to hear plea over sexual crimes against animals in July
The Delhi High Court would in July hear a plea to prosecute those involved in sexual crimes against animals.
A bench of Chief Justice Devendra Kumar Upadhyaya and Justice Tushar Rao Gedela on May 28 posted the matter on July 16 to enable the petitioner to bring more facts on record.
The Federation of Indian Animal Protection Organisations (FIAPO) in its PIL highlighted the "complete repeal" of Section 377 (unnatural sexual offences) of IPC under the newly-enacted Bhartiya Nyaya Sanhita (BNS).
While Section 377 of the IPC was rightly read down by the Supreme Court in the 2018 Navtej Singh Johar judgment to decriminalise consensual same-sex relationships, its complete deletion from BNS inadvertently decriminalised sexual violence against animals, leaving them unprotected by law, it argued.
The Parliamentary Standing Committee on Home Affairs, the plea said, in its report on BNS highlighted the removal of Section 377, proposing reinstating it to address non-consensual sexual offences against men, transpersons and animals.
The plea, filed through advocate Varnika Singh, sought the restoration of the provision that specifically criminalised sexual crimes against animals under the erstwhile Section 377 of IPC.
In April alone, the PIL referred to a couple of crimes being reported in the national capital.
While a man was arrested in Shahdara area for allegedly raping several dogs, a pet dog, which succumbed later, was found unconscious on a road in Saket and a condom was retrieved from its intimate parts.
The PIL also referred to an incident in Coimbatore, where a construction worker was found sexually abusing a dog.
FIAPO's CEO Bharati Ramachandran, in a statement, said, "Animals cannot defend themselves. They deserve justice and protection from sexual violence under law.'

2 get 20-yr jail for sexually exploiting minor girl
Kota: A POCSO court in Jhalawar Saturday sentenced a man and a woman to 20 years in jail for sexually exploiting a minor girl in Jhalawar's Kamkheda police station area four years ago in March 2021. The court also imposed a fine of Rs 20,000 on each accused. The accused have been identified as Hanif (49) and his partner Sonu alias Sugna (38), residents of Manhorethana police station area, public prosecutor Deepesh Bhargav told TOI. The minor survivor's father had filed a report with Jhalawar SP on March 17, 2021, alleging that Hanif and Sugna abducted his minor daughter on March 12 and Hanif sexually exploited her while Sugna assisted him. On the directions of the then SP, the police registered a case against Hanif and Sugna under sections of the IPC and POCSO Act in Kamkheda police station and began an investigation. However, the police gave the two accused a clean chit and submitted a Final Report (FR) to the court on Nov 23, 2022. The survivor, on the same day, filed a protest petition against the FR, following which the court ordered the resumption of the trial and statements of witnesses, Bhargav said. POCSO Court-2 found the two guilty and passed the sentence. The convicts have been in jail since their arrest following the trial's resumption in Nov 2022.

4 cabbies held for killing youth over love affair in Lucknow
Lucknow: Madiaon police and crime branch jointly arrested four men for murder of Krishna Gupta, 26, resident of Radha Gram Duda Colony in Thakurganj for his relationship with the sister of the prime accused. All four, arrested near Madiaon flyover on Jun 20, were taxi drivers. On Jun 19, his elder brother, Suraj Gupta, filed police complaint at Madiaon police station, stating that Krishna was murdered by Sanjay Yadav alias Monu, following an altercation over Krishna being in relationship with Sanjay's sister. FIR was registered under sections 103(1), 115(2), and 351(2) of Bharatiya Nyaya Sanhita. Police arrested Monu Yadav (29) resident of Radha Gram Duda Colony, Thakurganj, originally from Ramnagar, Barabanki, along with Wasiq Khan alias Raja (21), resident of Muslimnagar, Jankipuram, originally from Muzaffarpur, Sitapur; Mohammad Aamir (23), resident of Ramleela Maidan, Madiaon, originally from Gopalpur, Sitapur and Sharif (20), resident of Sector-2 Jhopadpatti, Jankipuram, originally from Tarapur, Meerut. SHO, Madiaon, Shivanand Mishra, said the accused confessed to the crime. "The accused invited Krishna to drink with them and murdered him with a heavy iron rod, a wrench (pana) and blades. His body was dumped near Ghailla Bridge. Police recovered the blood-stained iron rod and wrench used in the murder," said Mishra. The body was found on June 20 with fatal injuries on the neck, head and face. Following investigation, police added Section 3(5)/238 of the BNS to the charges. Officials ensured compliance with Supreme Court and Human Rights Commission guidelines during arrest. Accused were presented before court and verification of their criminal backgrounds is underway across other districts and police stations.

Operator & aide held for Rs5 lakh ATM theft in Noida
Noida: An ATM operator employed with a cash management company in the city and his accomplice have been arrested for allegedly stealing Rs 5 lakh from a cash van during an ATM refill operation. The theft came to light after CCTV footage from inside the van showed the custodian breaking the seal of a cash bag and pocketing the money. The accused Raghav Akash, worked with Hitachi Cash Refill, a company responsible for refilling ATMs across Noida. Akash and his associate were arrested by officers from Phase-1 police station on Tuesday. According to SHO Amit Maan of Phase-1 police station, the company, based in Sector 2, routinely sends out vans with cash to replenish ATMs. "Akash went out in a van carrying Rs 24 lakh to refill multiple ATMs across the city. But when he returned in the evening, a discrepancy of Rs 5 lakh was noted in the records," SHO Maan said. Company officials said that when Akash was questioned about the missing amount, he failed to provide a clear explanation. A case was registered against the duo under BNS Section 309 .
