‘Money grab': Why Wall Street donors are sweating the tax bill

Wall Street philanthropists — including some major supporters of the GOP — are about to get hit with a big tax bill if House Republicans get their way.
Large charitable foundations overseen by industry heavyweights like Blackstone Group's Steve Schwarzman and Citadel's Ken Griffin could soon see their tax rates double or even triple under the 'big, beautiful bill' that House leaders are pushing to the floor. Industry representatives and nonprofit groups say the looming tax hike on private foundations represents a threat to private philanthropic efforts that they say Republicans should be elevating, rather than punishing.
'The foundation world fills many gaps,' Kathy Wylde, the president and CEO for the Partnership for New York City, a nonprofit organization that represents the city's top business leaders. 'To discourage investment is counterproductive to the president's goals of getting some of these functions into the private sector and out of government.'
The plan to raise tax revenue from philanthropic organizations established by top financiers underscores the ascendance of Republican lawmakers who are wary of Wall Street's long-held influence over party leadership. While the overall bill is projected to benefit top earners, its targeting of private foundations — along with provisions that raise taxes on college endowments and establish new levies affecting nonprofits — reflects populist frustrations with tax-exempt entities that are perceived as having boosted progressive causes.
But zeroing in on those organizations — which include family-run nonprofits that are used to fund hospitals, religious organizations and charter schools — also risks frustrating the party's traditional allies within the industry.
Leon Cooperman, the billionaire investor and philanthropist, said the GOP's budget bill misses the mark, and that he expects the tax hit on private foundations to dent philanthropic efforts. Cooperman, a longtime Republican donor, established a tax-exempt family foundation in 1982 that has contributed hundreds of millions to charities, hospitals and educational institutions.
'The government continues its policy of tax and spend rather than focus on expense reduction. We don't have a revenue problem but rather an expense problem,' he said in an email, later adding that the tax hit on large private foundations 'won't effect [sic] me but I think [it will] adversely effect [sic] giving.'
The bill — written to deliver on President Donald Trump's tax, border and energy priorities — would charge private foundations higher excise taxes on investment income based on their size. Institutions with between $50 million and $250 million of assets would be charged 2.8 percent, those with more than $250 million would be charged 5 percent, and those with $5 billion or more would be charged 10 percent. The tax rate on smaller institutions' investment gains would remain unchanged at 1.4 percent.
The overall cost of the Republican legislation is likely to be enormous. Estimates from the Yale Budget Lab and Penn Wharton Budget Model project that the current framework would add $3.4 trillion to the debt over the next decade, and holding onto any new revenue sources has been a priority for Republican leaders looking to fend off a revolt from deficit hawks. The Joint Committee on Taxation estimates that the new foundation taxes would raise close to $16 billion over the next decade.
Members of both parties have been skeptical of the influence wielded by major private foundations and how they might be used or fund political efforts. Private philanthropies launched by the Clinton and Trump families have long been treated as political punching bags — Trump's foundation was eventually dissolved by New York authorities — and populist lawmakers have frequently made mincemeat of tax-exempt groups that they say improperly padded their coffers.
Still, the House GOP's push to raise billions through new taxes on foundations has chilled leaders of groups who helped steer the wealthy's philanthropic efforts into endeavors that are traditionally aligned with the right.
'They're looking at the elites versus the non-elites. There's a lot of money in foundations who would be defined as the elite, and therefore they like to see that money go elsewhere,' said Lawson Bader, the president and CEO of DonorsTrust, a donor-advised fund and 501(c)(3) that's a powerful force in Republican fundraising circles. This 'seems to be really nothing more than a money grab that is — I think — tinged with some political DNA that has me uncomfortable.'
Nevertheless, the private foundation tax is broadly expected to be included in the House bill upon passage. Two tax lobbyists, who were granted anonymity to discuss the negotiations around the bill, said they expect larger foundations to step up their outreach on Capitol Hill in the coming weeks to try to deter Senate Republicans from including the provision in their bill.
Washington advocacy organizations representing nonprofits, including the Philanthropy Roundtable and Council on Foundations, have been pushing back publicly on the new levies.
While the tax hike takes the biggest swing at large foundations — think major philanthropies like the Gates Foundation or George Soros' Open Society Foundations — nonprofit advocates are warning that smaller foundations may be forced to curtail grants or gift giving to prepare for a steeper tax bill.
'They see the ripple,' said Jenn Holcomb, the vice president of government affairs and legal resources at the Council on Foundations. 'They know this is going to have a broader impact beyond just private foundations.'
Ridgway White, the president and CEO of the Charles Stewart Mott Foundation, said his Flint, Michigan-based foundation may have to cut back support for local organizations if its investment income is taxed at much higher rates.
'The unfortunate thing is that the dollars being taxed aren't going to come back to communities like Flint,' said White, whose 99-year-old organization had roughly $3.7 billion of assets as of 2023. 'That would mean that there's less programs for after school, less money to support maintenance of parks — it's across the board — less money going into our cultural center, institutions, Catholic Charities, food bank, warming centers, food pantries. Across the board.'
'The Mott Foundation has, over time — if you account for inflation — granted $9 billion to our local community and communities across the world,' he added. 'I would argue that that benefit far exceeds any kind of tax benefit that was received by C.S. Mott in 1926.'

SENIOR MOMENT — Keep an eye on the internal election in the House Democratic Caucus next week — it will have far bigger stakes than it might seem. The race to be the top Democrat on the House Oversight and Government Reform Committee has important near-term political ramifications since the victor will serve as the foil to Chairman James Comer (R-Ky.) on a panel that has seemed as interested in investigating former President Joe Biden's age as current President Donald Trump. But there are also significant institutional implications. The contest will be a test of the future of the seniority system which has been a key feature of how Congress has governed itself for centuries. There are four Democratic contenders, two congressional veterans in their 70s and two congressional newcomers in their 40s. The old guard are 70-year-old Rep. Stephen Lynch (D-Mass.) was first elected to Congress in 2001 and 76-year-old Rep Kweisi Mfume (D-Md.) who has spent 15 years on Capitol Hill in two stints nearly 25 years apart. The upstarts are 47-year-old Rep. Robert Garcia (D-Calif.) and 44-year-old Rep. Jasmine Crockett (D-Texas), both of whom were first elected in 2023. The candidates will first try to make their case Monday to the House Democrats' Steering Committee, which will make a recommendation for the full caucus to ratify on Tuesday. At a time when, particularly among Democrats, there is a circular firing squad over issues surrounding age in the aftermath of Biden's presidency and failed reelection campaign, the idea of a system that benefits the old over the young, has drawn scorn in some quarters. After all, some progressives are still embittered over the fact that 74-year-old Rep. Gerry Connolly (D-Va.) beat out 35-year-old Rep. Alexandria Ocasio-Cortez (D-N.Y.) for this position at the end of the last Congress, shortly after Connolly was diagnosed with cancer. Connolly, who was first elected in 2008, had a positive prognosis at the time. However, within months the cancer proved untreatable and he stepped down as the top Democrat on the committee in March. The Virginia Democrat died in May. Seniority, the concept that the longest tenured member of a committee should be its chair, is not written in any formal congressional rules. It's as much a custom whose strength has ebbed and flowed. It only rigidly determined who became a committee chair for a little over half a century —- the period from the overthrow of the iron fisted Speaker Joe Cannon in 1911 to the post Watergate era in 1974, when rebellious House Democrats ousted three veteran committee chairmen, the youngest of whom was 73. Since then, the seniority system has held increasingly less sway on Capitol Hill. Republicans have imposed term limits for committee chairman whereas Democrats have proved increasingly willing to oust older chairmen who are viewed as enfeebled or simply inadequate. Yet the notion of seniority still has a certain persuasive power in internal debates. As former Rep. Emanuel Celler (D-N.Y.) argued in an essay 60 years ago (written when he had served a mere 38 years in the House and was in his sixth year as chair of the House Judiciary Committee) argued 'the seniority criterion for selecting committee chairmen has the added virtue of being objective. It automatically eliminates the intrigues, deals, and compromises that characterize election campaigns.' It does, though, inherently favor those members in safe seats who face little opposition in primaries or general elections. In the mid 20th century, this made seniority a bugaboo among those reformers in the Democratic Party who wanted to push progressive legislation, particularly on civil rights. After all, the Democrats most likely to be easily reelected year after year were conservative white southerners. Now though, in the third decade of the 21st century, those members of the caucus who most benefit from it are members of the Congressional Black Caucus, who are often in safe districts, many of which are protected from gerrymandering as well by the Voting Rights Act. The question is whether seniority's appeal will continue to dwindle on Capitol Hill next week in the vote. It wouldn't be the first time that Democrats have rejected the committee's most senior member to lead it —- Lynch has already been passed over twice and is considered likely to be rejected yet again. But, of the two top contenders, the difference between passing over Lynch for a veteran like Mfume or newcomers like Garcia and Crockett is significant. House Democrats have elected a number of less tenured members of their conference to top committee slots in recent years but going with Garcia or Crockett, who are only in their second terms in Congress, would set a new benchmark for doing it and further mark the transformation in how congressional power is accumulated and held. After all, for generations, the surest path to power on Capitol Hill was a slow and steady apprenticeship before finally wielding a gavel. More and more, that's not the case. Instead, as Congress has become an increasingly enervated legislative body, the value of playing 'the inside game' has diminished. Seniority's value was that it served as the most objective available proxy to determine legislative gravitas. It was never exact but it was better than the alternatives. No alternative has since emerged for the imperfect system of simply relying on length of tenure. In a social media age, legislative gravitas isn't the only thing that matters anymore — cable news hits and viral posts, both of which are valuable currencies today, can be measured far more precisely. ‘We can't wait forever': GOP frustrated but unwilling to act on Trump's TikTok extension

President Donald Trump's latest move to keep TikTok alive is yet again frustrating congressional Republicans, many of whom object to China's continued involvement in the popular app but just want to be done with the whole drama. 'Not my favorite thing,' Sen. Josh Hawley (R-Mo.), along-time proponent of the ban, deadpanned, when asked about the president's plan to issue another extension. He spoke a day before the White House confirmed Trump signed a 90-day suspension of enforcement of the law requiring TikTok to divest from ByteDance, its China-based parent company, throwing another lifeline to the short-form video app. By Friday, some House lawmakers registered a note of resigned irritation. The extension — Trump's third since the law went into effect on Jan. 19 — is a unilateral decision not envisioned in the bipartisan law passed by Congress and upheld last year by the Supreme Court. Rep. Darin LaHood (R-Ill.), a member of the House Intelligence and China committees, told POLITICO. 'The national security concerns and vulnerabilities are still there, and they have not gone away. I would argue they've almost become more enhanced in many ways.' But Trump's extension of the TikTok law largely boxed out Republicans in both chambers who have shown little inclination — beyond stern words — to prevent him from making these postponements almost routine. Many GOP lawmakers saw themselves as granting the president space to cut a promised deal while the White House deals with urgent priorities, like trade negotiations and the Israel-Iran conflict. 'In light of everything going on, I think he did the right thing,' Sen. John Kennedy (R-La.), a China hawk who voted for the ban, told POLITICO of Trump. 'I have concerns about all kinds of things — that [the extension] is on the list — but it's not at the top of the list.' Though Trump has promised his TikTok negotiations areclosely tied to trade talks with China, Treasury Secretary Scott Bessent testified last week to a Senate panel that TikTok's sale was not currently a part of the negotiations with China, raising a further potential obstacle to Trump inking a deal in the near future. Sen. Lindsey Graham (R-S.C.), a close ally of the president and longtime national-security hawk said earlier in the week: 'The sooner we get that issue solved, the better,' without offering any ideas for further enforcement. 'I just want finality,' Senate Judiciary Chair Chuck Grassley (R-Iowa) told POLITICO. 'I want some certainty and just know that the Congress isn't being played when we make a decision [that the app] be sold.' Another member of the House China Committee, Rep. Zach Nunn (R-Iowa), told POLITICO, 'No more extensions. It's time to follow through.' Rep. Dan Newhouse (R-Wash.), also a member of the China panel, noted in a post on X Thursday the law only allows one extension of the compliance deadline, adding, 'I was proud to support the ban of TikTok and believe the law should be implemented as written.' With their comments, the lawmakers echoed House China Chair John Moolenaar (R-Mich.), who in early June called for the U.S. to 'let [TikTok] go dark' to bring China to the table to negotiate. He reiterated that stance on Friday. 'Delays only embolden the Chinese Communist Party,' Moolenaar said in a statement to POLITICO. 'I urge the administration to enforce the law as written and protect the American people from this growing national security threat.' Still, observers say Republicans are not exercising their leverage to demand the White House enforce the law they helped write, for example by withholding funding or congressional oversight hearings. 'I keep reading that Republicans are 'frustrated' and 'impatient' about their TikTok law being ignored, but they should stop complaining to reporters and take it up with Trump,' said Adam Kovacevich, founder and CEO of the pro-tech Chamber of Progress. Among the Republicans being undercut by the president is his own secretary of state. Marco Rubio — who as senator was one of the loudest critics of TikTok's ties to China, and a huge backer of the app's ban — has been conspicuously silent as Trump has repeatedly granted more time to strike a deal for its sale. 'You have to decide what's more important, our national security and the threat that it poses to our national security,' Rubio told POLITICO in March 2023, as Congress was considering a ban. 'You have to weigh that against what you might think the electoral consequences of it are. For me, it's an easy balancing act. I mean, there is no balance. I'm always going to be for our national security.' A spokesperson for Rubio at the State Department did not respond to a request for comment. Democrats — even those who support keeping TikTok online — say Trump's approach is the wrong one. 'These endless extensions are not only illegal, but they also put TikTok's fate in the hands of risk-averse corporate shareholders,' Sen. Ed Markey (D-Mass.) told POLITICO in a statement. 'This is deeply unfair to TikTok's creators and users. I'm prepared to work towards a solution, but Trump isn't coming to the table.'

RALEIGH, N.C. (AP) — North Carolina Democratic Gov. Josh Stein vetoed his first bills on Friday, blocking for now Republican legislation that would let adults carry concealed handguns without a permit and make state agencies and local sheriffs more active in Trump administration's immigration crackdown. Stein, who took office in January, issued his formal objections to three measures backed by the GOP-controlled General Assembly presented to him last week. The former attorney general also had the option to sign any of them into law, or let them become law if he hadn't acted on the legislation soon. The vetoed measures now return to the legislature, where Republicans are one House seat shy of holding a veto-proof majority. Its leaders will decide whether to attempt overrides as early as next week. Voting so far followed party lines for one of the immigration measures, which in part would direct heads of several state law enforcement agencies, like the State Highway Patrol and State Bureau of Investigation, to cooperate with Immigration and Customs Enforcement. But one House Democrat ended up voting for the other immigration bill that Stein vetoed. It toughens a 2024 law that required sheriffs to help federal agents seeking criminal defendants. GOP prospects for enacting the permitless concealed gun measure, a longtime aspiration for gun-rights advocates, appear dimmer, because two House Republicans voted against the bill and 10 others were absent. Gun bill would let 18-year-olds carry concealed handgun In one veto message, Stein said the gun legislation, which would allow eligible people at least 18 years old to carry a concealed handgun, "makes North Carolinians less safe and undermines responsible gun ownership." Democratic lawmakers argued the same during legislative debate. Current law requires a concealed weapons holder to be at least 21 to obtain a permit. The person must submit an application to the local sheriff, pass a firearms safety training course and cannot 'suffer from a physical or mental infirmity that prevents the safe handling of a handgun" to obtain the permit. No safety training would be required if getting a permit is no longer necessary. 'Authorizing teenagers to carry a concealed weapon with no training whatsoever is dangerous,' Stein wrote. Gun-control groups praised the veto. Conservative advocates for the bill say removing the permit requirement would strengthen the safety of law-abiding citizens. 'Law-abiding North Carolinians shouldn't have to jump through hoops to effectively exercise their Second Amendment rights," Senate leader Phil Berger said in a press release criticizing the veto and planning for an override vote in his chamber. Permitless carry is already lawful in 29 states, according to the National Conference of State Legislatures. North Carolina would also be one of the last states in the Southeast to implement that legislation. Immigration bills focus on state agencies, sheriffs One vetoed immigration bill would require four state law enforcement agencies to officially participate in the 287(g) program, which trains officers to interrogate defendants and determine their immigration status. An executive order by President Donald Trump urged his administration to maximize the use of 287(g) agreements. Stein wrote Friday the bill takes officers away from existing state duties at a time when law enforcement is already stretched thin. The measure also would direct state agencies to ensure noncitizens don't access certain state-funded benefits. But Stein said that people without lawful immigration status already can't receive them. The other vetoed bill attempts to expand a 2024 law — enacted over then-Democratic Gov. Roy Cooper's veto — that directed jails to hold temporarily certain defendants whom ICE believe are in the country illegally, allowing time for immigration agents to pick them up. The vetoed bill would expand the list of crimes that a defendant is charged with that would require the jail administrator to attempt to determine the defendant's legal status. A jail also would have to tell ICE promptly that it is holding someone and essentially extends the time agents have to pick up the person. Stein said Friday while he supports sheriffs contacting federal immigration agents about defendants charged with dangerous crimes that they are holding, the law is unconstitutional because it directs sheriffs to keep defendants behind bars 48 hours beyond when they otherwise could be released for a suspected immigration violation. With the veto of this bill, House Speaker Destin Hall said, Stein sided with the 'most radical elements of his party's base over the safety and security of North Carolinians.' Latino advocates and other bill opponents had urged Stein to veto both immigration measures. They say the legislation would cause Hispanic residents to feel intimidated and fear law enforcement.
