NGT issues notice to Odisha chief secretary, three others in legacy waste case
CUTTACK: The National Green Tribunal (NGT) has issued show cause notice to the chief secretary, Odisha, secretary of the Housing and Urban Development department, Bargarh collector and executive officer of Bargarh municipality in connection with the alleged non-compliance of order regarding removal of legacy waste from Bargarh town for more than a decade.
NGT's east zone bench comprising Sudhir Agarwal (Judicial Member) and Dr Arun Kumar Verma (Expert Member) observed, 'In the circumstances, we find sufficient justification in this particular matter where action should be taken for prosecution of the authorities who have not complied with the Tribunal's order by initiation of prosecution under Section 26 of NGT Act, 2010.'
'However, before proceeding further in the matter, we find it appropriate to give a last opportunity to the concerned authorities hence we give opportunity to respondents to show cause as to why appropriate directions be not issued for initiation of prosecution against them for committing offence by non-complying and disobeying the directions of the Tribunal and thereby, attracting the provisions of Section 26 of NGT Act, 2010,' the bench stated.
Response by the said authorities shall be submitted within one month, the bench added, further posting the matter to July 28.
As per section 26 of the National Green Tribunal Act, non-compliance of direction of Tribunal is an offence for which punishment as prescribed includes imprisonment for a term which may extend to three years, or with fine which may extend to Rs 10,000 crore.
Ramakanta Rout and six other residents of Purushotam Nagar in ward no 15 under Bargarh Municipality area filed the petition seeking criminal proceedings against the authorities for non-compliance of orders the Tribunal had issued on March 23, 2023. Advocates Sankar Prasad Pani and Ashutosh Padhy represented the petitioners.

What Karnataka's new crowd control bill proposes
Facing flak over the handling of the Royal Challengers Bengaluru (RCB) victory celebrations, which resulted in the death of 11 cricket fans in a stampede outside Bengaluru's Chinnaswamy stadium on June 4, the Karnataka government has proposed a new legislation to manage crowds at events. The Karnataka Crowd Control (Managing Crowd at Events and Venues of Mass Gathering) Bill 2025 looks to 'effectively manage and control crowds at sponsored events and venues of mass gathering' such as political rallies, conferences and other events. It excludes 'jatra, rathotsava, pallakki utsava, teppada teru, urus, or any religious event pertaining to any religion, caste or creed'.Discussed in a cabinet meeting led by Chief Minister Siddaramaiah on June 19 and slated to come up for approval in the next cabinet meeting, the draft bill lays down guidelines on standard operating procedures for managing crowds, including protocols for dealing with emergencies as well as provisions for reserved seating, security systems, access control and advanced check-in solutions to prevent bottlenecks while ensuring smooth crowd flow. 'There shall be independent audits of every venue's capacity, entry/exit routes, emergency evacuation options and communication systems,' reads the draft. 'Venues that don't comply with safety standards should not be allowed to host high footfall events.' In case of emergency, the jurisdictional police station may postpone or cancel the event, or change its by event planners shall be punished with 'imprisonment for a term which may extend to three years or with fine up to Rs 5 lakh'. 'The event planner is responsible to pay the compensation to the person who is severely injured in such an event, mass gathering pertaining to political rally, jatra, conference etc, or compensation to the family member of the deceased. In case of the event planner not paying the compensation, the government may collect the amount as arrears of land revenue. The event planner's property can be auctioned by the government,' the bill outrage following the tragic loss of lives at the RCB victory celebrations had put the Siddaramaiah-led Congress on the backfoot, even as the Karnataka High Court registered a suo motu petition to hear the matter. The CM sacked his close aide and political advisor K. Govindaraju, while ordering the suspensions of five police officers, including the city police commissioner. A day after the incident, representatives of RCB and an event management company were placed under arrest. Karnataka minister HK Patil pulls up own government over illegal mining cases
Karnataka Law Minister HK Patil has written to Chief Minister Siddaramaiah urging him to punish those guilty of illegal mining in the state, alleging that the government has not been honest and committed to ensuring proper punishment for those guilty of "looting the state's wealth".In order to bring the culprits behind illegal mining to justice, Patil also suggested steps that the Siddaramaiah government should take, according to a seven-page letter to the Chief Minister, Patil claimed that only 7.6 per cent of all illegal mining cases have been investigated and that the government has not done enough to punish the culprits and recover the lost wealth. "Between 2007 and 2011, massive treachery took place in Karnataka in the form of illegal mining. Politicians and bureaucrats systematically looted the state's wealth. The government lost Rs 1.5 lakh crore. But in spite of such a large-scale loot, the government has not demonstrated honesty and commitment in ensuring commensurate punishment for the loot and recovery of the state's wealth," Patil said in the said that there is public outrage over illegal mining in the state and the administration's inability to address most of such cases."There is outrage among people about this. A special investigation team (SIT), which is looking into a few cases, has not made progress. These cases are getting buried in government files and administrative delays," he also suggested steps that can be taken to effectively address illegal mining and their investigation:Through the Criminal Law Amendment Ordinance of 1946, a Recovery Commissioner should be immediately appointed within the jurisdiction of the State Government to seize the property of criminals accused of recovery efforts. This Commissioner must be provided with the necessary support and strength. Steps must be taken with firm determination to make recovery to the number of illegal mining cases that have completed investigation and are now in the trial phase in court, there are at least ten times more cases that have not yet undergone investigation. Investigations into such cases are essential. Meghalaya murder case: Indore property dealer arrested for destroying evidence
The Indore Police on Sunday arrested a property dealer, identified as Shilom James, in the Meghalaya honeymoon murder case for tampering with allegedly disposed of a black bag belonging to the main murder accused, Sonam Raghuvanshi. The bag contained Rs 5 lakh in cash, her jewellery, a country-made pistol and her clothes -- all items were linked to the probe, the police told India Today the course of the investigation, one of the arrested accused -- Vishal alias Vicky Chauhan, a hitman allegedly hired by Sonam to kill her husband Raja Raghuvanshi -- revealed that he had booked an online auto from his Indore residence to Sonam's hideout in the same city with a black bag containing her clothes, jewellery, Rs 5 lakh in cash, and a pistol. Following the accused's statement, the Shillong Police reached Indore, the couple's hometown. However, after failing to locate the black bag, their counterparts in Indore managed to track down an auto driver who had delivered the bag to the Heerabag area, where Sonam was the police raided the flat in Heerabag. But, the bag was still checking nearby CCTV footage, the police identified Shilom carrying a black bag from the flat and putting it inside a car. The police, then, summoned him for he didn't respond to the summonses, the police tracked Shilom's phone and located him on the Indore-Devas road, where they arrested a local court on Saturday remanded Sonam Raghuvanshi and her alleged boyfriend Raj to a 13-day judicial custody in connection with Raja's police custody for the two prime accused -- Raja's wife Sonam, and Raj -- ended on Saturday, and the special investigation team probing the case did not seek an extension, officials from PTI
