Why Kansas Reflector filed a complaint about stonewalling by the Senate efficiency panel

The Kansas Open Records Act makes clear demands of state and local government.
This vital law requires timely release of public records within three business days of receiving a request. If officials can't fulfill that timeline, they're required to explain why, in detail.
The Kansas Senate Committee on Government Efficiency claims to be working for the good of all by ferreting out waste and bloat in state government. Perhaps it should start with itself, or at least with chairwoman Renee Erickson, R-Wichita. She led the effort to stonewall news media requests for public recommendations submitted to COGE through its online portal. Kansas Reflector requested the records from her on Feb. 25. They weren't released until April 9 — more than six weeks later.
By that time, our reporter Anna Kaminski had already examined a leaked copy of public feedback.
That batch of public comments suggested why Erickson pushed the public release until after the legislative session ended. Kansans blasted the committee with messages calling for Medicaid expansion, legalized cannabis and tolerance for LGBTQ+ youths. They show, in short, how anti-government narratives miss the mark in Kansas, where right-wing ideologues have poisoned the well of state government for years.
On Wednesday, Kansas Reflector editor in chief Sherman Smith submitted a complaint to the state Attorney General's Office about this delay. Erickson's committee did not respond to our request in a timely manner, and the broader public suffered because crucial information was hidden from them. COGE members could access the messages in mid-March, but their constituents could not. We believe that government officials should be held responsible for delay and obfuscation.
We heard attempts to justify the delays at a COGE meeting May 13. There were just so many messages. We had to screen them all. We didn't delete anything.
Gordon Self, a legislative staff member, opined: 'Once the KORA requests were received and a response was made, there was a review of the records, all 2,000, to determine if any of the records did contain information. After a thorough review, there were some identified that did have some sensitive information in them.'
Erickson harumphed: 'At the end of the day, there are none that have been deleted, there are none that are not available for review. But as was said, we wanted to make sure that we were not including information that was not appropriate for such a situation.'
Forgive me for rolling my eyes. These self-satisfied excuses don't add up.
None of the messages reviewed by Kansas Reflector staff appear to include sensitive information that the government had to shield from prying eyes. As noted earlier, a tranche of unredacted submissions was leaked to us in late March. We have compared the two versions. There's no there there.
In one message, for instance, Statehouse staff omitted a profane phrase. That didn't protect anyone's personal or private information.
In another case, the same suggestion was apparently submitted in two categories. The messages mention Senate President Ty Masterson's lucrative side hustle at Wichita Stare University, where he earns more than $150,000 a year as 'director of GoCreate, a Koch Collaborative.' In one of them, Masterson's name has been redacted, along with that of the author. In the other, neither Masterson nor the author has been redacted.
Only a few dozen of the thousand-plus messages saw any redactions at all.
Perhaps Statehouse staff don't have the slightest idea what they're doing. Perhaps they made a few random edits to the messages to justify the month-plus delay. Neither option should fill Kansans with confidence in their legislators or the work of COGE.
Finally, and perhaps most importantly, he COGE web portal includes the warning that 'Portal submissions are public records that are subject to the Kansas Open Records Act.' Those sending in feedback have to check a box next to that warning. Why even bother to do that if you're going to screen the material afterward?
Like other public records conflicts, this runs the risk of sounding petty. So what, I can hear some readers ask. You got the information anyway. Why fuss?
My answer remains the same as when I wrote about Emporia Stare University's unconscionable response in turning over information to Kansas Reflector. This information belongs to everyone. Lawmakers don't get to pass a law and then arbitrarily decide whether to follow it. If they expect town and county governments to follow KORA, if they expect other state agencies to follow KORA, they can damn well follow it themselves.
That's what justice and fair play demands. That's what their fellow Kansans deserve. And it's what we're going to do, no matter Erickson's sanctimonious claptrap.

Legislation that Republicans are trying to pass by the Fourth of July would end a slew of popular consumer tax breaks tied to clean energy, leading some experts to call on households to act now to collect the savings. Many tax breaks on the chopping block were created, extended or enhanced by the Inflation Reduction Act, a 2022 law signed by former President Joe Biden that provided a historic U.S. investment to fight climate change. The House passed its version of the One Big Beautiful Bill Act in May. Both bills would eliminate tax credits for households that buy or lease electric vehicles, or that make their homes more energy efficient. "The intention of Republicans writing the bill is to root out all of the incentives from moving away from fossil fuels that the Biden administration puts in place, and it's just a question of timeline," said Matt Gardner, senior fellow at the Institute on Taxation and Economic Policy. Republicans would use money from the clean energy tax breaks — as well as cuts to food assistance and healthcare programs like Medicaid — to help pay for a broader multitrillion-dollar package of tax cuts for households and businesses, among other policy priorities. The "One Big Beautiful Bill Act," which House Republicans passed in May, would end a tax credit of up to $7,500 for qualifying households that buy a new electric vehicle and a $4,000 credit for those who buy a used EV. It would also end a separate tax incentive that allowed car dealers to pass along a $7,500 credit to consumers who lease an electric vehicle. Additionally, the House bill would end the energy efficient home improvement credit (also known as the 25C credit) and residential clean energy credit (the 25D credit), which help consumers defray the cost of projects like installing insulation, solar panels, heat pumps, and installing energy-efficient windows and doors. With few exceptions, these tax breaks would disappear in 2026, about seven years earlier than under current law, which makes them available through 2032. Senate Republicans, who haven't yet passed their version of the legislation, would end these tax breaks under a similar timeline. For example, the tax credit for used EVs would end 90 days after the law's enactment. The credits for new and leased EVs, as well as the ones tied to energy efficiency, would disappear after 180 days. Advocates for preserving the tax credits argue that getting rid of the tax breaks would raise monthly bills for U.S. households and businesses. A group of 21 House GOP lawmakers in March expressed support for preserving clean energy tax credits, in a letter to Rep. Jason Smith, R-MO, chairman of the House Ways and Means tax-writing committee. "As our conference works to make energy prices more affordable, tax reforms that would raise energy costs for hard working Americans would be contrary to this goal," they wrote. Consumers who want to ensure they get a federal tax break for buying an EV or undergoing an energy-efficiency home project should act soon, according to experts. "Based on the existing proposed language, if you've been considering an EV or planning to get one, now is the time to do it," Alexia Melendez Martineau, senior policy manager at Plug In America, told CNBC recently. The legislation may change in the Senate, which may vote on the massive domestic policy measure as soon as next week. If there are changes, the House would have to pass the legislation before sending it to President Trump's desk.

Republican Sen. Lisa Murkowski says she has been "pretty clear" about her concerns over potential cuts President Trump's so-called "big, beautiful bill" would make to Medicaid and food benefits for her constituents in Alaska. In an interview for "CBS Sunday Morning," Murkowski told CBS News senior correspondent Norah O'Donnell that she hasn't given any absolute deal-breakers in the Senate legislation — but she's voiced her reservations about the Medicaid proposals. "I have not given anybody in the administration an absolute, this is my red line, right?" Because I think it's important that every step of the way, I communicate where my concerns are," Murkowski told O'Donnell in the interview airing this weekend. The reconciliation bill — or "one big, beautiful bill," as Mr. Trump and Republicans in Congress have dubbed it — has passed the House, but remains up for debate in the Senate, where some Republicans are pushing for deeper cuts to Medicaid than the House-passed version allows. Medicaid is the entitlement program that offers government-backed health care for both low-income Americans and those with disabilities, with the federal government and states splitting the costs. While the House version adds a new work requirement to Medicaid for childless adults, the Senate wants work requirements to expand to parents of older children. The Supplemental Nutrition Assistance Program, or SNAP, provides food benefits to the poorest Americans, and some Senate Republicans are hoping to place more requirements on states. "So I've been pretty clear that when it comes to Medicaid, those cuts that would harm Alaskan beneficiaries, that's not something that I can take home, right? We have some of the highest health care costs in the country. We have 40% of Alaska's kids that are on Medicaid. I want to try to do what we can to address certain aspects of our entitlement spending. We've got to do that. But doing it with the most vulnerable bearing the brunt of that is not the answer," she said. Senate Majority Leader John Thune, a Republican from North Dakota, wants the reconciliation bill to pass by the July 4 holiday, but that deadline is quickly approaching. 'It's heartbreaking,' she said in an interview Thursday in a break room at the University of Vermont Medical Center, where she currently works, tears filling her eyes. 'I'm relieved, too.' Cordes' reasons for leaving are complicated — and speak to the disparate challenges of living in Vermont and serving in government as an outspoken, progressive, LGBTQ+ woman in the era of Donald Trump. Well before the assassination of a Minnesota lawmaker last weekend during a shooting spree that killed or injured three others, Cordes had twice faced death threats related to her public service. She had taken to carrying a 9mm handgun, searching her apartment when she came home and scanning crowds in public places. Advertisement 'I do feel unsafe,' she said. 'I don't feel comfortable freely being myself … The tenor of tolerance in our culture now is so bad.' If politics contributed to her decision to move, financial considerations drove it. Rank-and-file legislators in the 150-member Vermont House make around $15,000, plus food and lodging stipends, for approximately four months of service each year. Lawmakers have complained for years that, to afford to serve, one has to be independently wealthy or retired. Advertisement Cordes, 66, is neither. As a per-diem nurse at UVM Medical Center, she has taken whatever shifts she can — and has even worked as a traveling nurse at a hospital in Maine. With Vermont's health care system in crisis, Cordes said, her employer has cut back nursing shifts, making it harder for her to make a living. As a member of the House Committee on Health Care, Cordes thinks she has a pretty good idea of what's coming down the line. She fears Trump's proposed cuts to Medicaid will further imperil hospitals like her own. 'Things are not going to get better — in our health care system or any other part of our culture, any part of our governance,' she said. Since leaving her marriage a few years ago, Cordes has struggled to find affordable housing in the rural Addison County district she represents in the House. She has crashed with one of her two adult daughters, stayed in dorm rooms in Montpelier and, for a few weeks last summer, lived in a tent at a state park. What does it say that a highly trained nurse and well-known public servant can't afford a roof over her head? 'I think our society is in entropic freefall and I don't know where the bottom is,' she said. 'I do have hope that it will turn around, but I believe it will get much worse before that happens.' Rep. Alyssa Black, a fellow Democrat who chairs the House Committee on Health Care, called Cordes' departure 'bittersweet.' She said she wants to be happy for her friend and colleague, but will miss her. Advertisement 'She's a legislator with a lot of courage, and we will feel her absence. Vermont will feel her absence,' Black said. 'I don't know who's going to fill her shoes.' A former president of the state's nursing union, Cordes has been a vocal supporter of legislation supporting workers' rights and reforming the health care system. She's sought to regulate pharmacy benefit management companies and protect health care providers who work in gender-affirming and reproductive care. 'I think it's her empathy that drives her,' Black said. 'She takes on the struggles and pain of others and wants to do something about it.' Like some others of her political persuasion, Cordes joked last year that, if Trump won a second term, she'd move to Canada. But she didn't really mean it at the time, she says. She always assumed she'd stick around and push back against the president's policies. 'I think sometimes that I shouldn't be leaving now — that I should stay and fight,' she said. 'And then I also know that I have been fighting my whole life. I'm exhausted. And I just want to give myself some grace.'
