Centre reviews HC order to resume MGNREGA in West Bengal from August 1

The Centre is looking at various options following the Kolkata High Court's (HC) order directing it to re-start the stalled Mahatma Gandhi National Rural Employment Guarantee Scheme (MGNREGS) in West Bengal from August 1, according to senior officials.
They said the order is being studied in detail to understand all the nuances after which a formal stand could be taken.
The Kolkata HC, in an order issued on Wednesday, directed the Centre to resume the MGNREGA scheme in the state that has been stalled since three years, but with some riders.
The Court, while asking the Centre to restart the scheme, also allowed it to impose any condition or restriction that it deems necessary so that corruption that occurred previously is not repeated.
The HC's order was passed following a Public Interest Litigation (PIL) that claimed the poor were being denied their legitimate entitlement under the Act, which guarantees 100 days of employment per year to rural households.
A division Bench comprising Chief Justice T S Sivagnanam and Justice Chaitali Chatterjee Das issued the order.
The Bench noted that neither the Centre nor the State had taken any action against those involved in the alleged corruption, which had delayed the scheme's implementation in West Bengal.
Both the ruling Trinamool Congress and Opposition BJP claimed victory, with Chief Minister Mamata Banerjee saying that the Centre wants to restart all the social welfare programmes stalled in the state since the last three years.
BJP also welcomed the order saying that the control of the scheme will now rest with the Centre, and there won't be any retrospective payments and genuine beneficiaries will be included in MGNREGS not ghost workers. It added that the order also meant that all recovered money from the mishandling of funds will go back to the consolidated fund of India.
The Left-affiliated All India Agricultural Workers Union said that the verdict is the result of the continued struggles of the agricultural workers of West Bengal and unity of the workers, peasants, and agricultural workers.
The union government had been withholding MGNREGS funds for West Bengal by imposing Section 27 of the Act that allows it to stop funds for violation of rules in implementation of the scheme by the State.
The section was first invoked in December 2021 alleging large-scale corruption and violation of guidelines.
In a parliament reply made in July 2022, the ministry of rural development had acknowledged that on account of non-compliance of its directives, as per provision of Section 27 of MGNREGA, the release of funds to the State of West Bengal has been stopped. At that time, the pending liabilities for MGNREGS wages was estimated at ₹2,605 crore.

Chandigarh: The Punjab and Haryana high court has ordered complete demarcation of the boundary of the forest and settlement of the rights of the people in the Morni Hills area by Dec 31. Thereafter the state shall issue notification under Section 20 of Indian Forest Act 1927 of the scheduled land as a reserved forest latest by Dec 31. "The FSO shall be handed over all the documents qua demarcation and survey which are presently in possession of the revenue authorities, forest authorities and Survey of India and the FSO shall be provided, forthwith, with all requisite facilities/infrastructure to enable him to discharge his duties contemplated in Chapter II of 1927 Act including making inquiry, entry, survey, demarcation, preparing map, acquiring land and exercising powers of a civil court, etc," the HC has clarified in its detailed order released on Friday. The court has also clarified that there will be complete ban on all non-forest activities in the Morni Hills area till the completion of the process. The secretary of the Haryana forest department has been asked to file a compliance affidavit, in terms of the directions made hereinabove, within seven months from, failure wherein may invite punitive consequences. Division bench comprising Chief Justice Sheel Nagu and Justice Sumeet Goel has passed these orders while disposing of a petition filed by a local activist Vijay Bansal. He had sought directions to conduct the settlement, in terms of Punjab Land Revenue Act 1887 and Punjab Settlement Manual, of Morni Hills area and incidental directions. Counsel for the petitioner, advocate Ravi Sharma submitted that the residents of Morni Hills area come within the definition of traditional forest dwellers for all intents and purposes, but no efforts have been made to treat them as such. The prime issue before the HC was as to whether the settlement of the Morni Hills area, including the process of demarcation, is required to be carried out entirely by the FSO alone, and expeditiously or not. Tired of too many ads? go ad free now The state government had raised the objection, that FSO has no jurisdiction to conduct demarcation & survey of the area proposed to be proclaimed as reserved forest, and the said power lies within the exclusive domain of the revenue authorities, it would be apt to deal with this objection. Rejecting the state's stand, the bench observed that once a special law i.e. Indian Forest Act 1927 is enacted covering the entire subject matter of Reserved Forest, the FSO assumes exclusive jurisdiction for performing all substantive and ancillary functions including demarcation and survey. "The entire exercise of survey and demarcation being done by Revenue Authorities is required to be handed over to the FSO already appointed, who shall henceforth conduct & conclude the survey, demarcation, preparation of maps and discharging all functions under Chapter II of 1927 Act," held the bench. Expressing shock over the delay on the part of the officers of the state government officials for delay in completing the process, the HC observed that such inaction on the part of such officers, particularly in a matter of such profound public importance, merits the unequivocal condemnation of this court. "The State, as the ultimate custodian and protector of its citizens' rights, is endowed with a solemn responsibility to act with dispatch and diligence, especially when confronted with issues of pressing environmental concern. The prolonged failure to finalize the process initiated by the December 18, 1987 notification, undermines the very spirit of the 1927 Act and betrays a shocking lack of urgency," the HC has observed. Lungs of Tricity "The Morni Hills are serving as the prime green cover acting as lungs for the Tricity of Chandigarh-Panchkula-Mohali. Indubitably, the authorities are required to take a decision, one way or the other, regarding completion of the process which begins with issuance of notification under Section 4(1) of the 1927 Act and culminates upon a notification issued under Section 20 of the 1927 Act," HC said. (HT Photo) The concerned departments were ordered to inspect commercial, industrial, and all other establishments which are legally mandated to have Sewage Treatment Plants (STPs) or Effluent Treatment Plants (ETPs) installed and operating. The inspections are meant to ensure that the plants have been properly installed and are fully functional, and that the establishments are complying with existing environmental norms. Legal action will be taken against any establishment which is found to be violating these norms, and penalties will be enforced under the Water (Prevention and Control of Pollution) Act, 1974. A centralised monitoring system will be created in the form of a real-time electronic dashboard, which will track inspections, violations, and corrective actions. The concerned departments have also been instructed to coordinate with each other to eliminate bureaucratic delays, and to submit bi-monthly compliance reports to the minister's office. 'This is a crisis that can no longer be ignored. Delhi cannot afford to let untreated sewage flow into its lifelines. No polluter will be spared. We will act, and act fast,' said Verma.

New Delhi: Delhi govt instructed the DPCC to enforce strict compliance with the mandatory installation and functioning of Sewage and Effluent Treatment Plants across all relevant premises. They are to conduct time-bound inspections to verify installation and operational efficiency, ensuring treated effluents meet prescribed standards. An E-Dashboard will also be developed for real-time monitoring, with bi-monthly reports submitted. "Why were Delhi's drains not cleaned properly year after year? Why was there no long-term planning for flood management? Why were crores allocated to agencies like DJB and I&FC, but the city still drowns after every rainfall? CM Rekha Gupta is actively working, reviewing projects, visiting sites and holding officials accountable," he said. Hitting back, AAP Delhi president Saurabh Bharadwaj said with MCD, Delhi govt, NDMC, and DDA all under BJP's control, it has no excuse to pass the buck. Every drain in Delhi falls under BJP-ruled agencies. "BJP is exposed as Delhi reels under waterlogging every time it rains. Rekha Gupta and LG must answer for apathy, corruption, and negligence," he said. Any desilting exercise which didn't happen on the ground in the last 2 years amounts to corruption, which LG refused to investigate despite it being flagged by then UD Minister, he said.
