
Private medical practitioners' proposal potentially violates Competition Act: MyCC
PETALING JAYA: The Malaysia Competition Commission (MyCC) has warned that proposals by private medical practitioner associations in several states to implement new service charges could potentially breach the Competition Act 2010.
This comes in response to reports that several associations representing private medical practitioners are looking to introduce new service charges including prescription and registration fees, regulatory compliance charges, and facility usage fees some of which may have already been implemented or are under review.
MyCC chairman Tan Sri Datuk Seri Idrus Harun said such practices are considered serious violations and are commonly referred to as cartel activities, which are illegal regardless of whether the pricing agreement has been implemented or merely agreed upon.
'These additional charges reportedly include prescription fees, registration fees, regulatory compliance charges, and facility usage fees, which may already be in effect or currently under consideration.
'MyCC stated firmly that any collective decision by associations representing general practitioners (GPs) or private doctors to introduce such charges could be in violation of the Competition Act 2010 (Act 712),' he said in a statement.
Idrus added under Section 4(2)(a) of the Act, private doctors and GPs are regarded as 'enterprises,' and any agreement between enterprises including decisions by associations to fix prices or trading terms may constitute anti-competitive conduct.
'If any association or organisation collectively agrees to introduce new charges, it may be interpreted as a price-fixing arrangement. Even non-binding pricing recommendations could be deemed price-fixing under Section 4 of the Act,' he said.
The Sarawak Private Medical Practitioners' Society (SPMPS), the Private Medical Practitioners' Association of Selangor and Kuala Lumpur (PMPASKL), and the Penang Medical Practitioners' Society (PMPS) have been specifically cautioned about the possibility of violating Competition Act.
MyCC urged SPMPS to withdraw its advisory encouraging members to implement these new charges.
PMPASKL and PMPS have also been advised not to hold any meetings or make decisions that could result in the uniform imposition of new charges, as this could be considered a breach of the law.
'Under the Competition Act 2010, any enterprise found guilty of violating the Act may face financial penalties of up to 10% of its global turnover during the period of infringement.
'MyCC will not hesitate to initiate investigations and take strict enforcement actions against any parties involved in anti-competitive conduct,' said Idris.
He further stressed MyCC is closely monitoring the situation and called on all stakeholders in the healthcare sector to fully comply with competition laws.
'MyCC reaffirms its commitment to promoting a competitive, healthy, and transparent marketplace for the benefit of consumers and the integrity of Malaysia's economy,' he added.

The two-day career carnival, which began today, was launched by Perlis State Secretary Datuk Rahimi Ismail. Meanwhile, Perkeso, in a statement, said that a total of 74,576 job seekers nationwide have successfully secured employment through placement programmes conducted in collaboration with various stakeholders. 'This achievement not only demonstrates the commitment of all involved in enhancing employment opportunities, but also offers new hope for job seekers to build a better future, through ongoing collaborative efforts,' it said. It also noted that between January and June 13, Perlis Perkeso organised 33 open interview programmes, resulting in 522 individuals successfully securing new employment. It added that a total of 14 individuals received Perkeso benefits, amounting to RM239,732.90, in conjunction with the carnival's opening ceremony today. The benefits were provided under the Employees' Social Security Act 1969 (Act 4) and the Self-Employed Social Security Act 2017 (Act 789), covering various categories, including temporary disability benefit, permanent disability benefit, Survivors' Pension, and Invalidity Pension.

SIS did not use ‘Islam' in company registration, says minister

KOTA KINABALU (June 21): A check has confirmed that women's rights group Sisters in Islam (SIS) did not use the word 'Islam' in its official company registration, said Domestic Trade and Cost of Living Minister Datuk Armizan Mohd Ali. Armizan said the organisation was registered in 1993 as a Company Limited by Guarantee (CLBG) under the name SIS Forum (Malaysia) in accordance with the Companies Act 2016. He explained that under the Act, the word 'Islam' is considered a controlled term. Any company wishing to use it must seek clearance from the Department of Islamic Development Malaysia (Jakim). 'From Domestic Trade and Cost of Living Ministry's jurisdiction, specifically through the Companies Commission of Malaysia (SSM), the registered name was SIS Forum (Malaysia) and did not include the word 'Islam'. Therefore, we did not refer the matter to Jakim,' he said at a press conference after launching the Sabah-level 2025 Digital Business Programme at Universiti Malaysia Sabah on Saturday. Armizan also disclosed that a total of 77,546 companies have been incorporated and 1,676 Limited Liability Partnerships (LLPs) registered across Sabah to date. He said the figures were based on Companies Commission of Malaysia (SSM) statistics as of May 31 this year. 'This total does not include companies registered under the state's own legal framework, namely the Trade Licencing Ordinance 1948. Of the overall total, 31,110 companies and 1,510 LLPs are currently active. 'In Kota Kinabalu alone, 39,525 companies have been incorporated and 1,118 LLPs registered during the same period, of which 15,331 companies and 1,003 LLPs are active,' he said. He said PPP25 is a new initiative by SSM aimed at supporting the business development agenda for B40 entrepreneurs and aspiring business owners through digitalisation. 'The main focus is to provide participants with exposure to the benefits and importance of digitalisation in expanding markets, enhancing productivity, and improving product quality. 'The use of digital technology such as media and e-commerce platforms not only increases operational efficiency but also opens up wider market access, both locally and internationally,' he added. The Sabah programme marks the first of three PPP25 series planned for this year, with the remaining two to be held in Penang and Terengganu. During the event, SSM also presented Corporate Zakat Wakalah (WZK) contributions worth RM107,518 and Corporate Social Responsibility (CSR) donations totaling RM45,000 to underprivileged recipients.
