Retired garda avoids jail for second time over harassment of woman
A retired detective garda who was facing jail time after he contacted a woman despite his conviction for harassing her has had his eight-month custodial sentence suspended on appeal. The District Court Appeals Court heard that Eamon Moran (51) has suffered ill health ever since he was attacked on a 2012 deportation flight and was recently in intensive care. Advertisement Moran, with an address in Perrystown, Dublin 12, harassed a woman by sending her unwanted texts and calls on dates between 2021 and 2023. He originally pleaded guilty before the District Court and was convicted of harassment under section 10.1 of the Non-Fatal Offences Against the Person Act, 1997, amended by the Harassment, Harmful Communications and Related Offences Act 2020. He was sentenced to eight months in custody, which was fully suspended for two years on the condition that Moran would make no contact with the injured party and her family, would continue his medical rehabilitation and would stay one kilometre away from the injured party's home. His jail sentence was reactivated by Judge David McHugh at Blanchardstown District Court in October 2024 after the court heard Moran had contacted the woman by email and phone after his conviction. Advertisement The victim reported the breaches to gardaí, saying that his actions caused her some anxiety and stress. The court heard that Moran had sent an email and then called the victim on two different days in September 2024, which went unanswered. It was found that Moran had breached the conditions of his suspended sentence and he did not contest this in the District Court. Counsel for the appellant, Niamh Ní Aonghusa BL, on Thursday told the District Court Appeals Court that Moran 'misinterpreted this non-relationship' and is "very much apologetic" to the victim. She said he has no intention whatsoever to contact the victim again. Advertisement Ms Ní Aonghusa said that Moran's health has been in decline since an incident in 2012 in which he was on a flight that was deporting people in his duty as a garda when he was attacked by a man with a razor blade. She presented several letters from medical professionals which said that Moran suffered a stroke, had a hole in his heart and had a liver condition. Judge Sinéad McMullan said that this is 'obviously a very serious matter' and that no one should have to deal with harassment. She said there was a clear court order that Moran 'clearly breached', but she also took into account that he was recently very unhealthy. Judge McMullan decided to fully suspend the sentence of eight months for a period of two years on the condition that Moran in no way attempt to contact the injured party ever again, stay one kilometre away from her house, continue to receive medical attention and attend Alcoholics Anonymous meetings.

Beccles man who stole £300k worth of books sentenced
A man who stole £300,000 worth of legal books has been handed a suspended prison Nunn, 42, admitted the theft from the firm LexisNexis, between March 2019 and September 2023. Nunn of Meadow Gardens, Beccles, Suffolk will have to carry out 200 hours of unpaid work as part of his sentence. Judge John Brook-Smith said Nunn had escaped an immediate sentence by the "slimmest of margins" because the "impact on your children would be significant". Summarising the case, the prosecutor said Nunn had been working at CPI William Clowes printers in Beccles since firm produced legal texts for LexisNexis, printing them and then sending them to buyers. The court heard that Nunn had worked night shifts and had access to where books were stored. It was said that Nunn had stolen books from the warehouse and sold them on Amazon, offering a discount on the usual price. The theft was discovered after a buyer contacted the firm asking how the Amazon listings were so cheap. A company listed as the seller on the site under UK Top Sellers was tracked to was suspended by CPI William Clowes and then resigned before he was arrested in October 2023. The prosecution said £205,000 was brought in from sales on Amazon, with the retail value of the goods sold of £329,000. Nunn's defence barrister Edward Renvoize argued that there was "nothing sophisticated" about his crimes and that his client had "low to average intelligence".The judge said Nunn had committed the crime whilst having gambling debts and accepted that he had shown some remorse and the case had been "hanging over his head".A further hearing will decide on what should be done with any proceeds of crime. Nunn owns the Wine Vaults Bar and Restaurant in Beccles, April the venue had its licence revoked by East Suffolk Council following the conviction. East Suffolk Council's licensing sub-committee said it decided to take the licence away as Nunn's conviction was "incompatible with the promotion of the licensing objective for the prevention of crime and disorder".Nunn is appealing that decision. Drink driver nearly four times over limit on M4 near Reading

It is 'laughable' that Fred Doe, the son of a multimillionaire caravan magnate, avoided a jail sentence for his involvement in the sale of a £4.8 million golden toilet stolen from Blenheim Palace, an art theft expert told the Mail's 'The Trial' podcast. Fred Doe, 37, was convicted following a trial in March of attempting to broker the sale of around 10 kilos of the stolen gold on behalf of burglar and family friend James Sheen, 40. Judge Ian Pringle KC sentenced Doe to 21 months in prison, suspended for two years, after accepting that he had strong personal mitigation due to his wife's poor health and the wellbeing of his children. Lawyer Christopher A. Marinello, one of the world's foremost experts in recovering stolen, looted, and missing works of art, said the awarding of a suspended sentence shows ' crime does pay in the UK.' 'It's laughable', Mr Marniello told crime reporters, Jack Hardy and Caroline Cheetham. 'It's not a deterrent. The bottom line is that this was a laughably light sentence. It shows that the judges, and the prosecutors, are disconnected from victims worldwide. 'The sentencing says we do not treat burglaries and art crimes as seriously as other crimes. That we do not realise the scars the victims get when they are robbed, when everything they have worked for is taken away from them. 'That says to criminals – come to London, crime does pay in the UK.' Doe became involved in the conspiracy when he heard Sheen - whom he knew through the traveller community - had snatched the toilet and offered to use his extensive contacts in Hatton Garden to sell the stolen gold. Crispin Aylett KC, defending Doe, told the court that he was a 'bit-part player who succeeded only in delaying James Sheen from converting his gold into cash'. Failing to sell the gold in London, Sheen took it Birmingham, later bragging in a text message to Doe hat he had made £520,000 from selling his share of the gold to an unidentified jeweller. Asked to speculate where the stolen gold could be now, Mr Marniello said: 'It could be anywhere'. 'It's the insurance company that's the victim here', Mr Marniello said. 'And guess what? The insurance company is going to raise its rates – and who's going to pay for that? You and me. 'When they raise their rates – their stocks go down – and their stocks are owned by our pension plans. We are the victims in all of this.' The 18-carat golden toilet was an artwork called 'America' and was plumbed in at Blenheim Palace for visitors to use at an exhibition in September 2019. But in the early hours of September 14 - just two days after the toilet went on display - a gang of five men came screeching into the grounds of Winston Churchill's birthplace in two stolen cars. Extraordinary CCTV captured the unfolding raid as three of the men smashed their way through a window with sledgehammers and crowbars and emerged just minutes later with the golden toilet.
