POCSO-accused tribal youth gets Madhya Pradesh HC reprieve

BHOPAL: The MP High Court has commuted the death penalty of a 20-year-old tribal man convicted of rape in Khandwa district, reducing his sentence to 25 years of imprisonment. In 2023, a trial court had found him guilty of raping and attempting to murder a 4-year-old girl. Hearing the petition challenging the April 2023 Khandwa district's Protection of Children from Sexual Offence (POCSO) Act court's order rendering the youth death sentence, a two-judge bench of Justices Vivek Agrawal and Devnarayan Mishra held that though raping a four-year-old innocent child and strangling her and throwing her in a deserted place is a cruel act, considering the family background of the youth, the death sentence is not appropriate. 'Hence, the sentence imposed upon the appellant for the offence punishable under Sections 363, 450, 307, 201 of the Indian Penal Code is affirmed, but his sentence for the offence punishable under Sections 6 of the POCSO Act is converted from capital punishment to the rigorous imprisonment of 25 years with the fine amount of Rs 10,000…' 'Sentence not apt' The court said though raping a girl is cruel, considering the family background of the youth, the death sentence is not appropriate. 25 year RI & Rs 10,000 fine His sentence has been converted from capital punishment to an RI of 25 years with a fine of Rs 10,000.

World Brain Tumour Day: Early Detection Saves Lives, say city doctors

Nagpur: Eminent neurologists from the city joined experts from across the globe on World Brain Tumour Day to raise awareness about the disease. At an event held at the Indian Medical Association (IMA) headquarters in Nagpur, specialists emphasised the importance of early diagnosis, discussed symptoms and treatment options, and highlighted the multifaceted challenges faced by patients and their families. Renowned neurologist and Padma Shri Dr Chandrashekhar Meshram stressed the need for timely detection and comprehensive care. He said awareness about the type of brain tumour and its symptoms is crucial. "If diagnosed in the early stages, proper treatment can save lives. Therefore, timely diagnosis and treatment are extremely important," he added. A brain tumour is an abnormal growth of cells within the brain, which may be benign (non-cancerous) or malignant (cancerous). These growths can either originate in the brain (primary brain tumours) or spread from other parts of the body (secondary or metastatic tumours). Prominent neurosurgeon Dr Vivek Agrawal reiterated the importance of awareness, stating that early detection and medical intervention can significantly improve outcomes. However, due to the complexity of the brain and its functions, brain tumours can be difficult to diagnose in the early stages. Common symptoms that require attention include persistent headaches, nausea or vomiting, seizures, vision or hearing problems, memory loss or confusion, and difficulty with balance and coordination. Dr Agrawal also explained that the purpose of Brain Tumour Day is to educate the public about the disease and its impact, to express solidarity with patients, survivors, and caregivers, and to promote and fund research for better treatments and potential cures. In India, the prevalence of brain tumours is estimated to be 8 to 10 cases per 1,00,000 population, with around 28,000 new cases reported annually. Neurologist Dr Ninad Shrikhande pointed out that the actual figure may be significantly higher due to underreporting, largely caused by a lack of awareness, limited healthcare accessibility, and financial constraints. Despite the challenges associated with a brain tumour diagnosis, experts conveyed a strong message of hope. Advancements in medical science, combined with increased awareness, are leading to better treatment outcomes and improved quality of life for many patients.

HC commutes death sentence in child murder case

Jabalpur: The MP high court has commuted the death sentence of a man convicted of abducting and murdering his six-year-old nephew, instead sentencing him to life imprisonment until his last breath. A division bench of Justice Vivek Agrawal and Justice Dev Narayan Mishra also nullified the life sentence of the co-accused woman in the case. On March 12, 2019, six-year-old Shivkant Prajapati from Rahikvara village in the Nagod police station area of Satna was kidnapped by his uncle, Anutav. Co-accused Vibha alias Vidya Prajapati called the child's family, demanding a ransom of Rs 2 lakh. The accused uncle strangled the child to death. Police filed a charge sheet against the accused in a Nagod court. The Nagod court considered the case as the rarest of the rare and sentenced the accused uncle to death. Additionally, the co-accused woman was sentenced to life imprisonment. The case was referred to the high court for confirmation of the death penalty. An appeal was also filed in the HC challenging the sentence. During the hearing, the bench found that the accused was only 21 years old at the time of the crime. Moreover, the crime was committed for money. The bench did not consider the incident to fall under the rarest of rare category and annulled the death sentence. Due to a lack of evidence, the bench also overturned the sentence of the co-accused woman.
