Every breach of contract not an an offence of cheating: Court
New Delhi: A Delhi sessions court, while hearing a revision petition against a magisterial court, observed that the magisterial court "did not independently apply its mind to the chargesheet and simply borrowed the opinion of the IO" and took cognisance of the chargesheet filed against a private limited company for the offences of cheating, criminal conspiracy and others. The court of Additional Sessions Judge Vishal Singh on June 4 said that according to the offences committed by the company, cognisance for offences of criminal breach of trust and criminal conspiracy could be taken. According to the prosecution, a Delhi-based real estate company in 2011 took money from various buyers and promised possession of flats in three years but failed to do so. Following this, buyers filed a case in 2019. A magisterial court on May 6, 2025, took cognisance of the offences under sections 420 (cheating), 409 (criminal breach of trust by public servant, or by banker, merchant or agent), and 120B (criminal conspiracy) against five accused, including two private companies. The accused filed a revision petition against this decision in the sessions court. For the purpose of constituting an offence of cheating, the complainant is required to show that the accused had fraudulent or dishonest intention at the time of making the promise or representation," the ASJ said. Even in a case where allegations are made regarding failure on the part of the accused to keep his promise, in the absence of a culpable intention at the time of making the initial promise, no offence under Section 420 IPC could be said to have been made out, the court held. The court said that in the present case, the delay was caused because of circumstances beyond the control of the accused, so the buyers could scarcely allege that they were cheated by the accused. "Things would have been different if the agreement between the parties pertained to an already developed residential colony with plots of specific size and serial numbers. Then there would be no contingency involved and the seller would be under strict obligation to sell the contracted plot to the buyer," the court said. The judge then ruled that as per the chargesheet, the accused diverted the money received from buyers/complainants and meant for plotting purposes to other accounts, misappropriating the money to their personal benefit in contravention of contractual obligations. "The accused have not accounted for the money entrusted to them by buyers for plotting purposes. On the basis of the chargesheet, there is sufficient reason to proceed against the accused for the offence under Section 406 (criminal breach of trust) IPC read with Section 120B IPC," the court concluded.

Interview Excerpts: How do you see the UAE evolving as a digital-first nation? The UAE boasts the best networks in the region and consistently ranks high in benchmarks. The nation is heavily investing in AI, data centers, and partnerships with hyperscalers. The leadership in the UAE is visionary and proactive in embracing digital transformation, which serves as a model for the wider region. Having lived in Singapore for 20 years, I see many parallels in how the UAE is creating a hyper-digital infrastructure across sectors like airlines, banking, retail, and tourism, making it an emerging economic powerhouse. Can you explain Nokia's journey and leadership in the autonomous network space? Autonomous networks as a concept are not new to us. We have long been managing the full lifecycle of services — from creation to delivery, deployment, fulfillment, and assurance. With the advent of 5G SA, cloudification, AI, and generative AI, the promise of autonomous networks is now being realised. Our portfolio and prior investments position us ahead of the curve. We're already delivering results — for instance, stc and Nokia were recognised at FutureNet MENA for developing Autonomous Network Operations that has large-scale automation and intelligent operations. Other global operators like Bharti in India are also on this journey with us, leveraging our technology across various stages of TM Forum's Autonomous Networks framework. Can you elaborate on Nokia's cloud strategy and how deploying software across any cloud is enabling telcos and enterprises? Our core strategy is to focus on applications, not cloud infrastructure. We've consciously moved away from building our cloud stack and instead partner with players like Red Hat, AWS, Microsoft, and Google. Our applications are designed to run on any cloud — public, private, or hybrid. For example, in Telefónica Germany, our packet core runs on AWS, with signaling and policy on Google Cloud. Similarly, Dish Networks in the US leverage our solutions on AWS and Rogers in Canada are conducting trials. 'The flexibility of multi-cloud deployment is critical as the industry moves from virtualisation to true cloud-native models using Kubernetes and advanced automation.' What are the key cybersecurity focus areas for AI-driven, cloud-native networks? We've been in the security space for a long time, particularly in securing critical telecom infrastructure. One key area is identity and privileged access management for cloud infrastructure. Additionally, we focus on endpoint detection, network security, extended detection and response (XDR), certificate lifecycle management, and compliance. As cloudification and AI adoption grow, the attack surface expands. Our goal is to help customers build networks that are secure by design — not as an afterthought — through collaboration with ecosystem partners, customers, and system integrators. How is Nokia supporting digital transformation in emerging markets? Industries such as manufacturing, mining, transportation, and logistics often operate on legacy infrastructure. We address this through: · Campus Networks: For secure and reliable on-prem connectivity. · Wide-Area Networks: For sectors like public safety, railways, defense, and utilities that require broader, mission-critical connectivity. We're driving 5G adoption aggressively in these sectors. In the region, for example, we're working with the likes of e& and du in the UAE as well as with stc in Saudi Arabia to build private networks and even mission-critical networks for public enterprises. Security remains a core pillar — we emphasise building networks that are secure by design. How is data analytics shaping strategic decisions within Nokia's Cloud and Network Services? Telcos possess vast amounts of data, but historically, they haven't fully leveraged it. OTT players have monetised it more effectively. We are now helping telcos harmonise data across the network to create actionable insights. This is critical for training large language models (LLMs) and driving use cases like churn reduction, anomaly detection, customer experience optimisation, and marketing. Our focus is on creating 'data products' that make telco data ready for AI consumption, which in turn supports the vision of autonomous networks, because without intelligence and insights, automation isn't possible.

J&K: SPO held with heroin in Udhampur
JAMMU: Police arrested a special police officer (SPO) with over 5g heroin in Jammu and Kashmir's Udhampur district Wednesday. 'A patrolling team intercepted a suspicious person trying to escape. On frisking, police found 5.6g of heroin in his possession. The accused has been identified as Vishal Singh, from Udhampur's Shakti Nagar, posted as an SPO in the same district,' police spokesperson said. In another case, police arrested a Chhattisgarh-based drug peddler and seized 2.4kg ganja from his possession in Kathua district's Ramkot area.

J-K: Special Police Officer arrested for drug peddling in Udhampur, heroin recovered
Udhampur (Jammu and Kashmir) [India], June 4 (ANI): Jammu and Kashmir Police has arrested a Special Police Officer (SPO) posted at District Police Lines (DPL) Udhampur for drug peddling after heroin-like substance was recovered from his possession during a police checking operation, said officials. SPO was arrested from the Phangyal area of Udhampur town on Wednesday. According to an official release, a team from Police Station Udhampur led by the Station House Officer (SHO) was on patrolling and checking duty near Phangyal when they intercepted a suspicious person. On noticing the police party, the individual attempted to flee but was apprehended promptly. Upon frisking, the person was identified as Vishal Singh, an SPO posted at DPL Udhampur and a resident of Shakti Nagar, Udhampur. Police recovered 5.64 grams of heroin-like contraband substance from his possession. A case has been registered under various sections of the Narcotic Drugs and Psychotropic Substances (NDPS) Act at Police Station Udhampur. Further investigation into the matter is underway. Earlier on June 2, in a decisive action against subversive and criminal elements inimical to the security and integrity of the nation, Srinagar Police have booked five terror associates of proscribed terror outfits involved in subversive activities under the Public Safety Act (PSA). According to officials, the arrested individuals have been identified as Nayeem Ahmad Khan, resident of Gamandar Panthachowk in Srinagar, Faizan Akhter Bhat alias Faizan, resident of Gousia Colony, Mehraj Ud Din Bhat, resident of Pandach in 90 FT Road, Umar Hamid Sheikh, resident of Assar Colony in Hazratbal Srinagar, and Suhaib Shafi Baba alias Chamna, resident of Diwat Walipora, Rainawari Srinagar. These accused persons have been booked after obtaining formal detention orders based on dossiers prepared against them by the Srinagar Police. Consequently, they have been detained and subsequently lodged in the district jails of Kathua, Udhampur, and Kot Balwal in Jammu. It is pertinent to mention that many criminal cases have been registered against these individuals. Despite this, they did not mend their ways. After getting bailed out from the courts, they were brazenly involved in criminal and subversive activities prejudicial to the interests of the Nation. Pertinently, J-K Police has been systemically targeting and dismantling such anti-national infrastructure in Srinagar city, with a relentless crackdown on such elements. (ANI)

Suakati panchayat of Keonjhar wins e-governance award
Keonjhar: Suakati gram panchayat in Keonjhar district has won the 'jury award' in the National Awards for e-Governance (NAeG)-2025, for effectively using technology to enhance public service delivery. Suakati GP, Palsana GP in Gujarat and Lalitpur municipal council in Uttar Pradesh are the three local bodies in the country to be honoured in the newly introduced category. "The recognition reaffirms our belief that effective governance, when backed by innovation and dedication, can truly uplift rural communities," said Keonjhar district magistrate Vishal Singh. He said that Suakati's achievement would serve as motivation for other panchayats to adopt digital tools and practices. The awards will be presented during the 28th National Conference on e-Governance to be held in Visakhapatnam on June 9 and 10. The ministry of personnel, public grievances and pensions announced 10 gold and 6 silver awards across six categories. Among the gold awardees are the IMD for its 'Multi-Hazard Early Warning Decision Support System' and the ministry of civil aviation for its Digi Yatra initiative. Gold winners will receive a trophy, certificate, and Rs 10 lakh to support further digital projects, while silver awardees will be awarded Rs 5 lakh.
