Two years ago United Auto Workers members elected Shawn Fain to lead their union out of a decade of corruption. Now the high hopes that swept Mr. Fain into the president's office are crashing down. In a report this week, the union's court-appointed federal monitor says Mr. Fain retaliated against a fellow elected official, Margaret Mock, the union's secretary-treasurer.

United Auto Workers President Shawn Fain retaliated against one of his own top lieutenants, according to a report by a court-appointed monitor assigned to watch the union's governance after years of corruption. Fain, a bombastic leader who railed against how automakers treated their workers during a 2023 strike, wrongly stripped duties from the union's Treasury-Secretary Margaret Mock after she refused to approve certain expenses, according to the latest report by the monitor, Neil Barofsky, an attorney with Jenner & Block.

Auto workers union president retaliated against top officer, monitor says
The federal monitor overseeing the United Auto Workers union determined that UAW President Shawn Fain retaliated against Secretary-Treasurer Margaret Mock by reassigning some of her duties last year, according to a report released on Tuesday. The monitor, New York attorney Neil Barofsky , opened the investigation in February 2024 to review allegations around the two officers' actions, including that Mock said she had faced retaliation for her refusal or reluctance to authorize certain expenditures for Fain's office. "Fain acted on a premeditated plan to take action against Mock," the report stated, adding that the union president retaliated against her because she refused "to grant exceptions to the strict policy restrictions governing the expenditure of Union resources." The UAW did not immediately respond to a request for comment. Mock also did not immediately respond to a request for a comment. In the report, the monitor called for the union's executive board to reinstate the various responsibilities stripped from Mock, which included purchasing, benefits and pensions. The secretary-treasurer was also previously accused of obstructing union operations and seeking to influence board votes, claims the monitor said were unfounded. Barofsky's latest report is damaging to Fain, a symbol of union power resurgence across the country during a 2023 strike against the Detroit Three automakers , Ford Motor, General Motors and Stellantis, maker of Ram trucks and Jeeps. The monitor was appointed in 2021 following a years-long corruption scandal that resulted in the federal convictions of several former leaders. He has since regularly released reports on his team's investigations into the union's practices. Tuesday's report is the twelfth from the monitor's office.

Monitor: Fain 'improperly stripped' responsibilities from Margaret Mock
The court-appointed monitor overseeing the United Auto Workers in a blistering status report has directed the union to reinstate all duties to Margaret Mock, the treasurer-secretary, after she was stripped of her duties more than a year ago. Neil Barofsky, a lawyer appointed by the court in 2021 to oversee the union as it emerged from a public corruption scandal, published the report on Tuesday, June 17. In the report, the monitor writes that the stripping of Mock's duties was uncalled for and based on "unsupported or outright unfounded" allegations from UAW President Shawn Fain of misconduct. "The Monitor concludes that Mock was falsely accused of misconduct, subjected to retaliatory action by Fain, and improperly stripped of her responsibility for various departments and board assignments," the report reads. It continues: "The Monitor's investigation found that Mock consistently and strictly applied Union policy, guided by a commitment to accountability in the wake of the UAW's past financial scandals. Her removal was not the result of dereliction of duty or dishonesty, but rather a consequence of her refusal to grant exceptions to the strict policy restrictions governing the. expenditure of Union resources, including to those within Fain's inner circle." When her duties were stripped, the monitor, whose duty it is to root out corruption in the union, opened an investigation. Mock's return to her previous job vindicates her in the eyes of some UAW members who leveled that Fain's treatment of her was unconstitutional and unfair.
