Sabah MTUC urges immediate re-election and council meeting to restore leadership
KOTA KINABALU (June 7): The Malaysian Trades Union Congress (MTUC) Sabah has called for an expedited re-election process to appoint new officers and restore effective leadership within the organization. Its chairman, Mohd Airy Arin, emphasized the urgent need for a general council meeting to ratify the election process, enabling MTUC to resume its vital role in representing Malaysian workers. MTUC is currently overseen by a special joint committee (JBK), appointed by the High Court on February 21, with a specific mandate to conduct leadership re-elections within 90 days — originally ending on May 22 and later extended until August. Mohd Airy noted that the JBK had issued a statement protesting the government's refusal to recognize MTUC delegates for participation in the International Labour Organization Conference (ILC) in Geneva, Switzerland. He recalled that the High Court's consent order on February 21 required the JBK to hold a Special Delegates Conference (SDC) to elect new leadership. However, the JBK has so far failed to meet this requirement. 'To date, there are still no officers capable of fulfilling the duties of MTUC,' he said in a statement. Highlighting the significance of the ILC as a tripartite platform involving governments, employers and workers, Mohd Airy stressed that the JBK lacks the mandate to nominate representatives on behalf of MTUC. 'Therefore, MTUC Sabah is urging the JBK to concentrate solely on conducting the re-election process and to convene a general council meeting immediately to formalize and ratify the process,' he added.

Solomon explains that the JSC was established through a Consent Order of the Court of Appeal, which authorised it to conduct the SDC and oversee MTUC affairs within a set timeframe. – Photo via Facebook KUCHING (June 5): Recent claims suggesting that the Joint Special Committee (JSC) lacks the authority to manage the Malaysian Trades Union Congress (MTUC) are misleading and contradict the Court of Appeal's explicit mandate, said JSC chairman J Solomon. He explained that the JSC was established through a Consent Order of the Court of Appeal, which authorised it to conduct the Special Delegates Conference (SDC) and oversee MTUC affairs within a set timeframe. 'The JSC has already fixed the date for the SDC and issued circulars to affiliated unions,' Solomon said in a statement today. He added that the Ministry of Human Resources (MoHR) had acknowledged the JSC's role by officially inviting its members to attend the Labour Day celebrations organised by the government, further recognising the JSC's legitimacy and responsibility in managing MTUC's affairs. Solomon also criticised MoHR for refusing to submit the JSC-nominated names of Workers' Representatives to the International Labour Conference (ILC), calling the action 'a deliberate act of mischief'. He stressed that the Court Order had resolved the internal crisis within MTUC and clearly mandated the JSC to manage its administration. Solomon further alleged that MoHR withheld the workers' representative list from the ILC to avoid scrutiny over the Minister's actions, which he claimed were contrary to Convention 98 regarding interference in collective bargaining process and alleged collusion with employers. 'For the first time since becoming a member of the International Labour Organisation (ILO) in 1957, Malaysian workers were not represented at the ILO conference,' he said. He claimed the MoHR's refusal to submit the names was an attempt to prevent discussion about the Minister's conduct at the ILC. 'It is this agenda of MoHR which resulted in the workers of Malaysia not being represented at the ILC,' he added. Solomon advised individuals and parties against making statements in blind support of the MoHR Minister as such remarks could mislead workers and stakeholders and potentially lead to contempt of court. MTUC Sarawak has since urged the JSC to resolve the leadership impasse and refrain from issuing statements that could create confusion. MTUC gears up for special delegates conference in August
PETALING JAYA: The Malaysian Trades Union Congress (MTUC) is set to host its Special Delegates Conference (SDC) on August 2 and 3 in Shah Alam. Currently, the MTUC's operations are overseen by a Joint Special Committee (JSC). This committee was established through a Court Consent Order, resolving a dispute that had nullified the previously elected office bearers. The JSC's mandate includes managing the MTUC's administration and organizing the upcoming SDC. JSC chairman, J. Solomon, announced that all affiliated unions have been asked to submit their delegate lists, proposed motions, and nominations for principal officials by June 12, 2025. Notices have been dispatched via mail and are also being publicized through the press to ensure broad and timely distribution. Solomon urged all stakeholders to support the JSC as it fulfills its responsibilities leading up to the August 3 conference. Affiliates needing assistance during this period are encouraged to contact JSC members, MTUC staff, or industrial relations practitioners.
