Punjab and Haryana HC disposes of Chandigarh slum dwellers' resettlement plea

The Punjab and Haryana High Court has disposed of a petition filed by Sanjay Patel and others seeking resettlement after being removed from land owned by the Chandigarh Administration. The case, which has been in court for over a decade, is the latest in a long legal tussle between the petitioners and the authorities. The High Court bench of Justice Anil Kshetarpal and Justice Aman Chaudhary passed the order on June 19. The petitioners had approached the court after their earlier attempt to enforce a 2016 court decision in their favour was rejected last year. The dispute began in 2012, when the petitioners — slum residents — had gone to a civil court, challenging their removal from the land. In 2016, the court partly ruled in their favour, saying two things: first, they could only be evicted through legal means, and secondly, the government should consider their claim for resettlement under welfare policies for slum dwellers. However, when the petitioners tried to act on this 2016 ruling by filing another case in 2019 to make the administration carry it out, the court rejected it in 2023. The judge in that case said the earlier order (called a decree) was limited in what it allowed, and the court couldn't go beyond what had already been stated. In its June 19 judgment, the High Court agreed with that view. It noted that the land belongs to the Chandigarh Administration and that the petitioners' claims had already been looked into and turned down. The court said the earlier judgment had run its course and could not be stretched to give the petitioners further relief. The petitioners had likely hoped the court would rely on a landmark 1985 Supreme Court judgment (Olga Tellis vs. Bombay Municipal Corporation), which held that eviction of slum dwellers without resettlement violated their right to life. But the High Court said that case didn't help in this situation because the Chandigarh Administration had already examined and rejected the petitioners' claims based on city development plans under the Chandigarh Master Plan. While disposing of the case, the court said the petitioners were still free to challenge the latest order passed by the Chandigarh Administration on June 18, 2025, if they wish to pursue the matter further. The case was argued by advocates Anil Mehta and Sukriti Kaur for the petitioners. The Chandigarh Administration was represented by senior standing counsel Amit Jhanji, along with Sumeet Jain and Himanshu Arora.

1 2 3 Nagpur: After emerging as a hub for making ammunition for big guns, Vidarbha may soon have a factory making bullets for small weapons like rifles and pistols. TEMBO Defence, a subsidiary of TEMBO Global, which has interests in textiles, engineering products, and solar power, has been allotted a comfort letter by Maharashtra Industries Development Corporation to allot 100 acres of land in Amravati. The project would entail an investment of Rs1,000 crore for which it already entered into an MoU with the state govt. The parent company was incorporated in 2010 and is a listed entity. It has been learnt that TEMBO Defence plans to start a small arms ammunition manufacturing facility at Amravati. It was learnt that the company entered into a tie-up with a global company famous for it handguns and rifles. TEMBO is expected to make both weapons and the rounds to be fired through them in India, said sources. The guns are expected to be made at its fabrication unit, and a separate unit for making bullets would be set up at Amravati. A PowerPoint presentation made for investors, shared with TOI, says it has entered into a strategic partnership with a European company, without naming it. Under this, the foreign partner will be buying 100% of the production output. An MoU was signed for establishing a state-of-the-art arms and ammunition manufacturing plant in India. With the presence of Ordnance Factories and private units, Nagpur and Chandrapur have already emerged as a hub for making ammunition used in artillery and armoured systems. This would be the first-ever bullet-making unit in the region. The OFs at Varangaon and Kirkee near Bhusawal and Pune, respectively, make small ammunitions too. The company's director, Sanjay Patel, said the allotment of land is a major step towards its long-term goals.

Pune civic body issues evacuation notice to residents of Padmavatinagar Society building

PUNE : The Pune Municipal Corporation (PMC) on Tuesday night ordered residents of Padmavatinagar Society's 'C wing' in Dhankawdi to evacuate the premises following a partial compound wall collapse amid heavy rain. The residents, however, refused and demanded evidence of structural instability of the 28-flat building. "You are hereby informed that upon receiving this notice, you should vacate the premises in your possession and cooperate with us to prevent any loss of life or property. If you fail to do so, we will be compelled to exercise our rights under Section 268 (7) of the Maharashtra Municipal Corporation Act, and if necessary, with the assistance of the police, to vacate the premises you are occupying," the PMC notice read. Resident Deepak Parekh, a structural engineer, said samples were collected from the site after the wall collapse on Tuesday. "These samples will be used to check the structural stability of the building. Telling the residents to vacate the premises before the structural stability test is not justified," he said. The partial wall collapse also led to a blame game between society members, as former officebearers of the society blamed the new body "for ignoring the concerns." "The civic administration must act against the illegal constructions near the compound walls to avert mishaps," Sanjay Patel, another resident of the society, said. A six-year-old girl and her two brothers (aged 12 and 13) survived miraculously after loose boulders and debris from the lower portion of the compound wall caved in amid heavy rain on Tuesday and crashed through the tin sheet wall to fall on the bed where they were sleeping. At least 15 families of roadside vegetable vendors have been residing in tin shed dwellings close to the wall. These dwellers approached PMC last year to get the society to strengthen the wall. The survivors said the housing society was to be blamed for the mishap. "If the timely action to strengthen the compound wall was taken, this mishap could have been avoided. The authorities should fix the responsibility. We should get compensation," Harshad Khandare, one of the survivors, said. According to PMC officials, a delegation of the society members visited the civic headquarters on Wednesday, where they were asked to take corrective steps. "The works for safeguarding the compound walls will be carried out by the housing society. Steps should be taken to avert such mishaps in the vicinity," Prithviraj B P, PMC additional commissioner, said.
