Sambhal violence case: Chargesheet filed against SP MP Zia Ur Rehman Barq, 22 others
The Uttar Pradesh Police have filed a chargesheet against Samajwadi Party MP Zia Ur Rehman Barq and 22 others in a case relating to the violence that erupted in Sambhal district in November, The Indian Express reported on Friday. Barq has been accused of inciting the crowd by giving allegedly provocative speeches, said a statement issued by the police in Sambhal on Wednesday. The statement said that 'some anti-social elements, criminals and certain political people to claim political relevance incited violence at the Shahi Jama Masjid' on November 24. The police claimed that they had found that allegedly inflammatory speeches and incitement to violence led to the clashes, which resulted in arson, the throwing of stones and damage to public and private property, The Indian Express reported. 'We have sent 92 people into judicial custody and are collecting evidence,' the newspaper quoted the statement as having said. 'The investigation is still ongoing, and soon, others involved will be arrested.' On November 24, violence broke out in Sambhal after a group of Muslims objected to a court-ordered survey of the Shahi Jama Masjid in Chandausi town. A trial court had ordered the survey in a suit claiming that the mosque had been built in 1526 by Mughal ruler Babar on the site of the 'centuries-old Shri Hari Har Temple dedicated to Lord Kalki'. Five persons were killed in the violence during the survey. The police said that the chargesheet was submitted in the special MP/MLA court of the civil judge (senior division) at the Sambhal district and sessions court in Chandausi in connection with a first information report filed at the Kotwali Sambhal police station, the newspaper reported. The Uttar Pradesh Police had accused Barq of inciting a mob for political gain which led to violent clashes. They alleged in an FIR that Barq visited the Shahi Jama Masjid days before the incident without permission, offered prayers and delivered provocative speeches. Twelve FIRs were filed after the violence and a Special Investigation Team was formed to look into the matter. Barq has denied the allegations, stating he was in Bengaluru at the time of the clashes. 'I was not even in the state, let alone Sambhal,' he had said after the violence. 'This is a conspiracy by the police and administration.' He had earlier criticised the court-ordered survey, stating that the mosque is a historic site. 'The Supreme Court had ruled that religious places as they existed in 1947 must remain unchanged as per the Places of Worship Act, 1991,' he said. On March 25, the Sambhal Police had served a notice to Barq over his alleged involvement in the matter. In April, the Samajwadi Party MP was questioned for about four hours by the SIT. On Thursday, Superintendent of Police Krishan Kumar Vishnoi confirmed that Barq had been charged in the case, The Hindu reported. 'The charge sheet details that late-night conversations took place between Barq and Zafar Ali, the president of Shahi Jama Masjid,' the newspaper quoted him as having said. 'They were responsible for gathering the crowd on November 22, two days prior to the widespread violence.' The chargesheet was based on 'extensive evidence' gathered during the investigation, he added. On January 3, the Allahabad High Court had stayed Barq's arrest but declined to quash the FIR filed against him and others at Kotwali police station. The court ruled that the investigation would proceed and ordered Barq to cooperate with authorities.

He also mentioned alleged arbitrary transfers of doctors under Nemi's tenure. Singh accused the CMO of negligence and unprofessional conduct, and claimed this has contributed to the deteriorating state of health services in the district. Tensions escalated after three audio clips, purportedly featuring CMO Nemi making derogatory remarks about the DM, surfaced on social media. 'This is the only DM in 75 districts who is taking credit for everything. If any meeting can happen in 20 minutes, he takes an hour to narrate stories from all around the world and exaggerates things. Now I am seeing women who go for meetings get irritated,' he was heard saying. Nemi, however, denied it was his voice and claimed it was AI-generated. The authenticity of these audio clips has not been independently verified by ThePrint. But after the matter escalated following several complaints from health officials, district magistrate Singh wrote a letter to the principal secretary of health to remove the CMO, saying that several complaints had been received against him for not following government orders, mentally harassing district health officials and seeking bribes for transfer postings. Also on Saturday, the DM confronted the CMO about the clips during a meeting. Nemi questioned the authenticity of the recordings, claiming they were manipulated using Artificial Intelligence (AI) to malign his image. Not satisfied with the response, the DM asked the CMO to leave the meeting. Responding to the charges, Nemi reiterated his innocence and alleged a conspiracy to tarnish his image. He said his sole focus was to improve the functioning of the health department. According to sources in the district administration, the DM had flagged instances of alleged negligence on part of the CMO during multiple surprise inspections over the last few months. He planned to take action after these visits. The CMO had also been reportedly absent from the office for the past few days. In the meanwhile, a photo of a saffron towel purportedly placed on his chair went viral on social media, garnering a lot of attention. Samajwadi Party MLA Amitabh Bajpai said, 'The rift between officials and BJP MLAs is common in the state, but I feel that this issue is actually between Chief Minister Yogi Adityanath and Deputy Chief Minister Brajesh Pathak. Common people are feeling betrayed by this government as corruption has not stopped.' Bajpai hinted the DM is considered close to Chief Minister Adityanath and the CMO is in the good books of Deputy Chief Minister Pathak. According to the officials, a hearing was scheduled on Thursday at the court of SDM Sambhal, Vikas Chandra. While Barq did not appear in person, his legal counsel submitted his arguments. Talking to reporters, SDM Chandra said the case is being heard under Section 10 of the Uttar Pradesh Regulation of Buildings Act, 1958. He stated that a building plan was submitted by another party, Mamlukur Rahman, during a previous hearing. A technical assessment of the plan was to be conducted by the assistant town planner from Moradabad, whose report has now been received by the court, he said. The court has decided to issue a reminder and a formal letter to acquire the final technical report. The next hearing in the matter will be held on June 26, Chandra added. Ehsan Khan, 60, a local businessman and former SP leader, was travelling with his wife Husn Bano and daughter Ariba to Kanpur to visit relatives. They stopped to refill CNG, with Ehsan still seated inside the vehicle. According to Ehsan, the pump staffer requested that he step out of the car before refuelling. Ehsan claimed he complied but objected to the manner in which the staff spoke. As per Ehsan's account, another employee arrived, and the situation escalated. One of them allegedly shoved him. Seeing this from a distance, Ariba rushed back to the car, grabbed her father's licenced revolver, and returned to the scene. What followed was captured on camera—Ariba stormed back, aimed the weapon directly at the chest of a pump worker identified as Rajneesh, and reportedly threatened, 'I'll shoot you so many times your family won't be able to recognise you." The incident caused panic among onlookers. People were visibly shaken as the young woman pointed a gun in broad daylight. Another customer reportedly intervened and managed to defuse the situation, after which the family quickly left the premises. The Aftermath The Hardoi police registered a case against Ariba, her father Ehsan Khan, and her mother Husn Bano based on a written complaint filed by the petrol pump employee. The revolver, licenced in Ehsan's name, has been seized by police. Station House Officer (SHO) Rakesh Kumar confirmed that investigations are ongoing. 'An FIR has been registered on the complaint of the petrol pump salesman. The girl's family has not submitted any complaint yet. Action will be taken based on evidence gathered during the investigation," he said. Ehsan Khan, meanwhile, posted a video defending his daughter's actions, stating she reacted only to protect him. 'The staff at the pump were not wearing uniforms. I was wearing a seatbelt and agreed to step out. But the employee became aggressive. Another man came and pushed me. Seeing this, my daughter panicked and brought out the licenced revolver in my defence," he said. Ehsan urged that CCTV footage from the petrol pump would reveal the truth and support their claims. Ariba's Version In an exclusive conversation with News18, Ariba detailed her experience. 'This was the first time I held a revolver. I've never seen anyone behave so rudely with my father before. He is elderly, and there were women present too. The staff didn't care. I feared my father wouldn't be able to handle it alone, especially since they seemed drunk and aggressive," she said. She added, 'I understand that I overreacted. I apologise to the government and request a fair investigation. The entire experience has affected my mental health and academic life. I haven't been able to sleep properly, and it's impacted my studies and future." Ariba also alleged that some of the petrol pump employees appeared to be habitual troublemakers. 'They looked like local goons. Only one or two were in proper uniform. I appeal for strict action against such people who misuse their position to intimidate customers," she said. Political Twist The incident took a political turn on Tuesday night when Hardoi's Congress district president Vikram Pandey visited Ariba's residence. He presented her with a framed picture of Rani Lakshmi Bai and lauded her actions. 'She is the embodiment of Priyanka Gandhi's slogan 'Ladki hoon, lad sakti hoon' (I am a girl, I can fight).
