‘Smell of alcohol … doesn't mean… under influence of liquor': Court acquits man who had hit a pole
Six years after a man was held by the Chandigarh Police for allegedly driving under the influence of liquor and hitting a pole, the district court of Chandigarh acquitted him observing that 'merely because smell of alcohol was coming from the accused does not mean that he was under the influence of liquor'. Accused Akshay was booked under Section 185 of the Motor Vehicle Act. As per the proseution, on June 9, 2019, at light point of Sector 22/23, Chandigarh, Akshay drove his vehicle bearing registration no. PB01A4282 in a drunken condition and hit the police. He was then apprehended and got medically examined and he was found under the influence of alcohol. Accordingly, a case was registered. The accused was arrested and his vehicle was taken into police possession. During trial in the court, a prosecution witness, Inspector (Retired) Rajinder Singh, testified that he along with Contstable Pardeep and Constable Vipin in an official vehicle bearing were patrolling. When they reached near Sector 22/23 light point, a car was coming from Sector-22 market driven in a rash and negligent manner. The car hit the dividing pole, Sector-22/23 light point. On confrontation, the said person told his name as Akshay and his breath was smelling of alcohol. Sector 22/23 Also, another prosecution witness, Dr Kriti Dayora, EMO, Civil Hospital, Sector 22, Chandigarh, stated that on June 9, 2019, the accused was brought in the emergency, Civil Hospital, Sector-22 for medical examination. She said Akshay had consumed alcohol but he was not under its toxic influence at the time of examination. Hearing the matter, Sachin Yadav, Chief Judicial Magistrate (CJM), said that, '…an accused cannot be held liable under Section 185 of M.V. Act only on the basis of general opinion of the doctor. Breath Analyzer Test or blood test are mandatory before filing Kalandra against the accused u/s 185 of M.V. Act which has not been done in the present case. Merely because smell of alcohol was coming from the accused, does not mean that he was under the influence of liquor. The accused can not be convicted only on the basis of general opinion of doctor, which is not corroborated by any scientific test…' Holding that prosecution lacks evidence, the court acquitted the accused.

Gurgaon's minimum temperature hits 30°C for first time this season
Gurgaon: The relentless heat continues to tighten its grip on the city, with the minimum temperature being recorded at 30.1°C — the highest of the season — and the maximum at 44°C on Thursday. In Haryana, Sirsa (IAF) registered the highest temperature at 46.6°C, while cities like Fatehabad, Hisar, Rohtak, and Bhiwani saw temperatures between 44°C and 46°C. Mercury in northern districts such as Ambala and Panchkula hovered between 40°C and 42°C. According to India Meteorological Department (IMD), a heat wave is declared in plain areas when the maximum temperature reaches 45°C or more, or when it exceeds 40°C with a deviation of over 4.5°C from the average. "I have never felt heat like this before," said Meena Sharma, a resident of Sector 14. "Even at night, it's impossible to sleep without the air conditioner on. We are worried about power cuts and water shortages." The IMD attributes the extreme conditions to a combination of atmospheric systems, including a cyclonic circulation over Punjab and West Rajasthan, and a weak western disturbance. According to Rajinder Singh, a shopkeeper in Sector 95, his business took a hit due to the heat. "Business is down because people don't want to step out. We have started keeping cold water and ORS sachets for customers, but even that is not enough," he said. Meanwhile, the forecast too, offered little hope for relief. "From June 12 to 14, heatwave to severe heatwave conditions are expected to persist. Light to moderate rain may occur at isolated places between June 15 and 16, followed by thunderstorms and gusty winds from June 15 to 18. A slight dip of 2–4°C in maximum temperatures is anticipated after June 15," said an IMD official. The weather department also issued an advisory, asking residents to stay hydrated, avoid direct sunlight between noon and 4pm, and wear light and breathable clothes. Dr Vishwas Chitale, senior programme lead, CEEW, said, "Various north Indian cities such as Delhi, Amritsar, Ludhiana, and Jalandhar are reeling under heatwave conditions. IMD has issued a red alert for a severe heatwave for the next 48 hours in some of these cities. For those working under the sun, adequate cooling shelters should be provided and at public places, clean and cold drinking water facilities must be established along with medical first-aid and ORS. Ludhiana MC joins hands with SHGs to turn city greener
Ludhiana: To boost greenery and community involvement, the municipal corporation has rolled out the 'Ek Ped Maa Ke Naam' campaign across the city. As part of this nationwide initiative by the ministry of housing and urban affairs, 40 self-help groups (SHGs) under the National Urban Livelihood Mission (NULM) have joined hands with civic officials to drive the mission forward. The 3-day first phase, titled 'Women for Trees', kicked off on May 21 and saw SHG members and officials identifying around half a dozen key plantation sites. The next phase of the green drive is set to begin on June 5. Executive engineer Jatinder Pal Singh, LSO Rajinder Singh, SDO Gurneelam Kumar, JE Kirpal, Urban Planner Birinder Kaur, CMMs Jaspreet Kaur, Rajinder Kaur, and Deepak Shahi, among others, are part of this initiative. The officials shared that the members of SHGs have been provided required kits and training for taking up plantation drives. The SHG members would also be given the responsibility of maintaining the saplings planted under the campaign, with financial incentives also to be provided for the same. MC commissioner Aaditya Dachalwal appealed to the residents to join this initiative and work for spreading greenery in their surroundings. Guru Granth Sahib Saroops moved to Amritsar from border areas amid India-Pakistan tensions
Tarn Taran (Punjab) [India], May 9 (ANI): Amid heightened tensions between India and Pakistan, the holy saroops of Sri Guru Granth Sahib were shifted to Gurdwara Ramsar Sahib in Amritsar from the Singh Sabha Gurdwara in Havelian village of Tarn Taran on Friday. Manager of Golden Temple, Rajinder Singh, said that the holy saroops of Sri Guru Granth Sahib are being shifted to safer locations. 'Given the heightened tensions between India and Pakistan, members of the Shiromani Gurdwara Parbandhak Committee (SGPC) have visited the villages and, after the consent of Granthis of the Gurdwara, the holy saroops of Sri Guru Granth Sahib are being shifted to safer locations. This is a village along the holy saroops of Sri Guru Granth Sahib are being shifted to Gurdwara Ramsar Sahib in Amritsar,' Singh told ANI. Earlier today, the Punjab government cancelled all leaves approved for the IAS and PCS officers across the state. It has also been instructed that no officer shall proceed on any kind of leave or move from station of posting without the explicit approval of the Chief Secretary. Indian national charged with CBT granted RM50,000 bail

(Reuters pic) PETALING JAYA : An Indian national company director facing a charge of criminal breach of trust (CBT) was granted bail of RM50,000 today with two local sureties by the Kuala Lumpur High Court. Bernama reported that Justice K Muniandy granted the application after hearing a bail review submitted by lawyer Daniel Annamalai, who represented Rajinder Singh, 57, following the sessions court's earlier decision to deny bail. 'The court allows the applicant to be released on bail of RM50,000 with two Malaysian sureties, with the additional condition that his passport be surrendered to the court,' he ruled. Earlier, deputy public prosecutor Izalina Abdullah informed the court that the prosecution had proposed bail of RM70,000 at the sessions court, but it was ultimately subject to the discretion of the presiding judge. 'Should this court allow the applicant to be released on bail, we propose the same amount of RM70,000 with two Malaysian sureties and the additional condition that the applicant surrender his passport to the court,' she said. Daniel also submitted that the sessions court had denied bail on the grounds that his client is a foreign national. However, he informed the High Court that Rajinder had been residing in Malaysia for eight years for employment purposes and holds valid travel documents. 'The proposed sum of RM70,000 is excessive for my client. We respectfully request that bail be set at RM40,000 should this honourable court be minded to grant bail,' he said. On May 5, Rajinder pleaded not guilty in the sessions court to a CBT charge involving RM141,486 belonging to Vantage Trading Partners, entrusted to him as an authorised signatory of the company. He allegedly committed the offence at the company's premises at Ilham Tower, Jalan Binjai, on Oct 13, 2021, and Nov 26, 2021. Rajinder was charged under Section 409 of the Penal Code, which provides two to 20 years' imprisonment, caning and a possible fine upon conviction. The accused also claimed trial to an alternative charge of misusing the same funds without the consent or ratification of a general meeting, at the same location and on the same dates, under Section 218(1)(a) of the Companies Act 2016, which provides a maximum penalty of five years' imprisonment, a fine of up to RM3 million, or both.
