ActionSA demands Batohi's removal over NPA's ‘growing failures'

ActionSA has asked the justice minister to initiate Batohi's removal and begin a process of investigating deep-rooted dysfunction within the NPA. ActionSA members yesterday marched and protested outside the office of the minister of justice in Pretoria to demand the removal of the national director of Public Prosecution Shamila Batohi due to what it described as the growing list of failures by the NPA under her leadership. Action SA president Herman Mashaba led the protest, which saw some victims sharing their injustices by the NPA before a memorandum of demands was signed and handed over to a representative of the minister. Demands to justice minister In the memo, the party demanded that the minister, as the Cabinet member responsible for justice and constitutional development, engaged President Cyril Ramaphosa to exercise the powers afforded him under Section 12 of the National Prosecuting Authority Act and initiate the formal process for the removal of Batohi. A call for Batohi's suspension and investigation into NPA Mashaba said the process must begin with her immediate suspension, pending an investigation into the systemic dysfunction in the NPA. 'South Africans are clear in their demand for us to fight to end the culture of impunity and to put the institution on notice that it must either deliver, or face the consequences,' he said. 'Genuine sense of hope' Mashaba said Batohi's appointment in December 2018 was intended to mark a break from the dark era of state capture, a period marked by political interference and institutional decay. 'Her arrival was met with rare national consensus and a genuine sense of hope that justice would finally be restored and those responsible for looting the state would be held accountable. Yet, nearly six years later, that hope has curdled,' he said. NOW READ: Batohi clarifies NPA infiltration claims to justice minister amid criticism

Iranian-Born Son Falsely Registered As Kuwaiti, Rises To Become Pilot

KUWAIT CITY, June 20: A long-hidden case of citizenship fraud was exposed in Kuwait following the death of a Kuwaiti man, revealing that his alleged son—an Iranian by birth—had been falsely registered as a Kuwaiti citizen since 1986. According to detailed investigations, the fraud began when an Iranian woman, after divorcing her Iranian husband, married a Kuwaiti man. With his cooperation, she added her son from the previous marriage to his citizenship file. The child, born in Iran, was officially registered as the Kuwaiti's biological son, allowing him to benefit from full citizenship rights, including access to education and government services. He eventually became a pilot in Kuwait under this false identity. The truth unraveled in 2021, when a dispute erupted among the children of the deceased Kuwaiti man over inheritance. Suspicions were raised about one half-brother, who appeared to have no legitimate paternal link. The family lodged a formal complaint, prompting the Public Prosecution to order DNA testing. The tests, which included samples from the deceased man's brother, confirmed that the accused individual was not biologically related to the Kuwaiti father. Further investigations revealed that the individual had knowingly perpetuated the fraud. He renewed his Kuwaiti passport and civil ID multiple times using false information, fully aware of his real origins. The court sentenced him to seven years in prison for forgery and fraud. However, by the time the verdict was issued, he had already fled Kuwait for Iran. As a result, the ruling was issued in absentia. Authorities also discovered irregularities in the man's citizenship file, including three separate family affiliations, raising further questions about how the fraudulent identity remained undetected for so long. The case underscores Kuwait's continued efforts to detect and prosecute cases of citizenship fraud, particularly those involving falsified family links.

Kuwaiti man acquitted in drug use, DUI after appeal

KUWAIT CITY, June 19: The Court of Appeals overturned the two-year prison sentence imposed on a Kuwaiti citizen with a criminal record, and then acquitted him of drug use and driving under the influence due to invalid procedures. Earlier, the Public Prosecution charged the defendant with the possession of psychotropic substances for personal consumption, as he allegedly failed to prove that he obtained a permit to do so. He was found to be a repeat offender and was sentenced to three years and four months in prison with hard labor for another felony. He also drove under the influence of amphetamine -- a psychotropic substance -- despite being a repeat offender, as described in the charge sheet. Attorney Mohammad Jaber Baqer, the lawyer of the defendant, appeared before the Court of Appeals, where he argued that the search of his client was invalid because it was conducted outside the legally prescribed circumstances, and that the defendant had denied the incident from the beginning of the investigation. The court accepted the arguments of Baqer and based its ruling on the legality of the initial arrest and the limits of the subsequent search, which were intended to strip the arrested person of any weapons or tools that might aid him in escaping or harming himself or others under Article 51 of the Code of Criminal Procedure. The court found that the search of a small box in the defendant's possession exceeded the limits; as such a box could not contain a weapon or a means of escape or harm. It then ruled that this search is invalid due to exceeding the legal purpose and the invalidity of the evidence derived from it. The court declared that all the narcotics seized from the defendant, which were purportedly inside the small box, are considered inconclusive. It added that such evidence cannot be used as basis for a conviction ruling as it was a direct result of an invalid procedure. It added that the case documents lacked any other legitimate evidence that could prove the first and second charges after excluding the invalid evidence.
