Teen rape survivor gives birth in MP's Jabalpur; accused held
A 16-year-old girl, allegedly raped by a man who befriended her on social media, gave birth at a government hospital in Madhya Pradesh's Jabalpur, police said on Friday. The police on Thursday arrested the 21-year-old accused, who had earlier forced the girl to consume abortion pills, additional superintendent of police Suryakant Sharma told reporters. He said the accused befriended the girl on Instagram last year and allegedly raped her in a hut on the outskirts of a village in October. The official said that when the girl told the accused about the pregnancy three months later, he allegedly forced her to consume abortion pills. As the pregnancy could not be terminated, he promised to marry the teenager, but later backtracked. The girl, who lives with her father in a village, experienced labour pain on Tuesday night, and he found out about the pregnancy, the ASP said. He said the girl was referred to the government medical college and hospital, where she gave birth on Wednesday. The hospital management informed the police, following which a case under relevant provisions of the Bharatiya Nyay Sanhita and Protection of Children from Sexual Offences (POCSO) Act was registered against the accused, the official said.

Girl, 9, raped by ‘father's friends' in Noida Sector 21; 3 arrested
Police have arrested three men for allegedly raping a nine-year-old girl over the past month in Noida's Sector 21, officials said on Thursday. The accused, who police said are friends of the victim's father, were booked under relevant sections of the Protection of Children from Sexual Offences (POCSO) Act and the Bharatiya Nyaya Sanhita (BNS). The horrific case came to light on Tuesday when the girl's father took her to a private hospital after she complained of persistent illness. During the medical examination, doctors confirmed signs of sexual assault and immediately alerted the authorities. According to police officials, the victim is a Class 1 student who lives with her father and two siblings—an elder brother and younger sister—in the servant quarters of a house where her father is employed. The family has resided in Sector 21 for about 25 years, and the parents are currently separated. The three accused—a 35-year-old from Sector 123 who irons clothes; a 50-year-old security guard who lives in Sector 48; and a 55-year-old from Harola who is a driver —were regular visitors to the family's home. HT is not identifying the three men because it could lead to the victim's identification as well. 'These men were regular visitors to the family's home and took advantage of their access to target the child when she was alone,' explained a senior police officer involved in the investigation, speaking on condition of anonymity. The victim's elder brother explained how the family uncovered the rape. 'My sister was feeling unwell the past week. When her health started to deteriorate, she informed my father that his friends had sexually assaulted her,' he told HT. 'The doctors confirmed the assault during examination and informed police, after which we filed a formal complaint.' Police confirmed that they were informed by doctors at the private hospital. 'Once we got the information, we rushed to the spot and counselled the minor. The girl revealed that her father's three friends who also work close to her home allegedly raped her in three different dates in the last one month,' said a senior police officer, part of the investigation requesting anonymity. Additional deputy commissioner of police Sumit Shukla outlined the charges: 'We have registered the case under BNS sections 137(2) for kidnapping, 74 for assault or criminal force to woman with intent to outrage her modesty, and 65 for rape, along with relevant POCSO Act sections at Sector 20 police station.' The three suspects were arrested on Wednesday and remanded to judicial custody before being produced in court on Thursday. Investigators are working to determine if this was an isolated incident or part of a broader pattern of abuse. 'We are thoroughly examining all claims made by the survivor and her family,' ADCP Shukla added, noting that the girl's condition is currently stable. The case has sent shockwaves through the area, raising questions about child safety and the vulnerability of domestic workers' children. Police have assured the public of a thorough investigation and strict legal action against the perpetrators.

'No Leniency In POCSO Cases': Chhattisgarh HC Upholds 20-Year Jail Term For Minor's Gangrape
Last Updated: Citing SC precedents, the high court said a rape survivor's statement, especially sexual assault cases concerning children, need not be corroborated if it inspires confidence The Chhattisgarh High Court upheld the conviction and 20-year jail term to three men for the gangrape of a 13-year-old girl during a wedding celebration in Kondagaon district. The bench of Chief Justice Ramesh Sinha and Justice Bibhu Datta Guru dismissed their appeals, observing that the trial court had rightly convicted them under Section 6 of the Protection of Children from Sexual Offences (POCSO) Act. 'Any act of sexual assault or sexual harassment to the children should be viewed very seriously and all such offences of sexual assault, sexual harassment on the children have to be dealt with in a stringent manner and no leniency should be shown to a person who has committed the offence under the POCSO Act," the division bench wrote in a headnote to the judgment. The incident took place on April 26, 2019, when the girl and her friend stepped out of a crowded wedding venue in Makdi village to go to a nearby field. The survivor testified that four men dragged her away and took turns to rape her while keeping her friend restrained. She later identified the accused – residents of nearby villages. She had seen their faces in the light from their mobile phones, and was also helped by residents of Ambal village from where the groom's party was visiting. The day after the crime, she lodged a complaint with the Kondagaon police and, based on her statement, a case was registered under Sections 376D and 506 of the Indian Penal Code along with relevant sections of the POCSO Act. The minor's testimony was consistent and detailed. She clearly described the attack and identified the accused. Her medical report showed a torn hymen and vaginal injuries. Forensic tests determined semen stains on her underwear and the undergarments of the accused. Doctors confirmed that all three accused were capable of sexual activity and fresh injuries were noted on two of them. The defence, however, argued that the case was built solely from the girl's version, pointing to alleged contradictions and claiming false implication. It questioned the absence of immediate corroboration, lack of injuries on the accused, and challenged the method used to determine the girl's age. But the court was not convinced by these arguments. Referring to school admission records, the court held that the girl was 13 years old at the time of the incident, with the case attracting the POCSO provisions. The defence had offered no proof to rebut this. Citing Supreme Court precedents, the high court said a rape survivor's statement, especially sexual assault cases concerning children, need not be corroborated if it inspires confidence. 'A girl or a woman in the tradition bound non-permissive society of India would be extremely reluctant even to admit that any incident which is likely to reflect on her chastity had ever occurred," the court observed. It added: 'She would be conscious of the danger of being ostracised by society and when in the face of these factors the crime is brought to light, there is inbuilt assurance that the charge is genuine rather than fabricated." Calling such crimes 'a degradation not only of the body but also of the soul", the court said there was no reason to interfere with the lower court's findings. The conviction is supported by consistent eyewitness testimony, medical findings, forensic confirmation, and absence of any credible defence, the bench said while dismissing the appeals. Ghaziabad: 32-yr-old man gunned down by bike-borne assailants outside police station
A 32-year-old man, who had come to file a first information report (FIR) in relation to firing at his house by two bike-borne assailants, was gunned down by the same suspects outside the Muradnagar police station in Ghaziabad on late Wednesday night. The police identified the deceased as Arun Sharma who was the son of Ravinder Sharma, the national vice-president of Bharatiya Kisan Union (Bhanu). The family is a resident of Milak Rawli village in Muradnagar. According to police, an altercation started between Ravinder Sharma and two suspects, identified as Monty (single name) and Ajay Chaudhary, following a road rage incident around 7:30pm on a road near Rawli. 'They had some heated exchange over the passage of their cars. Later, around 9pm, the two suspects arrived on a bike and fired shots at Ravinder Sharma's house and fled. Sharma then called the police. We went to the house of Monty, but he was not found. The police then asked Sharma to come to the police station to register an FIR,' said Surendra Nath Tiwary, deputy commissioner of police (DCP) of the rural zone. 'It was around 11:45pm when the two suspects arrived on a bike and opened fire just outside the police station and again fled. One shot hit Ravi Sharma and killed him. We have formed five teams to trace the two suspects, and an FIR has been registered against them,' DCP added. Ravinder Sharma, father of the deceased, said that the two bikers fired about 4 to 5 shots from a pistol right outside the Muradnagar police station. 'During the firing outside the police station, four policemen were near us, but none of them opened any retaliatory fire even though we insisted. They just started preparing videos of the incident. We rushed my injured son to a nearby hospital, where he was declared dead. We kept his body outside the police station on Thursday morning and demanded that the two suspects should face police encounter and ample security should be provided to my family,' Ravinder Sharma said. The police said that prime suspect Monty had come out of jail last year after serving imprisonment in a 2015 case in which he was convicted under charges of Protection of Children from Sexual Offences Act (POCSO) and rape of a minor girl. Following the incident, senior officials of the Ghaziabad police Commissionerate suspended the station head officer (SHO) of Muradnagar police station, a sub-inspector who was the night officer, and another sub-inspector who is the beat police officer of the concerned areas, the police said in a statement.
